(KGTV) -- After being under a federally mandated quarantine at MCAS Miramar for two weeks, Steven and Michele Smith are finally heading home to Paradise, California."Tomorrow morning we're putting our bags on the other side of that door and we're heading on a bus to the airport. We're going to rent a car and drive 600 miles home," said Steven Smith in a Skype interview with 10News.The two would have been back home weeks ago after their planned cruise to Hawaii, but due to a coronavirus outbreak on the Grand Princess cruise ship they were on, they and all other passengers had to go into quarantine once their ship finally docked in Oakland."My sister is taking care of my birds, my daughter is taking care of my dog, and then my friend is taking care of our cat," said Michele Smith.The Smiths will complete their 14-day quarantine Tuesday and drive home Wednesday. Health and Human Services officials tell us nearly 50 people quarantined at Miramar left Tuesday, and the remaining 130 people will be discharged over the next two days. For nearly two weeks, their temperatures were checked twice a day. The Smiths mostly remained inside of a room at the Consolidated Bachelor Quarters on base, had food delivered three times a day, and only stepped outside occasionally."You can go out and walk outside, they have a fenced-in area that they keep us inside of," said Steven Smith.They were tested for COVID-19 and got their results back Monday."It was just a weird test, to have somebody shove something up your nose that far back into your nasal cavity," Steven Smith explained."But we tested negative!" added an excited Michele. "So, we are virus free 100 percent."They are thrilled to be heading home healthy and say their positive attitude and sense of humor helped get them through this unusual time.Michele leaves others just starting their quarantine with this advice, "I would recommend to all the people out there, now is not the time to bring up negative things or things that could create conflict, but just to love on each other, laugh and enjoy each other." 2101

SAN DIEGO (KGVT) - For many students across California, school is either back in session or will start soon in a virtual setting.With uncertainty about what the school year will look like for all children, the parents of students identified as needing special education services are raising serious concerns about their child’s access to necessary supports and resources."Right now, school is virtual," said Sally Sachrison. "It’s been quite a challenge".Sachrison's 12-year-old son just started the 7th grade. That's an achievement, but the emotions she's feeling are not the typical excitement of going back to school."It's just overwhelming because distance learning doesn't always work for everybody, and I feel like they have abandoned our kids that really the special services," Sachrison said.Her son has Down syndrome and is autistic. His unique needs can’t be met over a computer, Sachrison said.“The conflict is that my son needs like a special education teacher, he needs a speech pathologist, he needs an occupational therapist, and these are specialized, trained professionals," she explained.Sachrison said she’s already noticed her child regressing just since schools moved to remote learning in mid-March to prevent the spread of COVID-19. By May, he was slurring his speech and having trouble with other tasks, she described.Regression and lack of services are a concern heard by attorney's and advocates from parents across the state."How do you take a parent and say hey we're going to train you to do occupational therapy even though you're not licensed to do it?” said Nicole Shelton, the executive director of Advocacy Associates Inc. "You don't have that background and still have that done virtually."Advocacy Associates Inc. is an origination that helps families of students with specials needs get the services to which they are entitled by law.In California, once a child is found eligible for special education, the family will participate in the process by attending an individualized education program or IEP.It's both a process and a written document.Shelton explained the IEP team, which includes representatives from the school and district, meets once every three years to conduct an assessment to ensure the student still qualifies. The team must also meet annually to review progress on goals, create new goals, and see what accommodations the student needs.She said parents are concerned that won't happen."I think it's important for parents to be requesting IEP meetings right now," Shelton said.There are also concerns about services not being provided and compensating students if they've regressed because they weren't provided with appropriate services and support."I think parents absolutely need the first step to be asking for that emergency IEP," she said. "We need to talk about services, and we need to talk about accommodation."In Sachrison's case, the district told 10News, "Providing equitable educational experiences to all students including students with disabilities is a key priority for us and we want the service you receive to reflect that principle. Due to the current school closure emergency that prevents in-person instruction, student Individualized Education Plans will be implemented through distance learning to the greatest extent practical via online resources and other means. The IEP will be provided by means of ‘distance learning’, as determined by your child's teachers, in light of the emergency circumstances."A district spokesperson explained, “‘Distance learning’ means instruction in which the pupil and instructor are in different locations. ‘Distance learning’ may include, but is not limited to, all of the following: (1) Interaction, instruction, and check-ins between teachers and pupils through the use of a computer or communications technology. (2) Video or audio instruction in which the primary mode of communication between the pupil and certificated employee is online interaction, instructional television, video, tele-courses, or other instruction that relies on computer or communications technology. (3) The use of print materials incorporating assignments that are the subject of written or oral feedback. This applies to the special education and related services in the IEP to the greatest extent possible in light of the emergency circumstances. Under current public health and CDE guidelines we cannot provide services either at the school, or in person, for more than 10 days due to the qualifying state of emergency. The parent will be notified as to the specific means by which the student's IEP will be provided, given the emergency circumstances present at that time. The IEP will be provided by alternative means as necessitated during the period of emergency conditions only."The district said IEP meetings are being scheduled to take place virtually and it is dependent upon the IEP team to determine whether new goals will be developed on an individual basis.When asked how the district plans to handle learning regression from the spring and forward and whether the state has provided any guidance a spokesperson explained, "When ‘regular’ school hours resume there will certainly be a need to discuss each students' services since distance learning falls short of providing optimal outcomes. At that time students with disabilities, in addition to ALL students in the general education setting, will have to undergo some form of instructional/educational recuperation. Our district is currently considering multiple options to meet this need."A spokesperson for the California Department of Education said students who are receiving special education services through their school district have an IEP and the services and/or accommodations they receive are listed in that IEP."The federal government has not waived the federal requirements under the Individuals with Disabilities Education Act (IDEA) and local educational agencies (LEA) should adhere to IDEA requirements. In the upcoming school year, local educational agencies in consultation with their local health agency may offer in-person instruction, distance learning, or a combination of both. Section 43503(b)(4) specifies that distance learning shall include "Special education, related services, and any other services required by a pupil's individualized education program pursuant to Section 56341, including the requirements of subparagraph (A) of paragraph (9) of subdivision (a) of Section 56345, with accommodations necessary to ensure that individualized education programs can be executed in a distance learning environment." 6617

