SACRAMENTO, Calif. (AP) -- The California Supreme Court overturned the 2005 death sentence for Scott Peterson in the slaying of his pregnant wife.The court says prosecutors may try again for the same sentence if they wish in the high-profile case. It upheld Peterson's 2004 conviction of murdering his wife Laci Peterson.Laci Peterson was eight months pregnant with their unborn son, and investigators said that on Christmas Eve in 2002, Scott Peterson dumped the bodies from his fishing boat into San Francisco Bay.The court on Monday said the trial judge made several significant errors in jury selection that undermined Peterson's right to an impartial jury at the penalty phase.The court ruled potential jurors for the death penalty phase were improperly dismissed after saying they disagreed with the death penalty but would be willing to impose it."The trial judge made a mistake by kicking those people off the jury, so the only people that sat on the jury were in the death penalty camp," said criminal defense attorney Gretchen von Helms.Prosecutors will now decide whether to retry the sentencing phase.While the sentence was overturned, the court affirmed the murder convictions. "The sentencing was a positive step. The other decision (convictions affirmed) was about what we expected. Now we go to the habeas appeal," said Lee Peterson, Peterson's father.The court will examine the case again when it decides a separate habeas corpus challenge, based on evidence. not presented at the original trial. Peterson's father declined to talk about the arguments in the appeal, but says he's expecting a development within the next four months.Peterson's family issued this full statement in response to the court's decision:Our family is sincerely grateful that the California Supreme Court recognized the injustice of Scott’s death penalty. For a long and difficult 18 years, we have believed unwaveringly in Scott’s innocence, so today’s decision by the court is a big step toward justice for Laci, Conner and Scott.Now our family will do two things: First, we wait for Stanislaus County District Attorney Birgit Fladager to decide whether to pursue a new penalty phase trial. If the DA elects to do so, a new jury would be seated, and they would hear all the evidence. They would then decide only Scott’s sentence: life without the possibility of parole or the death penalty. While we hope for the opportunity to present the new evidence to a jury, it is not likely that this penalty phase trial will happen. The case against Scott has weakened to the point where no jury would ever sentence him to death again and the District Attorney is aware of these facts.Second, we wait for the court to address the new forensic and eyewitness evidence we have submitted that shows Laci was alive the morning of December 24th and demonstrates Scott’s innocence. When the court reviews this in the coming months, we are confident they will grant Scott a new guilt phase trial.Our family has been deeply moved by the outpouring of support not only from family and friends but also from the hundreds of people from all walks of life who have shared their faith in Scott’s innocence. RICHMOND, Va. – A military veteran who died of a heart attack while onboard a Richmond city bus was robbed while unconscious. Several burobbed while unconsciouss riders jumped in to help the man while he went into cardiac arrest, but they ultimately got off the bus, with the exception of one.Police say 20-year-old Demontea Chappell stayed behind under the guise of giving aid but was seen on camera taking the man's wallet.A video reveals the heartbreaking details."Pop? What you name is Pop?" said a young man, as the older bus passenger struggled unconsciously and not breathing."Trying to find his wallet. Where the wallet at?" that young man continues.Chappell, according to police, was acting as if he was giving aid to the Air Force veteran, but the bus video showed he went inside the man’s wallet and then slid the cash into his own pocket.Sources told WTVR's Jon Burkett that the veteran always carried cash, but how much money he had that day was unknown.Police now have a warrant for Chappell's arrest.The veteran died on the bus near the corner of First and Federal last Thursday morning.Sources tell WTVR that after family members questioned why their loved one’s wallet was empty, officials with the Greater Richmond Transit Company (GRTC) went to the recordings and alerted police. The investigation led police to Chappell, who is still on the run.GRTC is helping police in this investigation. But listen closely to Paul Reisler's music class, all you need is a smile and a wild imagination."I’m always surprised what comes out," said Paul. "When you’re creating a song with children it really is an incredible group process."The singer and educator is the founder of "Kid Pan Alley." Paul and partner Cheryl Toth immerse themselves in classrooms with students of all ages and abilities.The assignment in every class is songwriting no matter the talent level."There are no bad ideas in Kid Pan Alley," said Paul. "It is so important to impress upon them that every idea is a good idea.""For the children, they’ve written it, so it is their voice," said Cheryl. "So music has a way of capturing our emotion and voice together."The duo says sparking a child's creativity ranks as high as the three R's."I think it touches every aspect of their education," said Cheryl.For 20 years, Paul an accomplished composer has been taking his non-profit and guitar on the road."We’ve worked with about 65,000 kids and written about 2,700 songs," said Paul.In schools from coast to coast, every far-fetched lyric and theme are embraced.