SAN DIEGO (KGTV) - As San Diego doctors sound the alarm on potential dangers of motorized scooters, some victims are now turning to personal injury lawyers.A woman walking downtown was recently hit by a scooter and left with ,000 in medical bills.Unfortunately, a personal injury attorney tells 10News in cases like this, victims will likely be on their own.RELATED: Mother, daughter seriously injured in scooter crash"The scooter operator is responsible for your injuries. Now, does that mean you’re going to be compensated for them? Probably not," said Mike Bomberger with Estey & Bomberger. "Most scooter operators don't have insurance to cover them for the operation of the scooter."While scooter riders must have a driver's license, they are not required to have insurance. Bomberger says it's also unlikely the scooter companies would be held liable in accidents.RELATED: Electric scooter rider injured in crash, cited for DUI“The waivers and disclaimers you sign are very, very detailed in favor of the company, almost under no circumstance can you go after company unless there’s a malfunction of the scooter itself," said Bomberger.While attorneys are advertising they can help scooter victims, Bomberger believes compensation will be few and far between.“We’ve gotten 10-12 calls and have only taken one case; they were hit by a car," said Bomberger.RELATED: Police crack down on scooter riders without helmetsDowntown resident Jonathan Freeman has been a staunch opponent of scooters coming to San Diego. His dog was hit and he's had close calls himself.“I have elderly neighbors; they tell me they don’t want to walk. SAN DIEGO (KGTV) - Commuters trying to avoid traffic along the 56 in Carmel Valley are using side streets, worrying people who live in the Pacific Highlands Ranch neighborhood."It's the worst between 7:30 and 8:30 in the morning," says longtime resident Randy M. She lives in the Portico West part of the development and says she sees cars going 50-60 miles an hour down her block every day."Sometimes, if I'm walking my dog, they'll almost run me over," she says. "So I have to be really careful."The traffic is coming from State Route 56. When that backs up, people will use Carmel Valley Road as an alternative. But that gets jammed as well, leading some drivers to turn into the neighborhood and use side streets and alleys.Making traffic worse, a half dozen schools are in the area (see map above) and all of them start between 8 and 8:40 am."It's a nightmare," says Naz Nahani, who drives her daughter to Pacific Trails Middle School every morning."When you reach this area, you're pretty much at a stand still," she says.The Carmel Valley Planning Board has held a pair of meetings about the issue. Chairman Frisco White says they're trying to find a solution."If the streets are private, we may look into blocking them from traffic during the morning," he says. They've also looked into placing no turn signs on Carmel Valley Road to discourage drivers from entering the neighborhood.Another option that White has heard would be to ask the school districts to further stagger the start times, so the traffic will be spread out over a longer period of the morning.White says the problem may get worse before it gets better, as hundreds of new apartments and homes are being built in the area.Nahani thinks the city should add more lanes to SR-56 and to Carmel Valley Road."We're planning to move closer to the school because of this," she says. 1864

SAN DIEGO (KGTV) - Crowds gathering at Veterans Park in Ocean Beach may face fines if they don't follow the county's public health orders.Tuesday morning, city crews put up orange mesh fencing around the park, but a few hours later, witnesses took pictures of two men cutting the fence down.Residents and business owners have been complaining for weeks about large groups gathering on Wednesday evenings gathered to watch the drum circle and hang out in the park.Mark Winkie is the president of the Ocean Beach Town Council. He didn't agree with shutting down the park, but he didn't condone tearing down the fence, either."Disappointing what happened here this morning, but it's important for people to know, as a town council, we really would like education to come first, to notify people about what they need to do when gathering here on such large quantities on a Wednesday," said Winkie.The public health orders banning gatherings of more than ten have been in place for months, but Winkie said it's possible not everyone is aware."Particularly for the drum circle, no city or county official has been out really interfacing with them, SDPD definitely came out, and I applaud their actions," said Winkie.Last week, police broke up the crowd, but did not issue citations.Councilmember Dr. Jennifer Campbell said it's time for enforcement."Everyday more San Diegans are dying, so we have to get tough and I'm telling you if this situation that happened last Wednesday night, happens this Wednesday night, there's gonna be a lot of clamp down, so they have got to stop it," Dr. Campbell said shouting.Violators could be fined up to ,000."By God, that is now the law and, therefore, the county sheriff should be out here arresting people who aren't wearing masks, who aren't distancing, and who are coming together," said Dr. Campbell.It's unclear if the city will put up a more permanent barrier or if anything will be in place by Wednesday evening. 1962

  

SAN DIEGO (KGTV) — As the unofficial start of summer came and went, one thing that many San Diegans were without was the use of community pools.Reopening community and apartment pools is listed in San Diego County's pilot program to phase into California's Stage 3 of reopening early.The county has submitted a letter petitioning the state to be allowed to enter the pilot program, but has yet to hear back.RELATED: Is it safe to swim in pools this summer amid COVID-19? CDC offers guidanceWhile Memorial Day weekend say many Americans looking to cool off, the Centers of Disease Control and Prevention offered new guidance on community pools. The agency says currently, "there is no evidence that the virus that causes COVID-19 can be spread to people through the water in pools, hot tubs, spas, or water play areas. Proper operation and maintenance (including disinfection with chlorine and bromine) of these facilities should inactivate the virus in the water."But for San Diego County, health officials are leaning on the state for the go ahead on pools. Sarah Sweeney, communications officer with the county's Health & Human Services Agency, says the risks go beyond pool chemicals.RELATED: Gov. It’s the gathering of individuals across different households for extended periods," says Sweeney.The county's public health orders allow for water activity in the ocean, bays, and lakes. SAN DIEGO (KGTV) — Days after revealing its move to downtown San Diego's Petco Park, KAABOO announced it's under new ownership.KAABOO's new owner, Virgin Fest, the music festival arm of The Virgin Group, will not change the festival's brand of live music, comedy, art, and culinary experiences, KAABOO said in a release.While Virgin Fest Founder and CEO Jason Felts has acquired all of the festival's assets, KAABOO San Diego itself will also not be rebranded.
