PALA, Calif. (KGTV) – An Oceanside woman is dead and a man and 11-year-old are hospitalized after a vehicle was found overturned on an embankment near State Route 76. The family of three, a father, mother and son, were traveling from Palomar Mountain back to their home in Oceanside.At about 6:13 a.m. Friday, California Highway Patrol received a call from San Diego Sheriff's Department about a vehicle that had veered off the roadway. The driver, a 30-year-old man from Oceanside, said he was unsure of his location and knocked unconscious in the crash, but that he was somewhere along SR-76 between Palomar Mountain and Oceanside. He also was not sure what time they went over the edge, but said they had been driving around 11 p.m. Thursday night, which means they could have been down there for close to eight hours. Both agencies dispatched crews to find the vehicle and using his cellphone location, were able to find the vehicle just after 6:30 a.m. south of SR-76 near Bodie Blvd. The vehicle, a Subaru carrying, was about 300 feet down a steep embankment near the roadway."He wasn’t even sure when the crash happened. He thought he left somewhere around 11 o’clock last night, heading home from Palomar Mountain to Oceanside, so he may have been out there all night," said CHP Public Information Officer Mark Latulippe.The right-front passenger, a 30-year-old woman, had died from her injuries in the crash. The driver sustained major injuries and was taken to Palomar Medical Center. An 11-year-old male who was in the right rear of the Subaru also received major injuries and was taken to Rady Children's Hospital.The driver and child are expected to recover.A small dog was also in the vehicle at the time of the crash. Animal control helped locate the dog after the crash.Investigators are not sure how long the vehicle had been there. They believe sometime overnight the Subaru was traveling on SR-76 near the Wilderness Gardens Preserve when for unknown reasons it left the roadway and overturned down the embankment. All three victims were ejected during the crash and found either partially or fully outside of the vehicle, CHP says.The names of those involved in the crash were not released. Investigators do not believe impairment was a factor in the crash and everyone is believed to have been wearing a seatbelt. 2342

He'd only spent a day in Jamaica once on a cruise.But even though he repeatedly told authorities in Monroe County, Florida, that he was a US citizen, according to a federal lawsuit filed Monday, they held him in custody and threatened that he was headed to a Jamaican prison, citing a request from Immigration and Customs and Enforcement.Now, more than seven months after he allegedly ended up in an ICE detention center, Brown, 50, is suing the Monroe County sheriff, alleging he was illegally detained.Monroe County Sheriff's Office spokesman Adam Linhardt and ICE spokeswoman Dani Bennett declined to comment, saying their agencies don't comment on pending litigation.The complaint filed by a coalition of immigrant rights groups Monday in US District Court for the Southern District of Miami details Brown's allegations about his April 2018 detention and its aftermath."Despite his repeated protests to multiple jail officers, his offer to produce proof, and the jail's own records, the Sheriff's Office held Mr. Brown so that ICE could deport him to Jamaica -- a country where he has never lived and knows no one," the lawsuit says.Brown was detained in early April 2018 after turning himself in for a probation violation, the lawsuit says.After his detention, authorities allegedly sent information about him to ICE, and in response the agency issued what's known as a detainer request, paperwork that asks local law enforcement agencies to hold a person for up to 48 hours beyond when they would otherwise be released so that ICE agents can pick them up.As a result, the lawsuit alleges, Brown was illegally held in detention and eventually transferred from the local jail to the Krome immigrant detention center in Miami.He was released from ICE custody after a friend sent a copy of his birth certificate to ICE, according to the suit."After confirming that Mr. Brown was a US citizen, ICE hastily arranged for his release from Krome. Before he left, they confiscated all the documents they had given him regarding his impending deportation," the lawsuit says.If his friend hadn't been able to provide a copy of his birth certificate to ICE, Brown would have been deported, the complaint alleges."It's shocking and not right that somebody can lose their human rights and have all dignity stripped away simply because someone delivers a piece of paper or signs a form," Brown said in a statement released by the American Civil Liberties Union, one of the organizations representing him.Attorneys representing Brown argue that the case highlights flaws in ICE's detainer system and shows why local authorities shouldn't do the agency's bidding."Peter's frightening story should make sheriffs and police chiefs think twice before agreeing to hold people for ICE," wrote Spencer Amdur, a staff attorney for the ACLU's Immigrants' Rights Project.Attorney Jonathan N. Soleimani said in a statement that the sheriff's "practice of blindly effectuating ICE detainer requests -- even where there is clear evidence undermining their basis -- resulted in a violation of Mr. Brown's constitutional rights."ICE has said it issues detainer requests to local law enforcement agencies to protect public safety and carry out its mission.But the practice is controversial. Advocates for sanctuary cities, local jurisdictions that don't cooperate with ICE when it comes to immigration enforcement, accuse the agency of targeting people who don't pose public safety threats.Brown isn't the only US citizen who's been detained by ICE.An investigation by the Los Angeles Times earlier this year found that ICE had released more than 1,400 people from custody since 2012 after investigating citizenship claims.Matthew Albence, a top ICE official, told the newspaper that the agency takes any assertions that a detained individual may be a US citizen very seriously.ICE updates records when errors are found, Albence said in a statement to the Times, and agents arrest only those they have probable cause to suspect are eligible for deportation.In a video released by the ACLU, Brown explained one reason behind his lawsuit."I would never have expected in a million years that this would happen, and I can tell you it's not a good feeling. And with policies like this in order and people implementing them like that, it was only going to continue," he said. "There has to be a stop at some point, before it becomes all of us." 4487

