Uber and Lyft are pushing a proposition this November they say is vital to their survival in California.And the ads are already starting. At issue is Proposition 22, which would carve an exemption into state law to allow the rideshare companies to continue employing drivers as independent contractors. Otherwise, they would have to reclassify the drivers as employees, guaranteeing them a swath of rights and protections, as mandated by Assembly Bill 5, which the state passed in 2019. Prop 22 would allow the rideshare companies to continue employing drivers as independent contractors, but guarantees them a minimum pay and also money for health insurance once they work a certain number of hours. "I only do this because it fits my lifestyle and what I do," said Chelsea Scott, a San Diego musician who drives for Uber and Lyft. "We're not getting benefits. We don't get any of those things, and I knew that coming into this. This wasn't a trick of any kind."Uber, Lyft, and Doordash released a new 30-second television ad that makes claims about the timing and impact of the law. First, it says California politicians passed AB 5 amid skyrocketing unemployment. Truth be told, the bill was signed into law in September 2019, before the coronavirus was even discovered. At the time, the state's unemployment rate was 4.2%. In August, it was 13.3%.However, the ad follows that with a key point, under AB 5, it will be illegal for rideshare drivers to operate as independent contractors in California. The narrator says that is "threatening to shut down rideshare and food delivery services." Truth be told, AB 5 does not shut down the services, but the services themselves could make the decision to shut down, which Uber and Lyft threatened to do in California last month after a court decision did not go in their favor. San Diego employment attorney Dan Eaton says overall the core point of the ad stands that jobs could be cut."They're saying, 'All right, fine, don't do this, but then don't complain when Uber and Lyft pull out of California,'" he said. The ad says Prop 22 "protects" drivers' abilities to work as independent contractors and saves critical jobs. For voters, however, it's all about whether they see being an independent contractor as protection in and of itself. 2296

