Better known as “Hollywood,” William Difonzo, Jr. was accused of punching and killing a man at a bar in Lake Worth, Florida in February 2017.Prosecutors announced Friday they have dropped the manslaughter charge against Difonzo, 27, citing lack of evidence, in the wake of him claiming “Stand Your Ground.”Palm Beach County Sheriff’s Office deputies arrested Difonzo on June 26, claiming he fatally punched Sebastian Paz in the face at the suburban Lake Worth bar. Deputies say the altercation began when one of Paz’s friends tried saying hello to Difonzo in the parking lot of the bar, but Difonzo was upset and told the man to go away. A woman told the man to go inside because “Difonzo tends to be problematic,” the report states. The man went inside the bar, but shortly thereafter went back outside to smoke. Difonzo moved towards the man in the parking lot, clenching his fist. Paz jumped in between the two, looking to stop a potential fight.A second witness told investigators Paz “had his arms crossed invading Difonzo’s personal space” as an argument broke out between the men.Difonzo punched Paz hard in the face, according to the arrest report. Paz fell straight back onto the asphalt in the parking lock, hitting his head on a concrete parking stop. He immediately started bleeding from his mouth and nose.Difonzo left the scene right away, according to a detective’s notes.“Paz didn’t deserve to die,” a woman who witnessed the punch told investigators.Paz was declared deceased the next morning in the hospital. The Palm Beach County Medical Examiner’s office determined Paz’s cause of death was blunt force trauma and ruled the manner of death as a homicide. Four months later, Difonzo was booked into the Palm Beach County Jail.Difonzo’s attorney Steven Bell said those witness’ stories changed once people were called into deposition. “All eyewitnesses have testified that they either did not see how the fight began or that Mr. Paz was the initial aggressor and [Difonzo] acted in self-defense,” Bell said.That’s why Bell says in December he filed a motion to dismiss the manslaughter charge against Difonzo based on statutory immunity, better known as the “Stand Your Ground” defense.In the motion, Bell cited a change in Florida law in June 2017 that shifts the burden of proof from the defense to the state. “It is now the state’s burden to show by clear and convincing evidence that [Difonzo] did not act in self-defense,” Bell wrote.  A hearing on the stand your ground defense was scheduled for March 26.Just days before, prosecutors announced they would no longer prosecute Difonzo on the manslaughter charge on Friday. Prosecutors said in court documents that “although there was probable cause to make an arrest, the evidence cannot prove all legally required elements of the crime alleged and is insufficient to support a criminal prosecution.”“It was dismissed because he stood his ground, he defended himself,” Bell told WPTV. “He was essentially cornered outside of a bar”But, he remains behind bars at the Palm Beach County Jail. Court records show Difonzo pleaded guilty to driving with a suspended license in a crash that killed one of his passengers in Jan. 2013. He was sentenced to three years in prison and two years probation, which was scheduled to end on May 3. His license was suspended in 2011 for driving under the influence, records state. In addition to the manslaughter charge, Difonzo was charged with violating his probation for getting arrested. He was also charged with testing positive for drugs and not reporting to his probation officer from Jan. 2017 until the time of his arrest in June.Several court documents report Difonzo as a known gang member. On Monday, Difonzo pleaded guilty to violating his probation by testing positive for drugs and absconding from justice. The violation charge for his manslaughter arrest was dropped.He was sentenced to five years in prison, with credit for three and a half years he has already spent behind bars. Bell had asked the judge to sentence him to time served.“I respect the judge’s decision, but it’s not what he wanted,” Bell said.Bell said he was relieved for Difonzo and Difonzo’s family when he learned the state had dropped the manslaughter charge.“He was innocent so he was properly nolle prossed and dismissed.” Bell said Difonzo would have claimed “Stand Your Ground” even under the original rules of the law.Difonzo could have faced 15 years in prison if convicted of manslaughter, according to Bell.Former Palm Beach Gardens police officer Nouman Raja has also filed a "Stand Your Ground" motion to dismiss the manslaughter and attempted murder charges against him in the death of Corey Jones. BOSTON (AP) — Prosecutors dropped a case Wednesday accusing Kevin Spacey of groping a young man at a resort island bar in 2016, more than a week after the accuser refused to testify about a missing cellphone the defense says contains information that supports the actor's claims of innocence.Spacey was charged with indecent assault and battery last year in the only criminal case that has been brought against the actor since his career collapsed amid a slew of sexual misconduct allegations. The