A California coffee shop refused service to a customer last week after he insulted a Muslim woman and her headscarf.According to KTLA-TV, the video was shot inside of a Coffee Bean & Tea Leaf store in Riverside, California on Friday. The video opens with a man standing in line for coffee."I said, 'Is this Halloween or something?" the man says."Why did you say that?" the woman filming asks."Why wouldn't I? A federal judge ordered the Trump administration to fully restore the Deferred Action for Childhood Arrivals program Friday and accept new applicants for the first time since 2017, according to media reports.A judge with the U.S. District Court in Brooklyn told the Department of Homeland Security to post a public notice by Monday that states they will accept DACA petitions from immigrants who qualify and are not currently enrolled.The judge also instructed DHS officials to grant approved applicants work permits that last two years, and not the one year limit the Trump administration had proposed, according to CBS News."DHS is DIRECTED to post a public notice, within 3 calendar days of this Order, to be displayed prominently on its website and on the websites of all other relevant agencies, that it is accepting first-time requests for consideration of deferred action under DACA, renewal requests, and advance parole requests, based on the terms of the DACA program prior to September 5, 2017, and in accordance with this court's Memorandum & Order of November 14, 2020," the judge wrote.The Trump administration tried to end DACA in 2017, but the U.S. Supreme Court ruled against him in June 2020. Wolf issued a memo in July saying that new applications for DACA would not be accepted and renewals would be limited to one year. The memo essentially suspended the program.Friday’s order follows a ruling in November from the same judge that found acting DHS secretary Chad Wolf did not have the legal authority to close DACA to new applicants, shorten the period for work permits or change protections from deportations.The judge ruled at the time Wolf’s appointment to his position violated the Homeland Security Act of 2002. In his ruling, the judge wrote DHS failed to follow an order of succession established when then-Secretary Kirstjen Nielsen resigned in April 2019.The nonpartisan Government Accountability Office determined in August that Wolf’s appointment was invalid. 2003

A man in Colorado who was sentenced to more than 300 years in prison for child sex crimes in 2015, is now walking free after his conviction was thrown out on a technicality.Michael Tracy McFadden, 46, was convicted for 19 counts of sexual offenses, including a habitual sex offender against children, according to KKCO. McFadden was released from the Arkansas Valley Correctional Facility on Tuesday.In June, the Colorado Court of Appeals found that McFadden's right to a speedy trial was violated when the judge in the case granted a continuance. When the court ruled that his statutes were violated, they threw out his conviction."Frankly I'm completely appalled with the decision," District Attorney Dan Rubenstein told KREX. "I find it offensive that our justice system would allow this to happen."Rubenstein explained to KREX that speedy trials are broken down into two categories: constitutional and statual.Constitutional speedy trials have no timeframe, depending on the case. However, in Colorado, statutory speedy right trials require a time frame of six months.Rubinstein told reporters, “Because the error here was that he shouldn’t have been tried longer than six months from the last time he waived speedy trial, there was no remedy for that, and therefore there is no ability to retry him." "The justice system completely failed in this situation. If you've heard the phrase 'got off on a technicality,' this is the phrase to the most stark sense I've ever seen it," said Rubinstein.Reports state that McFadden has been exonerated from all of his charges and does not have to register as a sex offender. 1661

A Cuyahoga County (Ohio) Sheriff's Department employee was on the job when he overdosed in the parking lot of a Brooklyn IHOP in March.Paul Grivas has a badge with the sheriff's department where he works as a process server — someone who serves warrants and subpoenas. He was in his marked sheriff's department vehicle when someone noticed him slumped over at the wheel and dialed 911."It was definitely a different situation dealing with somebody that's in the same line of work we are," Officer Joe Bugaj with the Brooklyn Police Department said.Police officers found several subpoenas he was in the process of serving in the back seat. They also found the badge he was carrying.When Brooklyn first responders arrived at the scene, they immediately recognized he was overdosing and unresponsive.Grivas was given several doses of Naloxone, the antidote for heroin. Police say when he woke up he was extremely combative. "He was flailing his arms, kicking his legs, and one of the medics ended up getting kicked in the head," Bugaj said.He kneed a fireman so hard, the fireman suffered a mild concussion. Officials say he is doing okay.Bugaj said it's not uncommon for people to wake up from an overdose and be aggravated. He said it's something first responders have to keep in mind. "You never know what could happen, whether or not they're going to be upset, because we are basically taking that high away from them," Bugaj said.When asked if there is anything first responders can do to protect themselves, Bugaj said it's just part of the job."It's our job. It's what we signed up to do. We are here to preserve life," Bugaj said.Scripps station WEWS in Cleveland requested more information on Grivas' status with the sheriff's department, but did not hear back Wednesday. Grivas has been charged with felonious assault and obstructing official business.  1998