UPDATE 6:04 PMThe bus driver, a 52-year-old man from Whittier, Calif., survived with minor injuries and was speaking with CHP investigators. 10News learned the charter bus originated from El Monte in East Los Angeles and made multiple stops en route to San Ysidro, including Riverside and Murrieta. The bus crashed about 20 miles south of Murrieta in Pala Mesa.Three females, described as Hispanic, were killed in the crash, authorities said.According to officials, a five-year-old male passenger was transported to Riverside University Health Systems Medical Center, about 50 miles north from the scene of the crash.Five other passengers were transported to Palomar Hospital, seven were transported to Temecula Valley Hospital, and five were taken to Inland Valley Hospital. Their conditions are unknown at this time.California Highway Patrol said the bus was equipped with seat belts. (KGTV) — At least three people were killed and 18 other people were injured after a charter bus crashed and overturned on Interstate 15 Saturday.The bus was on southbound I-15 just south of State Route 76 before 10:30 a.m. The bus lost control for some reason, skidding into the dirt on the freeway's shoulder and overturning.Officers arrived to find the bus overturned with at least one passenger trapped inside still. Crews also needed to stabilize the bus to prevent it from falling down an embankment.At least three people were killed, according to North County Fire Protection District (NCFPD). One victim was found dead inside the bus, NCFPD Capt. John Choi told City News Service. Some passengers were ejected from the crash.Eighteen people were taken to Inland Valley Hospital, Palomar Medical Center, and Temecula for injuries ranging from minor to critical condition. The ages of passengers ranges from minors to adults.The bus driver, a man from Whittier, Calif., survived with minor injuries and was speaking with CHP investigators. The bus was traveling from the Los Angeles area to San Ysidro.A Sig Alert was issued for the area after lanes of traffic on SB I-15 were closed for first responders to work in the area.Crews from Camp Pendleton, CalFire, Pala Mesa, Vista, and Oceanside were assisting, Choi told CNS.10News is monitoring this breaking news. (KGTV) — A nine-hour standoff between San Diego SWAT officers and a Valley Center man ended with the suspect peacefully surrendering to authorities.William Halverson was arrested hours after the standoff unfolded in the early hours Saturday. He faces multiple charges, including domestic violence, elder abuse, and felon in possession of a firearm, according to San Diego Sheriff's Department.Deputies were called to a home in the 12000 block of Lilac Knolls Road just after 10 p.m. Friday over a verbal argument. When authorities contacted the victim inside the residence, they say they learned a dependent adult was immobilized inside.Halverson made several statements he would "kill anyone who come on his property, including law enforcement," SDSO says. Two hundred million dollars – that's how much money Monat Global says it made selling hair care products in 2017 through multi-level marketing.YouTube videos show the family behind Monat in mansions and driving fancy cars — but an ongoing class action lawsuit claims the company is nothing more than a pyramid scheme.Three recently filed class action lawsuits accuse Monat of fraud and deception."An inherent design and/or manufacturing defect in Monat hair care products causes significant hair loss and scalp irritation to many consumers," one lawsuit alleges."I'm devastated with what my hair looks like right now," said Heather Fox, a Monat customer in Phoenix."I had to cut off my hair," said Monat Market Partner Erin Ostby.Both women say Monat did them more damage than good."My dad used to always say I was like Samson from the Bible – I got my power from my hair. So it was really upsetting and I couldn't do that to someone else," said Ostby, who recently stopped selling Monat.CLICK TO SEE THE ORIGINAL COMPLAINTSThe U.S. Food and Drug Administration has received and is in the process of assessing 187 adverse event reports related to Monat products. The FDA received these reports between  Aug. 2, 2017 8/27/17 and March 9, 2018.More than 500 complaints have been filed with the Better Business Bureau in South Florida, where Monat is headquartered.  "Any reputable lab will tell you there's nothing in the products that would cause this kind of reaction in a large population – there just isn't. You can rub it in your skin, you can drink it if you like, within reason. It's not going to cause this kind of reaction," Monat Spokesperson Gene Grabowski said in a phone interview.But the company's repeated response to BBB complaints states that, "although Monat's ingredients are naturally-based, safe, pure and sustainable, we understand that some may experience a reaction and should discontinue use."The class action lawsuits claim the products use numerous "harsh chemicals" and "known human allergens."  One controversial ingredient the suit highlights is Capixyl – containing red clover – which some say should be on a warning label."Yes, there should be a warning label, but only if the amount was higher," Grabowski said.The University of Maryland Medical Center says women with a history of breast cancer should avoid red clover due to its estrogen-like effects in the body. It also says red clover may interfere with the liver's ability to process some drugs."The amount of red clover used (red clover extract) is so small that it would have no effect," said Grabowski.According to the FDA, cosmetic companies are responsible for ensuring the safety of their own products, which in most cases don't require government approval before they go on the market."We do tests before we send them to market and we know they're safe," said Grabowski. "I mean, those aren't clinical tests."Monat's website shows the clinical tests they did utilized one active ingredient per study.As the class action lawsuits were recently filed, Monat has not yet responded to the claims in court.    3161

  

Ultimate Fighting Championship star Conor McGregor was charged with three counts of assault and one count of criminal mischief after an alleged bus attack, the New York Police Department said Friday.Bail for the fighter was set at ,000.Police arrested McGregor following the incident Thursday at the Barclays Center in Brooklyn.McGregor allegedly threw something through the window of a minibus, injuring a passenger, according to an NYPD source with knowledge of the event.CNN could not reach McGregor's team for comment.UFC president Dana White told the website MMAjunkie that a member of a credentialed website let McGregor and his entourage of about 20 people into the arena through a door during a media day event.The group went down to the loading dock where some fighters who were to participate in UFC 223 on Saturday were getting on buses.McGregor's group attacked a bus using trash cans, metal barricades and a two-wheeled dolly, White said."This is the most disgusting thing that has ever happened in the history of the company," White told MMAjunkie."This was a real bad career move for him," White said.White said McGregor had "some sort of beef" with lightweight fighter Khabib Nurmagomedov, who was on the bus.Another fighter on the bus, Michael Chiesa, suffered head and facial cuts from broken glass, White told the website.
