SAN DIEGO (KGTV) - If San Diego County has a case rate higher than 7.0 next week, it could be moved into the state’s purple tier which is the most restrictive tier for area businesses.Wednesday, county health officials said San Diego County was at a 4.5% testing positivity rate and 7.9 cases per 100,000 people. The current case rate it over the state's threshold of 7.0 cases per 100,000 residents reserved for the purple tier, the state's most restrictive.According to a breakdown from the California Department of Public Health, retail stores will have to lower to 25% capacity indoors, from 50% capacity.Restaurants must move to outdoor dining only, after operating at 25% capacity indoors or 100 people, whichever is fewer.Shopping centers will move to 25% capacity with closed common areas and a closed food court. To move forward, a county must meet the next tier’s criteria for two consecutive weeks. SAN DIEGO (KGTV) – Many restaurants around San Diego are making preparations to reopen Thursday nearly 24 hours after a judge ruled the state of California, and San Diego County, can’t enforce a stay-at-home order regarding restaurants and strip clubs.San Diego Superior Court Judge Joel R. Wohlfeil on Wednesday ruled strip clubs and "San Diego County businesses with restaurant service” cannot get a cease-and-desist order. At a Thursday hearing, the judge reinforced that his ruling encompasses all restaurants, not just strip clubs. The ruling had local restaurant owners such as Rudford’s owner Jeff Kasha clamoring to open their doors again."As soon as we’re asked to close in five minutes, we’ll open in five minutes,” Kasha told ABC 10News.Kasha said his eatery on El Cajon Boulevard in North Park went from 45 to 17 employees due to the constantly changing rules. Unfortunately, that means she and co-owner/chef Shannon Beckwith haven't been paid since March.Thursday could mean they make a small profit for once, with Romano adding, "You know, it's exciting and frustrating at the same time."The frustration due to the thousands of dollars spent each time they comply with new regulations, funding an outdoor dining space and cleaning supplies.Everyone is waiting to see what the county says in response.Coronavirus cases are sky high and hospitalizations are breaking records, bringing capacity down to 0.5% in Southern California.County officials said they're worried reopening right now will undermine the efforts of the state to bend the curve until this point."It's scary, but if you are vulnerable, stay home. SAN DIEGO (KGTV) — Lime is rolling its dockless scooters and bikes out of San Diego, a month after a hearing officer ruled the company could keep its operating permit.Lime announced Thursday they would not be renewing their permit to operate in San Diego but would monitor the opportunity to return in the future.“As part of our path to profitability, Lime has made the difficult decision to exit San Diego and focus our resources on markets that allow us to meet our ambitious goals for 2020," a statement from Lime said. "We’re grateful to our team members, riders, Juicers and communities who supported us throughout this journey. Lime added that the city's most recent regulations have led to a decrease in ridership and that the city has not been transparent when it comes to towing by city-contracted and private towing companies.In December, city council leaders voted to ban electric scooters from the city's boardwalks at Mission Beach, Pacific Beach, Mission Bay Park Bayside Walk, and La Jolla Shores. SAN DIEGO (KGTV) -- Mayor Kevin Faulconer condemned Governor Gavin Newsom’s amendment to the California sex offender law in a tweet Saturday morning.The mayor said he is “appalled” by the changes, which give judges discretion on whether or not to list someone as a sex offender for having oral or anal sex with a minor, the Associated Press reported.“As a parent I’m appalled that last night our governor signed a law maintaining a 24-year-old can have sex with a 14-year-old and it not be considered predatory,” Faulconer said.RELATED: California governor signs bill changing sex offender law“An adult who commits ANY sex act on a minor 10 years younger must be registered a sex offender. Law must be changed,” he continued.The bill does not allow statutory rape or pedophilia.The San Francisco Chronicle reported Friday that the bill, SB145, was signed by Newsom without comment. The bill gives judges discretion over sex-offender registration in cases involving teenagers between the ages of 14 to 17, and adults who are less than 10 years older, the Chronicle said.The author of the bill Senator Scott Wiener, from San Fransisco replied to Faulconer's tweet, "Mr. Mayor - I'd always been under the impression that you were a supporter of the LGBTQ community. This bill does nothing more than treat LGBTQ young people the same way we've treated straight young people since 1944. Why would you oppose simple equality?"The bill changes antiquated language that protects a man in a relationship with an underage woman, extending it to members of the LGBTQ community.The bill goes into effect on January 1, 2021.