“They would say things an adult wouldn’t say. A kindergartner said the wind blew me a pony. I don’t have any adult co-writers that would say anything like that,” said Paul."All of a sudden they come to life because they have something to share and contribute," Cheryl explained.Lyrics written in this classroom go deeper than "Wheels on the Bus.""These songs are very complex and emotional because they reflect what the children are thinking of the time," said Cheryl.Some tunes strike a chord with professionals. Singer Amy Grant recorded one class' collaboration. Another song was even nominated for a Grammy.“We treat the kids to work at the highest professional level. We want them to know they’ve done something of real value,” said Paul.From titles like “Sister for Sale" to "My shadow leads a double life."“It is this beautiful Pandora's box that opens. And you’re never quite sure what you’re going to get,” said Cheryl.Paul and Cheryl lament that music and art have taken a backseat to standardized testing.“They say we live in a creative economy. But there is precious little training for children being creative,” says Paul.The singers from Rappahannock County say their goal isn't to encourage students to pursue a career in music. “That is not the important part. The important part is that they take what they’re doing and doing it in a creative way,” said Paul.During these days of remote learning, "Kid Pan Alley" is adapting to the new norm.“This is a time they need it the most. They really need connection,” said Paul.Paul, Cheryl, and other artists write and perform with students virtually.“It is very joyful especially when I see these kids calling their parents in to listen to my song. Such great pride. (tighten) It is wonderful,” said Cheryl.“That is what I feel we do. When we go work with the kids we make a whole bunch of new best friends,” Paul added.Paul Reisler, a teacher helping his students write their way to a Grade "A" education with a lot of rhythms that touches the soul.“Because music brings people together. It brings community together. It brings children together. I think it creates a better world.”Paul will hold a virtual concert with his adult singer/songwriters on September 27. Russia has condemned US, UK and French strikes against targets in Syria over the alleged use of chemical weapons as the Western allies argued they were essential to deter the future use of illegal munitions.The overnight strikes hit three sites -- one in Damascus and two in Homs -- which US President Donald Trump said were "associated with the chemical weapon capabilities of Syrian dictator Bashar al-Assad."The action followed a week of threats of retaliation for a suspected chemical weapons attack on civilians in Douma, outside Damascus, where Syrian forces have long been battling rebels.Trump hailed the strike as "perfectly executed" in a tweet posted Saturday, adding "Mission Accomplished!"Russian President Vladimir Putin called the missile strikes an "act of aggression against a sovereign state" and said they were against the UN charter. ROSEMEAD (CNS) - Residents across Southern California were checking their homes and apartments this morning for any damage caused by a magnitude 4.5 earthquake that struck two miles south of Rosemead and was felt across a large portion of the region, including Orange County.The quake struck at 11:38 p.m. Friday, according to the U.S. Geological Survey. It was in almost the same location as the magnitude 5.9Whittier Narrows earthquake in 1987, famed seismologist Dr. Lucy Jones said. ``Just like in '87, the earthquake is quite deep ... it's possibly on the same fault,'' Jones told NBC4 early Saturday morning.She later tweeted this quake ``is not considered an aftershock (to the Whittier Narrows quake) because the aftershocks died off completely in less than two years.''A pair of aftershocks, magnitudes 2.1 and 1.6, struck within 10 minutes of Friday's quake, Jones said.She said there is about a 5% chance this was a foreshock to a bigger earthquake.The Los Angeles Fire Department went into ``Earthquake Mode, with all 106 Neighborhood Fire Stations checking their areas for damage.''About 12:45 a.m., the department said it had completed its assessments. "Though felt widely in the greater Los Angeles area, we are pleased to report there are no serious injuries, and no preliminary indication of significant infrastructure damage within the City of Los Angeles,'' department spokesman Brian Humphrey said.The department asked residents to also check on at-risk neighbors, especially seniors living alone, and pets. Immediately after the quake, the department called on residents to be prepared for aftershocks.``If inside when shaking starts: DROP, COVER, HOLD ON,'' the department said in a statement. ``Protect your head (and) neck while taking cover under sturdy furniture or near a sturdy interior wall, away from windows and doorways until the shaking stops.''There were no reports of damage at Los Angeles International Airport, but crews are thoroughly checking the airfield and terminal, officials at Los Angeles World Airports said.USC tweeted about 2:15 a.m. that ``(Department of Public Safety) completed a survey of (the main) & (Health Services) campuses, respectively.
