SAN DIEGO (KGTV) -- A La Jolla hardware store is being forced to remove their popcorn machine they say was used to give the buttery treat to customers for free over the last 25 years.According to a food inspection report, the Meanley and Son Hardware on the 7700 block of Girard was investigated for serving popcorn without a permit."Everybody has had fun with this until now, but we have to obey the law," said co-owner Bob Meanley.One of the store's owners says the inspection happened after someone complained.A customer reportedly saw another person reach into the popcorn machine barehanded."I’m sorry we can’t continue with the popcorn, but we’ll do it with everything else," added Meanley.In the report, the inspector said the small Gold Medal brand popcorn maker was seen in use and with “popped popcorn prepared.”The report forces the hardware store to stop making popcorn and to remove the popcorn machine from the building.If the shop wants to give away popcorn, according to the health department, they’ll have to go through the permitting process. A process which will also legally require that the store install three compartment sinks. The store says staff regularly cleaned the machine and refilled it with popcorn throughout the day for customers to enjoy.The hardware shop has an extensive history in La Jolla. The store was opened in 1948 when the niece of Ellen B. Scripps along with her husband and son established the business. 1507

SAN DIEGO (KGTV) — A North Park gym owner who defied the governor's health order and moved workouts indoors was served with a violation notice from the county, threatening ,000 daily fines. Owner Frank Kole initially complied with last month's order and moved everything outdoors, but after five days made the decision to go back inside. That's because he says the sidewalks outside his gym were littered with feces, blood stains, and trash. Kole instead instituted strict rules indoors, requiring masks and social distancing. But the county, while acknowledging the tough reality outside, still served him with the violation, saying it was the law. RELATED: North Park gym moves back in after 'disgusting' outdoor workouts"I appreciate that you previously complied with the state and local orders by moving your operations outdoors and had difficulties due to the surrounding environment," said the violation letter, signed by Public Health Officer, Dr. Wilma Wooten. "I encourage you to work with the city of San Diego to see what can be done to resolve the difficulties you previously faced." On Friday, however, Kole took everything back outside. Immediately, he and his staff discovered a syringe on the sidewalk as they were setting up equipment. The city of San Diego power washed the sidewalk on Wednesday, but Kole says it was a quick job without trash pickup. "If we weren't out there cleaning that sidewalk up everyday, that needle would still be there," Kole said. A spokeswoman for the city of San Diego says environmental crews will pick up syringes with biohazard boxes when they encounter them. In the meantime, residents can report the on the city's Get-it-done App. Kole says he will comply with the order and keep the gym outside, even if it means reduced hours and more staff time moving everything in and out everyday. "I'm a proud American and I'm a proud business owner and I will do what it takes to keep my business alive," Kole said. In total, the average San Diego household spent nearly ,000 per year on expenses, according to the report by the U.S. Bureau of Labor Statistics. From 2017 to 2018, more than ,000 went to housing for the average San Diegan, accounting for nearly 36 percent of families’ household budgets. SAN DIEGO (KGTV) - A man united families across the United States after digging into a military training crash that happened 50 years ago at MCAS El Toro.Johnathan Keene often visited his cousin's grave at Arlington National Cemetery, "I go up to visit him twice a year, typically Memorial Day and Veteran's Day." On January 15, 2019, he was in the neighborhood, stopped by and it was that day that he noticed Maj. Walter Zytkewicz grave next to his cousin's grave.Maj. Zytkewicz was in the Marines, like his cousin, and died the day before his cousin. He said that 'grabbed' him.Up until that day he knew his cousin, Capt. Robert Walls, died in a military crash, but it wasn't spoken of at the dinner table.He knew there must be a connection to the two men, so he started digging. He found four other Marines were on the same training flight July 30th, 1970. "Major Zytkewicz was 2 months away from retiring," Keene said he was studying to become a realtor.Staff Sergeant Kenneth Davis, 1st Lieutenant Mullins and Corporal Kenneth Metzdorf. Keene said Metzdorf wasn't supporsed to be on the flight, "called his best friend and said hey could you go on this flight for me today? So they switched and that cost him [his life]."Keene tracked down the redacted incident report and filled in the gaps with interviews from witnesses and Marines who knew the men on board."Witnesses say they waited too late to pull the plane out of the angle of attack and the plane hit, bounced, flipped upside down, hit again, bounced in the air, the left wing fell off, all four props fell off. The plane landed right in the middle of the air field. Flames and fuel streamed down the runway, they said it was basically a long stream of fuel and fire," he said.Flames Keene was amazed to learn his cousin and Metzdorf walked through, "the report listed 80%-90% coverage of third degree burns. I can't even imagine how he walked out," he said shocked.Mullins was killed on impact, found 50 yards from the plane with a broken leg. Walls, Zytkewicz and Metzdorf died days later from their injuries.Keene said Walls died from burns in his lungs.SSgt. Davis passed in 2013.The exact cause was redacted in the report. Keene believes the Marine Corps wants to preserve the honor of the pilot and protect his family."After the crash, the material that made up Marine Corps and Navy flight suits was changed. They thought it was a flame retardant material, unfortunately it burned and melted to their skin," he said.Keene hopes these difficult discoveries will fuel Marines' admiration. To keep their memories alive, Keene created a plaque with the team's names that will be presented at MCAS Miramar, where the squadron now resides."Every other Marine that goes through that squadron will see that plaque and realize there's five men that in some way or another touched their lives from either a safety stand-point or history and lineology of VMGR-352," Keene said. 2946

SAN DIEGO (KGTV) -- A judge is expected to decide whether to release a sexually violent predator into the Jacumba Hot Springs area.Joseph Bocklett, a convicted repeat sex offender, had a placement hearing Monday morning. Because of COVID-19 restrictions, it was held virtually. ABC 10News wasn’t given permission to record it, but we did monitor what happened inside of the courtroom.The Department of State Hospitals wants to put the 75-year-old Bocklett in a home in Jacumba -- after a Judge denied a proposal to move him into a home in Pauma Valley.Bocklett was convicted of three sexual offenses over a 19-year period involving victims between the ages of 4 and 9, according to the San Diego County District Attorney's Office. He was last sentenced in 2000 to a 17-year prison term and later civilly committed to Coalinga State Hospital to undergo treatment.Though the public wasn’t allowed to physically be inside of he courtroom, they’ve been working to make sure their voices are heard, protesting this recommendation.They have got pages of signatures from residents in the East County. A few of them gathered near the courthouse holding signs expressing their concerns about the possibility of another sex offender being placed in their community.Among that group Melissa Woodall and her daughter. Woodall said rural East County shouldn’t always be the first choice when it comes to placing sexually violent predators.Woodall said, "It’s awful, it really is. There are so many people who have been put into our community who are predators.”The judge says he’ll take a few days to review the letter that were submitted and the testimony that was given before he makes his decision. 1696