SAN DIEGO (KGTV)- Monday morning Escondido Police provided extra police patrols at a local mosque that was targeted on Sunday.Police say the Dar-ul-Arqam Mosque on 6th Avenue was set on fire by an arsonist that has yet to be identified.Worshipers inside the mosque noticed the flames around 3 a.m. on Sunday and were able to put them out before the fire could spread.Lt. Chris Lick with the Escondido Police Department said once police and arson investigators arrived, they determined that the fire was set intentionally. They also found a note left by the suspect.“Graffiti left behind by the suspect made reference to the shooting incident in New Zealand,” said Lt. Lick.The San Diego Police Department has also stepped up patrols at mosques across the city in response the incident in Escondido.San Diego's Anti-Defamation League issued a statement in support of the mosque and worshippers.“This attack appears to be meant to send a signal to the Muslim community” said ADL Regional Director Tammy Gillies. “Sadly, this type of behavior is consistent with the growth in hate crimes, rise in attacks on Muslims, and the surge in anti-Muslim bigotry that we have seen in our country and around the world.”A crowdfunding campaign was launched to help raise money to provide repairs and proper security at the mosque in Escondido.The campaign has received support from people across the country. San Diego (KGTV)- As Westin Hotel workers fight for better wages, local business owners are fighting to keep business.Hotel workers have been on strike for the past few weeks. Business owners say customers are now avoiding the area and its costing them money.Joey Aiello owns a shoe shine stand that sits outside of The Westin Hotel. He says he’s seen fewer customers this month because of the strike. “People don’t think its a big business but it supports my family,” says Aiello.He says since the workers hit the picket line, he’s lost 00 in business. “The first week they were here I made less than 0 a day. We have to make 0 a day to stay a float.” Other business also say they are concerned about the noise.The San Diego Police Department says they have received six complaints since October 9th. A spokesperson with Marriott International sent us this statement that says in part:“We are disappointed with some of the tactics the union has deployed including the noise levels. We continue to work with local police to address these issues and we are grateful to our guests for their patience during this time.”The Unite Here Union President, Bridgette Browning, says employees are now in negotiations with the hotel. She also sent us a statement that says:“While we are sympathetic to neighboring businesses - we believe the Marriott has the power to fix this strike and the businesses should be demanding that Marriott do the right thing. The workers are not to blame for the low standards that Marriott has created at the Westin San Diego Gaslamp. The workers are prepared to settle as soon as Marriott decides to do the right thing and sign a contract that provides living wages.”For business owner Joey Aiello, he says he won’t be able to make back the money he’s lost. “I just have to work harder and keep everything a float the best I can.” 1869

SAN DIEGO, Calif. (KGTV) – A prominent harbor cruise company is continuing to operate despite being cited for violating a County health order. Tuesday afternoon, 10News took video of Flagship Cruises & Events taking passengers aboard for bay tours even after the company was cited by San Diego Harbor Police over the holiday weekend for violating the County's health order 14C which bans recreational boating unless all the passengers are from the same household. Tuesday, a company spokesperson sent the following statement to 10News.“We are part of the Passenger Vessel Association, not recreational boating. They are classifying us under a charter business which is still banned. We DO have a charter business but are not operating any charters at this time. Only public tours and maintaining all safety guidelines set by the city & CDC. We didn’t receive a cease & desist, and will continue to operate our harbor tours & patriot jet boat this week. We open up our dining cruises starting this Friday with Hops on the Harbor – pairing with local brewery, Pizza Port.”Monday night, the company told 10News it's part 14E of the County health order, not 14C. That section states in part, "other public or private outdoor recreational facilities (other than community pools per State order), including recreational equipment (such as bicycle, boat, kayak, equestrian and surfboard) rentals may be open for limited use."During Tuesday’s County press conference, Supervisor Nathan Fletcher told 10News, “The rental items that they're alluding [are for] individual use type things like a bicycle or a kayak or a surfboard and so they are not covered under the current public health order,” and added, “If they continue to operate, they are going to continue to be cited.”Harbor Police say the citation comes with a fine of up to ,000 and up to a year in jail. Harbor Police say they're documenting each sail the company is doing and incorporating those into the original citation that it sent to the City Attorney's Office. 2046
