SAN DIEGO (CNS) - Four local restaurants and gyms are suing the state and county over its coronavirus restrictions as a shutdown of indoor operations looms for many county businesses. The lawsuit was filed Thursday in San Diego Superior Court on behalf of Cowboy Star Restaurant and Butcher Shop, Home & Away Encinitas, Fit Athletic Club and Bear Republic. The suit comes as San Diego County is slated to shut down indoor operations for nonessential businesses at midnight due to its recent entry into the most restrictive, purple tier of the state's coronavirus reopening plan. The businesses allege that San Diego's increased case numbers are not a result of exposures at restaurants, gyms and other types of businesses that will be impacted by the impending closures. The lawsuit cites recent figures indicating restaurants/bars, retail businesses, places of worship, schools and gyms make up a small percentage of confirmed community outbreaks.San Diego County Public Health Officer Dr. Wilma Wooten recently submitted an adjudication request to the state seeking to have San Diego County remain in the red tier. The request was rejected by the state last week."Penalizing the impacted sectors for case increases is wrong, as these sectors continue to do the right things, while trying to weather the ongoing pandemic and the back forth of reopenings," Wooten's request states. The businesses allege in their complaint that they may be forced to shut down permanently if the shutdown is not averted. Each business said it has had to undergo significant closures due to the pandemic, despite abiding by public health orders and implementing safety measures to remain in compliance with the orders. 1708

SAN DIEGO (CNS) - A suspected hit-and-run driver who allegedly struck and gravely injured a bicyclist last month in the Midtown area was arrested in a shopping center parking lot in Kern County, it was reported Wednesday.San Diego police identified the suspected driver last week as Mauricio Flores and also released the name of a woman, Jessica Bailey, suspected of riding in the van with Flores. The pair were in a 2005 Dodge Caravan with Georgia license places that struck a bicyclist around 1:30 p.m. on Aug. 21 on West Washington Street at India Street in the Midtown area, police said.RELATED: Bicyclist sustains life-threatening injury in hit-and-runThe victim suffered a life-threatening head injury and remains in the hospital, the San Diego Union-Tribune reported. In video shot by a witness and released by San Diego police, the driver could be seen stopping after the collision and getting out of the van.The video then showed the driver and passenger going to the injured man on the side of the road before the driver tugs the bent bicycle out from under the front of the van and sets it aside. He and the female passenger then got back into the van and drove away.A second passenger in the van has not been identified by police and no description of the man has been disclosed. An off-duty CHP officer who saw a flier about the collision spotted a suspicious looking van bearing CA exempt plates, typically used by state-owned vehicles, while riding his motorcycle in the Lake Isabella area over the weekend and notified the local office, CHP Officer Robert Rodriguez told the Union-Tribune.The officer assigned to that area -- roughly 35 miles northeast of Bakersfield -- went looking for the van early Tuesday morning and found it in a Vons parking lot, this time with Vermont license places, Rodriguez told the newspaper. With the assistance of Kern County sheriff's deputies, the officer located Flores and Bailey nearby and arrested them. 1962

SAN DIEGO (CNS) - A San Diego judge granted a preliminary injunction Friday sought by Hall of Fame horse trainer Jerry Hollendorfer against the Del Mar Thoroughbred Club, which banned Hollendorfer from participation in the wake of a spate of horse deaths.Hollendorfer, 73, was banned last month from Del Mar and sought legal intervention to allow him to participate at this summer's racing season. He argued that Del Mar officials did not provide an adequate reason for precluding him from racing. The complaint alleges that he was notified on June 28 that he wouldn't be assigned stalls because of "PR risks and considerations."RELATED: 2 horses killed in collision during training at Del Mar RacetrackIn his written ruling, Judge Ronald F. Frazier ruled that Del Mar "arbitrarily" denied Hollendofer's stall application without providing him a hearing on the matter. In court, Frazier noted that there was no definitive link tying Hollendorfer to the horses' deaths.Thirty horses died at Santa Anita during its most recent meet that started in late December and ended in late June. Four of the those horses were under Hollendorfer's care.Hollendorfer also has been banned by the Stronach Group, which owns the Santa Anita racetrack, as well as the New York Racing Association.RELATED: Del Mar Thoroughbred Club upgrades horse safety for 2019 racing seasonJ. Christopher Jaczko, representing the Del Mar Thoroughbred Club, argued that whether or not Hollendorfer could be connected to the horses' deaths, Del Mar's decision to exclude Hollendorfer was a valid business decision based on the negative publicity Hollendorfer could bring."Mr. Hollendorfer's record over the past six months in California is problematic," Jaczko said.He alleged that banning Hollendorfer was also in the interests of horse safety and not just to avoid bad publicity. However, had avoiding negative publicity been the sole reason for the ban, Jaczko contended that would be a rational business justification on Del Mar's part, particularly with the heightened scrutiny the horse racing industry is currently facing."We're not saying he did anything to kill those horses. We're saying that in the best interest of our business, we don't want the attention, we don't want the clamor that we're not doing everything we can to change business as usual," Jaczko said.Jaczko also said the ban does not cause "irreparable harm" to Hollendorfer, as he has the ability to participate in other races, including several ongoing and upcoming races in California.Talking to reporters outside the courtroom, Hollendorfer said he was "very grateful" that Frazier ruled in his favor."I've lost an awful lot of business because of this," said Hollendorfer, who was not sure when he would begin participating in the Del Mar racing season.Hollendorfer said he had confidence in his training methods, but would be open to recommendations to improve horse safety."I would guess my stable does more with horses every day than any other stable that I know of," Hollendorfer said. "We examine every horse every day from head to toe. We take them out of their stalls and jog them down the road and make sure that they're sound before we even consider taking them to the racetrack. I think that we're doing plenty to ensure the safety of our stable and if somebody else has another suggestion how to do more, than I'm certainly willing to listen to somebody's opinion on that."Hollendorfer's attorney, Drew Couto, said his record with equine fatalities was not as severe as Del Mar claimed, and laid blame to Stronach Group racetracks, identifying them as the common denominator in the deaths of horses under Hollendorfer's care."Where did (Hollendorfer) have equine fatalities? He had them at Stronach group racetracks," Couto said. "They were horribly managed in our opinion this last year and that's the cause of these issues."Couto did not make any definitive statements regarding any legal steps towards contesting Santa Anita's ban."One step at a time," Couto said. "We had to take care of this issue. They (Santa Anita) are certainly on our radar and probably next up."Another status conference in the Del Mar case is slated for Oct. 25 in Frazier's courtroom. 4226

SAN DIEGO (CNS) - Father Joe's Villages announced Friday that it has established an emergency fund to raise money for the homeless during the COVID- 19 crisis. With its thrift and donation stores shuttered, and donation pick-ups and drop-offs on hiatus as part of the shelter's efforts to reduce the risk of spreading the virus to clients and staff, Father Joe's representatives say the new fund will be crucial to continue to provide shelter, health care, food, showers and laundry for those in need. Qualcomm co-founder Franklin Antonio has provided a 0,000 matching gift challenge in an effort to encourage monetary support from the community, Father Joe's Villages said. Donations can be made online here. While some services have been paused in the wake of the coronavirus outbreak, Father Joe's Villages reiterated there are no confirmed COVID-19 cases at the shelter. One client showed signs of COVID-19 symptoms on Wednesday, leading to a temporary interruption in intakes. However, the client was tested for COVID- 19 and was confirmed negative for the virus Thursday, leading the shelter to resume accepting intakes following direction from county officials. 1177
