SAN DIEGO (CNS) - The Cajon Valley Union School District has joined 17 other California school districts in filing lawsuits against Juul for marketing its e-cigarettes and related products to children, attorneys said Tuesday.The suit is one of several recently filed against the San Francisco- based vaping company, which could not immediately be reached for comment regarding the litigation.Cajon Valley Union's suit is one of three filed by San Diego County school districts, joining San Diego and Poway Unified.RELATED: San Diego Unified School District suing JUULThe lawsuits allege negligence and nuisance on the part of Juul, claiming its advertising campaigns targeting young people have caused an e- cigarette "epidemic," which has "severely impacted" the school districts by interfering "with normal school operations."The school districts are also seeking compensatory damages to offset financial losses the districts allege resulted from vaping-related student absences, as well as extensive costs the districts incurred to establish outreach and education programs regarding vaping and enforcement infrastructure such as vape detectors, surveillance systems and extra staff to monitor e- cigarette use among students."The youth vaping epidemic created by Juul has significant costs," said John Fiske, shareholder for plaintiff's attorneys Baron & Budd. SAN DIEGO (CNS) - San Diego State University will not begin any of its fall sports earlier than Sept. 26 due to the ongoing pandemic, the university's athletics department announced Thursday.This follows guidance from the Mountain West Conference Board of Directors, which decided Wednesday to adjust conference team schedules to allow additional monitoring of ongoing COVID-19 developments and adjustments to keep student-athletes safe.The SDSU Aztecs football team will shrink its schedule to 10 games and most other fall sports will only play conference opponents."The Mountain West athletic directors and the conference office worked hard to develop a game plan for fall sports that will allow student- athletes to have a great experience and take in to account their health and well-being," said SDSU Director of Athletics John David Wicker. "Starting the season later allows us the opportunity to learn from professional sports and other conferences and continue to develop the best protocols possible to ensure the safest return to play model possible."The conference and school schedules align with the NCAA Board of Governors' directions, also released this week. SAN DIEGO (CNS) - Playgrounds in San Diego County can reopen to the public Wednesday, despite initially being closed under COVID-19 restrictions, after state health officials reversed course.Assemblywoman Lorena Gonzalez, D-San Diego, led a group of a dozen legislators who sent a letter to Gov. Gavin Newsom last week urging him to remove playgrounds from the stay-at-home order. They claimed opening playgrounds "is necessary for the mental and physical health of children to have opportunities to expend their physical energy and play." They also noted that in some low-income neighborhoods, "families may have little to no outdoor space of their own available."Newsom and the California Department of Public Health revised statewide public health guidelines on Wednesday to allow for public playgrounds to remain open."Every parent knows how important playgrounds are for our youngest Californians," Gonzalez said. "A huge thank you to Governor Newsom for hearing our collective concern and rethinking how we can open play structures for our kids."Playgrounds were closed earlier in the pandemic before being reopened in September. Then, with a spike in case rates and the state's issuance of a regional stay-at-home order, which took effect late Sunday night across all of Southern California, playgrounds closed again.Pressure from parents and legislators have now caused the state to reopen the playgrounds.According to the state's website, "playgrounds may remain open to facilitate physically distanced personal health and wellness through outdoor exercise. Playgrounds located on schools that remain open for in-person instruction, and not accessible by the general public, may remain open and must follow guidance for schools and school-based programs."San Diego County Supervisor Jim Desmond made a motion at the Board of Supervisors meeting Tuesday to defy the state order and not enforce the playground closure. SAN DIEGO (CNS) - The San Diego County Board of Supervisors will meet in closed session Monday to consider taking legal action against the state to prevent potentially sliding back into the most restrictive tier on Tuesday.The Board met Thursday night to discuss their options after Gov. Gavin Newsom rejected a county effort Wednesday to discount the more than 700 positive tests recorded by San Diego State University since the semester began.The supervisors did not make a decision on taking legal action against the state in their meeting Thursday, but Supervisor Greg Cox said the board will meet in closed-session Monday after receiving more information, "to consider any further actions."County Supervisor Nathan Fletcher was vague about the closed meeting Thursday, but urged caution."In general, I believe we should be fighting COVID-19 and not the state of California," he said. "We do not yet know what our case rate will be next Tuesday and will have to evaluate that number in order to understand any possible impact."The county will find out Tuesday if it will slip back to the purple tier of the state's coronavirus reopening roadmap. If so, it would likely shutter indoor operations for restaurants, movie theaters, houses of worship and gyms, limit retail businesses to just 25% capacity and have major impacts on indoor business for most other industries until the county can improve its numbers.Should the county be placed in that tier, it would have to wait a minimum of three weeks before moving back to less restrictive tiers.If state data announced Tuesday shows the county has a case rate higher than 7, it could be moved into the purple tier -- the most restrictive. However, if the numbers from the university were removed from the equation, San Diego County would suddenly drop below the mark to remain in the red tier.As of 6 p.m. Saturday, SDSU had reported 819 confirmed cases and 32 probable cases, bringing the total number of cases to 851. The university has not received any reports of faculty or staff who have tested positive, SDSU health officials said, nor have any cases been traced to classroom or research settings.San Diego County health officials reported 284 new COVID-19 infections and no new deaths on Sunday, raising the region's totals to 44,577 cases with the death toll remaining at 760.Of the 9,097 tests reported on Saturday, 3% returned positive, bringing the 14-day rolling average of positive tests to 3.6%.The seven-day daily average of tests is 8,375.Of the total positive cases reported as of Sunday, 3,404 -- or 7.6% -- required hospitalization and 800 -- or 1.8% -- had to be admitted to an intensive care unit.One new community outbreak in a grocery business was confirmed this weekend. SAN DIEGO (CNS) - Police Tuesday were searching for a man suspected of robbing a taco restaurant in the Mountain View area at gunpoint.It happened shortly before 8:50 p.m. Monday at an eatery on Ocean View Boulevard between South 36th and South 37th streets, San Diego police Officer John Buttle said.The thief walked up to the counter, pointed a black handgun at the clerk and demanded money from the register, Buttle said.The clerk complied. The gunman fled out the back door and continued running northbound on South 37th Street with an undisclosed amount of cash, he said.No injuries were reported.The bandit was described as a 5-foot-4 Hispanic man in his 20s with a thin build. He was last seen wearing a blue hooded windbreaker with a white collar.Robbery detectives were investigating the incident.v 815