Police and other law enforcement are constantly trying to stay ahead of criminals, but sometimes technology can get in the way.Apple made headlines a couple years back, when the company refused to unlock a phone when asked by law enforcement.Then came Grayshift, a company that specializes in cracking iPhones.  "Apple's fighting these guys pretty hard,” says digital security expert Steve Beaty. “Has been a bit of a chess game right."Beaty is a digital security expert professor with Metropolitan State University of Denver."It appears that people aren't now able to break into the iPhone with the most recent release of version 12 of iOS," Beaty explains.While Apple isn't saying much about what they've done, law enforcement around the country will have to scramble to find new ways to get into these devices.Beaty seems to think it's related to a small change in access by adding a USB restrict mode--that disables devices after a certain amount of time if it’s plugged into your phone."They can plug into iPhones, that historically in general, have what we call brute force them," Beaty explains.Brute forcing allows Grayshift to continue putting in passcodes until they find the right one. But because these external devices deactivate after about an hour, their process is interrupted. That's the main belief in how Apple is thwarting these devices.If you're worried about security, it's simple to activate USB restrict mode on your phone. There may be some other problems though you could run into charging issue."So, for the time being, I don't see it being more than a chess game that they are going to be advances made on either side,” says Beaty. “And I don't think there's going to be a definitive, if you will, checkmate in the foreseeable future." 1776

Police in southwest England say two people are in critical condition and are being treated "for suspected exposure to an unknown substance." One of the victims is a former Russian spy, Britain's national broadcaster said."The two people -- a man aged in his 60s, and a woman aged in her 30s -- were found unconscious on a bench in The Maltings in Salisbury," Wiltshire police said on Monday, adding that the injured are known to each other.UK's national broadcaster, the BBC, is naming the man, who is in his 60s, as former Russian spy Sergei Skripal, who was granted refuge in the UK following a "spy swap" between the US and Russia in 2010.None of the individuals involved has been named by the UK Home Office, Wiltshire Police or Salisbury Hospital."Because we are still at the very early stages of the investigation, we are unable to ascertain whether or not a crime has taken place," police said.Reiterating an earlier announcement, police said in a statement on Monday that "a major incident has been declared today and a multi-agency response has been co-ordinated." 1081

Police are investigating an alleged sexual misconduct incident at Las Brisas Academy in Goodyear, Arizona.The allegations were first reported to the principal Wednesday night, by the parent of the victim, who found text message conversations between 27-year-old Brittany Zamora and her 13-year-old male student.The conversation indicated there were sexual activities happening between the two, on and and off campus. According to police records, the teen's parents were alerted to the explicit messages by a parental app.After initially reporting the relationship to the Las Brisas principal, the 13-year-old's father also contacted Buckeye police.In a report made to police, the victim's father said he received a phone call from Zamora and her husband, who were allegedly "pleading with him not to contact the police." During the call, Zamora's husband reportedly asked to "meet up" and "settle this." 921
