SAN DIEGO (KGTV) – A family escaped from a fire that erupted in the garage of their Bay Ho home late Sunday night, but the family’s pet cat did not survive.At around 11:15 p.m., San Diego Fire-Rescue crews were called to a home in the 4800 block of Hidalgo Avenue in response to a fire at a two-story home.Firefighters knocked down the flames and kept the fire contained to the garage, but there was smoke damage throughout the home, SDFD spokesperson Monica Munoz said. A time of knockdown was not available.The family of five made it out of the home safely, but ABC 10News learned the family’s cat was overcome by smoke and later passed away.The American Red Cross was called to help the displaced residents arrange for temporary lodging. SAN DIEGO (KGTV) - A former San Diego Unified School District student and football player is suing the district.The lawsuit filed by Jason Srouy alleges he was never informed of the potential financial and legal risks of participating and playing an organized sport if a lawsuit were to be filed alleging any negligent or other claims against the student-athlete.In 2018 Srouy and the school district were sued by a referee. The referee was injured during a 2015 game and claimed it was done on purpose. He alleged Srouy had a history of unsportsmanlike conduct known and encouraged by the coaching staff.At the time Srouy told 10News he was playing wide receiver during the game, tasked with blocking the opposing cornerback. During the block, he says the opposing player fell onto the back of the referee's legs, injuring the official.In a previous interview, Srouy said after learning of the lawsuit a school official led his family to believe the district would help him; however that was not the case. “It wasn’t on purpose, it was an accident, I didn’t mean to hurt anybody," said Srouy.Srouy’s attorney tells Team 10 he was eventually dropped from the lawsuit but not before racking incurring more than 5,000 in costs and fees.A spokesperson for the district says they can’t comment on pending litigation. 1323

SAN DIEGO (KGTV) — A class-action lawsuit against the University of San Diego wants the school to refund students some tuition fees following the move to virtual learning.The lawsuit, filed by two students, claims the college owes students some of their tuition and fees back due to the switch to virtual learning.The suit says that when the school switched to virtual learning in Spring 2020, students were still charged full tuition even though "USD could no longer provide the promised hours of instruction." The lawsuit claimed that USD also increased its tuition on top of that."Similarly, students paid fees for services and access to facilities and equipment over the full semester. Though USD provided these services and facility/equipment access for only part of the semester, and could not provide them for the full semester, USD demanded that students pay fees for the entire semester," lawsuit documents state.A spokesperson for USD told ABC 10News they have not been notified of or served with the lawsuit.The lawsuit is seeking a "prorated portion of the tuition, fees and other related costs, proportionate to the diminished value of online classes and the amount of time in the Spring 2020 and following semesters when USD ceased in-person classes, campus services and access to campus facilities, continuing through to such time as USD reinstates in-person classes" for the two students who filed the lawsuit and "all others similarly situated." 1470

SAN DIEGO (KGTV) -- A family moving from Philadelphia to San Diego says they had their belongings stolen within the first 30 minutes of being here.The family says it all happened in the parking lot of a Target store in Mission Valley. The cargo carrier atop their car, stolen from the roof.The family says they think the suspects who stole the items may be professionals. Michael Kaminis says he thinks the thieves knew what they were doing when they unhooked the carrier without leaving a mark. “I was in shock, the kids were crying.”Kaminis says despite the setback, his family is staying positive. “You can’t let a thing like this deter a big life decision, they’re still on board, they love the idea of San Diego. You can’t let things like this shake your faith in humanity and people.” 798