two-time Oscar winner was among the earliest and biggest names to be ensnared in the #MeToo movement against sexual assault and harassment that swept across the entertainment and other industries.Spacey denies groping the man, whose mother first went public with the allegations in 2017.A phone message seeking comment was left with Spacey's lawyer.The actor's accuser was ordered to take the stand earlier this month after he said he lost the cellphone he used the night of the alleged groping. The defense said it needed the phone to recover deleted text messages it says would help Spacey's case.The man denied deleting messages or manipulating screenshots of conversations he provided to investigators. But when he was pressed by the defense about whether he knew that altering evidence is a crime, he invoked his Fifth Amendment right against self-incrimination, and the judge said his testimony would be stricken from the record.The judge then questioned how prosecutors would be able to bring Spacey to trial if the accuser continued to refuse to testify, and prosecutors told the judge they needed time to decide how to proceed.On Wednesday, Cape and Island District Attorney Michael O'Keefe said in court documents that they were dropping the charge "due to an unavailability of the complaining witness."The hearing at which the accuser testified came days after the man abruptly dropped a lawsuit he had just recently filed against the actor that sought damages for "severe and permanent mental distress and emotional injuries." The suit was dismissed "with prejudice," meaning it cannot be refiled.The man did not receive a settlement to drop the civil case, his mother said. His lawyer said he dropped it because he was emotionally overwhelmed and wanted only "one roller coaster ride at a time" and so chose to focus on the criminal case.The man's mother, former Boston TV anchor Heather Unruh, alleged in 2017 that Spacey got her son drunk and sexually assaulted him at the Club Car, a bar on Nantucket where the teen worked as a busboy.The man told police he went over to talk to Spacey after his shift because he wanted to get a picture with the former "House of Cards" star. He said Spacey bought him several drinks and tried to persuade him to come home with him before unzipping the man's pants and groping him for about three minutes.Unruh's son told police he tried to move Spacey's hands, but the groping continued, and he didn't know what to do because he didn't want to get in trouble for drinking because he was underage. The man said he fled when Spacey went to the bathroom.Shortly after Spacey was charged, he posted a video on YouTube in the voice of his "House of Cards" character who was killed off after the sexual misconduct allegations emerged, saying "I'm certainly not going to pay the price for the thing I didn't do."Spacey has faced several other accusations.His first accuser, actor Anthony Rapp, said Spacey climbed on top of him on a bed when Rapp was 14 and Spacey 26. It’s allowed me to go college in New York and California for free.”He started out playing drums at Leith Walk Elementary in East Baltimore.He quickly realized he wanted to make a change from percussion to brass.“I couldn’t take the instrument home for a whole two weeks, because we couldn’t take an instrument home until we got a sound out of it. Until we were able to play it.”After two weeks he could make a sound and has been bending pitches since.He’s been able to meet his idols like Theljon Allen, Christian Scott, and Clarence Ward.“They have made me more curious about being a black creator. About pushing the envelope, pushing the boundaries of the trumpet. Not putting it in a box. BOCA RATON, Fla. - Inside Boca Helping Hands, Mel Lazerick mans the pantry desk and hands out apples and bags of produce."I like to do things for other people because I've been fortunate," said Mel, who has devoted most of his life volunteering.At 100-years-old, Mel is the oldest volunteer and donates his time to help feed the hungry three days a week. Executive Director Greg Hazle describes Mel as an inspiration."Just to be active at that age and active helping people is an inspiring way to live," Hazle said.Mel has been handing out groceries at Boca Helping Hands for 20 years with a smile and a sense of humor."I worked it in with my golf and tennis, and I was able to find time," Mel said. "People are very nice to me, and I try to be nice to them."Mel moved from Ohio years ago and settled in South Florida. He recently celebrated his 100th birthday at Helping Hands, and has worked side-by-side with long-time buddy Harold Bader."He's very well-liked. He's very hard-working, even though he's 100," said Bader, who picks Mel up and drives him home. "It made me realize age has nothing to do with your abilities to do things, and he proves that every day.Mel has been volunteering for decades. He joined Big Brothers and Big Sisters more than 70 years ago, and he still keeps in contact with his two younger brothers."One is 65-years-old and one is 92," Mel said.Now, Mel will be honored for his service on October 20, when Boca Helping Hands will celebrate its volunteers.
