SAN DIEGO (CNS) - A judge took under submission today a motion by the federal government to dismiss a lawsuit filed by the cities of Imperial Beach and Chula Vista and the Port of San Diego, alleging that the International Boundary and Water Commission is violating the Clean Water Act by not doing more to prevent Tijuana sewage from flowing into San Diego area waters.The federal government maintains that the IBWC isn't legally responsible for the sewage flowing into U.S. waters from Mexico.But the plaintiffs claim that since the IBWC oversees a flood control channel that redirects the Tijuana River on its way to the Pacific Ocean, as well as water- capture basins in five canyons along the border, the agency is responsible for the sewage that gets through those systems.RELATED: Imperial Beach businesses hurt by sewage & runoff related closuresImperial Beach Mayor Serge Dedina, who has led the fight to against the IBWC since his city was hit with millions of gallons of raw sewage in February 2017, said it was heartening to hear U.S. District Judge Jeffrey Miller say he might go to the South Bay to see first-hand how the situation is being handled.Dedina said the plaintiffs got a fair hearing. "(It was) a very emotional morning for me," Dedina said outside court. "(I have) vivid memories of taking my kids to the emergency room. We have little kids here. Our kids are getting sick. Our lifeguards are getting sick. It's been a long road and a really tough fight, and it really meant a lot to me that members of our community were here to support that. And I'll tell you what, if our city council and our city ... have to crawl on broken glass through garbage to fight for this, we will do that. SAN DIEGO (CNS) - Ex-Poway Unified School District Superintendent John Collins pleaded guilty Wednesday to a misdemeanor financial disclosure charge and was immediately sentenced to five years probation in a plea deal in a case in which he was accused of misappropriating more than 5,000 in public funds.The Poway Unified School District and Collins also reached a settlement in a civil lawsuit related to the allegations, which is expected to be finalized Wednesday night. That settlement involves Collins paying the district 5,000 over a period of time, according to Judge Frederic Link."This is basically a win-win for a lot of people," Link said.Collins is required to abide by the terms of the civil settlement and follow the law as part of his probation, or face the risk of once again facing the criminal charges.After several days of testimony at a preliminary hearing -- a proceeding held to determine if there is enough evidence to proceed to trial -- Collins pleaded guilty to a misdemeanor charge relating to his failure to declare outside income to the Poway school board. SAN DIEGO (CNS) - An ex-con accused of abducting and sexually assaulting a woman in two separate locations before letting her out of his truck in Logan Heights pleaded not guilty today to felony charges, including rape and sexual penetration by force.Phillip Terrel McLeod, 47, who has a criminal record that includes a similar kidnapping case from 2002, faces 160 years to life in prison if convicted, said Deputy District Attorney Patrick Espinoza, McLeod was ordered held on million bail.The prosecutor said the 27-year-old alleged victim in the current case was initially attacked on Delta Street near Balboa Elementary School about 11:30 p.m. on Dec. 20.Espinoza alleged that McLeod pulled up and threatened to use a Taser on the woman, then forced her into his white pickup truck and drove her to an area near 39th Street and Broadway in Mount Hope, where she was sexually assaulted.The prosecutor said the victim fought back and McLeod drove her to Logan Heights, where he allegedly tried to rape her again. The victim pleaded with McLeod to let her go, and he did so near 32nd Street and National Avenue, Espinoza said.McLeod -- who is also charged with kidnapping for rape, attempted rape, assault with intent to commit rape, assault by means likely to produce great bodily injury and a misdemeanor count of resisting an officer -- was arrested Dec. 29.He will be back in court Jan. 15 for a readiness conference and the following day for a preliminary hearing. 1481

  

SAN DIEGO (CNS) - A roughly 36-hour spell of hazardously heavy surf will hit San Diego-area beaches beginning tomorrow, making the ocean extra dicey for surfers, swimmers and boaters.The large west swell is expected to arrive late Wednesday morning and generate waves of six to 14 feet in some locales, with the highest sets mostly occurring south of Encinitas, forecasters said.The anticipated conditions prompted the National Weather Service to issue a high-surf advisory, effective from 10 a.m. Wednesday to 10 p.m.Thursday, and a small-craft advisory, set to run from 6 a.m. Wednesday to 10 p.m. Thursday.Among the dangers posed by the rough local seas will be strong rip currents, minor coastal flooding and coastal erosion, according to the federal agency, which cautioned that entrances to harbors -- particularly Mission Bay -- will be difficult due to breakers large enough to capsize boats.The surf likely will peak late Wednesday into early Thursday, then slowly subside through Friday, the weather service advised. 1034

  

SAN DIEGO (CNS) - Jurors reached a verdict Tuesday in the trial of a Navy SEAL accused of fatally stabbing a wounded teenage ISIS fighter in the neck, shooting at numerous Iraqi civilians and threatening fellow SEALs to keep them from reporting him.Jurors found Special Operations Chief Edward Gallagher not guilty on six out of seven charges, including not guilty verdicts for premeditated murder, two charges of attempted premeditated murder, obstruction of justice, retaliation, and willful discharge of a weapon. Jurors did find him guilty of wrongfully posing for a photo with the teen's body. That guilty charge carries a possible sentence up to four months. 673
