SAN DIEGO (KGTV) -- The battle between rideshare companies and drivers' unions is on the ballot in the form of Proposition 22. It's a way for companies like Uber and Lyft to push back against California's Assembly Bill 5, which classifies drivers as employees with benefits instead of independent contractors.The gig companies are fighting the state in court, so they haven't been following those rules since the law went into effect on Jan. 1. Now, the fate of drivers will be in the hands of California voters on Nov. 3.The Yes on 22 campaign is backed by Uber, Lyft, and Doordash.It would classify drivers as independent contractors.Drivers could work towards a stipend to help purchase their own health insurance.They would also get some hourly pay, but only during what's called "engaged time." Yes on 22 says engaged time starts from the moment a driver accepts a ride until they drop the passenger off. It does not include time drivers spend waiting for their next passenger."If you were to compensate for all the time the driver spent on an app, you'd have to force them to accept every ride that comes across which would eliminate their flexibility to choose when they want to work and how long they want to work," said Vetter.Driver Al Porche says that's exactly why he's voting yes."Times are great right now," said Porche. "I've been driving all this year. I switched over from transporting people to delivering food and meals or groceries."According to the New York Times, rideshare companies have spent more than 0 million promoting the campaign, making it the costliest in state history.A "No" vote on Prop 22 would continue the current ruling under AB 5, reclassifying drivers as employees with a swath of rights and protections.Tonje Ettesvoll is against Prop 22, warning it's deceptive if you don't look closely."When you look at all these ads on TV and social media, that is Uber and Lyft's voice, said Ettesvoll. "That is not the driver's voice."She's been driving full-time for four years in San Diego and says it's only gotten worse."They have cut my rate many, many times to the point where I'm driving from 40 hours a week to 60 with the same pay."Nicole Moore with Rideshare Drivers United says about 40% of the job is waiting for your next ride -- time Prop 22 wouldn't pay up for in terms of pay or benefit because it's not considered engaged time."This is work. Just because you're a cashier in a store and you don't have somebody checking out doesn't mean you're not paid," said Moore. "It is definitely helping the billionaires and the people who are running these companies but it is not helping the drivers."The Yes on 22 campaign says if the proposition doesn't pass rides will be harder to find and prices will go up. SAN DIEGO (KGTV) — The Confederate monument at the center of an emotional debate has been removed from inside a city-owned cemetery in San Diego."It's a relief. I'm glad," said Amanda Bergara.Amid the recent protests aimed at racial injustice, Bergara was one of nearly 2,800 people to sign an online petition calling on San Diego's mayor to take down a confederate monument from inside Mount Hope Cemetery."It's a symbol of hate and disrespect for those who fought with their lives to end slavery," said Bergara.RELATED: Online petition seeks removal of Confederate memorial in San Diego cemeteryBuried in the cemetery are both Union and Confederate soldiers, who later lived in San Diego. The memorial, erected in 1948, names General Stonewall Jackson. In June, ABC 10News discovered the stone on the monument heavily damaged, with vandalism an ongoing issue. Unlike other Confederate markers removed in San Diego, the plot on which the monument sits is privately owned, and the city has maintained its hands are tied. The owner, United Daughters of the Confederacy, and supporters have said such markers are monuments to history.In the end, a city spokesperson says it was removed weeks ago at the request of the Confederate group, presumably to protect it from vandals. The monument is being stored by the city."Hopefully ending the hurt and pain for those who would have seen it and felt that hurt and pain. I hope it never sees the light of day," said Bergara.Not all the hurt is gone. A flagpole remains, along with a marker that includes the name, Stonewall Jackson. SAN DIEGO (KGTV) — The county Medical Examiner has identified the second teenager killed after a car lost control on a Mission Valley freeway and crashed before bursting into flames last weekend.David Chavez, 15, was killed by blunt force trauma, thermal cause, and smoke inhalation according to the ME in the tragic crash on Jan. 18.Police say a car was speeding at about 3 a.m. on the westbound Interstate 8 ramp to southbound State Route 163 when the driver lost control and hit a guardrail, sending the car down an embankment where it a tree and caught fire.RELATED:Community helping family of teen killed in Mission Valley crashAt least 2 dead in fiery freeway crash in Mission ValleyAnother 15-year-old, identified as Gustavo Beltran, was also killed in the crash.The driver, a 17-year-old, was arrested by CHP on suspicion of DUI. Even shorter breaks can erase some lessons.A special program at San Diego Unified is helping keep kids stay sharp and excited about learning all year round, even during breaks. It's about making learning a fun, family affair.In a classroom at Rosa Parks Elementary School in City Heights, 7-year-old students Melody and Isabella are getting some one-on-one attention with their lessons. The teachers in this case are Melody's grandmother and Isabella's mom."Everyday they have to read. Everyday they have homework to do," said Anna Gonzalez. She and Maria Theresa Jaume are among a growing number of parents and guardians getting more involved with their kid's education through the "Family Engagement Department" at San Diego Unified."So, I now know how to ask her questions," says Gonzalez, "How to engage her with the reading and things like that.""It solidifies the bond right," says Family Engagement Program manager Pamela King, "It shows kids that education is important." King says the program was established in 2016, inviting families to become partners in their kid's education with tips on how to do it."You're reading a fiction book. SAN DIEGO (KGTV) -- The City of San Diego is moving forward with a plan to underground utilities in eight neighborhoods throughout the city. In a meeting Monday, San Diego’s City Council voted to establish underground utility districts. The district's would include the neighborhoods of Otay Mesa-Nestor, San Ysidro, Clairemont Mesa, Encanto, Southeastern/ Skyline-Paradise Hills, College Area, Navajo, and Mid-City: Eastern Area. So far, the City of San Diego has moved roughly 400 miles of utilities underground. RELATED: SDG&E moves 20 miles of power lines undergroundAlthough Monday's meeting marked the first step in the process, the city says construction won’t begin for several more years. In total, the project is estimated to cost more than .2 million, including .5 million for the electrical utility work and .7 for related work, including administration, streetlight replacement, street resurfacing and related work. Recently, the city increased staff to accommodate more undergrounding districts and increase customer service.
