SAN DIEGO (KGTV) -- The ACLU is threatening to sue ICE over a policy that forbids detention center volunteers from speaking with the press.Souls Offering Loving and Compassionate Ears, also known as SOLACE, is not allowed to help at the Otay Mesa Detention Center until they sign a form promising not to speak with the media.In August, ICE discovered SOLACE wasn’t in compliance with their protocol before asking the group to resubmit the paperwork for their volunteers.ICE says the code of ethics is in place for the safety of the detainees. “These are often folks who don't have any family or friends in the United States so even if they could write or call they don't have anyone to connect with,” said Angela Fujii, a social justice coordinator with the First Unitarian Universalist.SOLACE volunteers are ready to help, but they want to make sure they can share with others about the place where things are kept pretty tight.SOLACE was also briefly barred from visiting during the Obama Administration but the compromise was met.Other groups are providing detainees with services, but SOLACE was the only one allowed to regularly visit. 1148

SAN DIEGO (KGTV) - The father accused of causing a condo fire in Rancho Bernardo that killed his two children appeared in court Tuesday afternoon for a preliminary hearing.Henry Lopez is accused of passing out drunk with a lit cigarette, setting his condo on fire last October.His children, 10-year-old Cristos and 7-year-old Isabella, were in the home at the time and suffered smoke inhalation. Both children died as a result of their injuries.Lopez was also burned in the fire and hospitalized for some time.One witness told the court Tuesday he heard a female screaming at the scene, but the screaming stopped.RELATED: Father charged after children killed in fireHenry Lopez' ex-wife Nikia Lopez testified the two were in the midst of a divorce. They shared joint custody of their children.  Lopez told the judge her former husband was an abusive alcoholic.She claims she had warned him previously not to smoke in the house around the children."He drank a lot. My goal was to keep it from the kids.  I would wake up in the middle of the night and throw away the bottles in the trash. I would pull him upstairs before the kids woke in the morning... sometimes I would have to clean up his throw up."  He’s not in custody because his defense attorney says he needs to be out to receive medical treatment for the burns he sustained during the fire.Prosecutors believe the fire started in his bed and ultimately spread to the rest of the home.  Investigators found discarded smoking materials and alcohol near the start of the fire.If there’s enough evidence against Lopez and the case goes to trial, he faces up to 14 years in prison for several felony counts including involuntary manslaughter and child endangerment.Lopez is not charged with intentionally starting the fire. 1809

SAN DIEGO (KGTV) - The Golden State Killer crime spree may have ties to San Diego, according to District Attorney Summer Stephan.Investigators say DNA evidence tied Joseph DeAngelo to the series of killings, rapes and burglaries that occurred between 1976 and 1986 across California.Stephan said Thursday that unsolved cases may be linked to the crimes. 361

SAN DIEGO (KGTV) -- The FBI is asking for the public’s help identifying the man who reportedly robbed a San Diego bank. According to the agency, the man robbed a U.S. Bank located inside a Vons grocery store at 665 Saturn Boulevard. The suspect reportedly approached the teller and made a verbal demand for cash, telling the employee he had a gun. The man made off with an unspecified amount of cash. Pictures show the man wearing a hooded Padres sweatshirt and mirrored sunglasses. He is described as a white or possibly Middle Eastern man in his late 20s or early 30s. SAN DIEGO (KGTV) - The fate of a beloved torrey pine - saved from the chopping block more than seven years ago - is once again in question.Along tree-lined Long Branch Avenue, one tree has captured the hearts of Jeff Ray's family."My kids loved it.  They touch it all the time.  It's wonderful," said Ray.The towering torrey pine is believed to be about 90 years old."It signifies the beauty of nature and the history of the area," said Ray.The history includes safety concerns. In 2010, with the sidewalks buckling, city experts deemed it a safety hazard, concerned the leaning tree would fall over. Upset neighbors hired their own arborist. Eventually, the city relented, deeming the tree stabile and repairing the sidewalks.  Since then, the tree has been granted Heritage status, giving it extra protections. Still, safety concerns remain.  On Wednesday afternoon, a city advisory panel met and the city's forester told the group the tree isn't just learning. It's actually on the move."The tree has moved an inch-and-a-half in the last two-and-a-half years. The city is recommending removal of the tree based on safety," said City Forester Brian Widener. 1192
