(AP) — Democrats have won two Republican-held California state Senate seats in the Central Valley, giving the party veto-proof supermajorities in both chambers of the Legislature.Vote totals updated since Election Day made winners Monday of Melissa Hurtado and Assemblywoman Anna Caballero.Hurtado won the open 12th District seat while Caballero defeated Republican Sen. Andy Vidak in the neighboring 14th District. Both are in the Fresno area.The victories give Democrats a two-thirds advantage in the Senate. The party also has that advantage in the Assembly.Supermajorities will allow Democrats to raise taxes, suspend legislative rules or override vetoes without Republican votes. 711

ROCHESTER, N.Y. (AP) — The mayor of New York’s third largest city has suspended a group of police officers involved in the suffocation death of a Black man last March. Daniel Prude died March 30 when his family took him off life support, seven days after officers who encountered him running naked through the street put a hood over his head to stop him from spitting, then held him down for about two minutes until he stopped breathing.Wednesday, Prude’s family held a news conference and released police body camera video obtained through a public records request that captured his fatal interaction with the officers.Prude had been taken to a Rochester hospital for a mental health evaluation about eight hours before the encounter that led to his death. He was released back into the care of his family and then abruptly ran into the street and took off his clothes.A medical examiner concluded that Prude’s death was a homicide caused by “complications of asphyxia in the setting of physical restraint.” The report lists excited delirium and acute intoxication by phencyclidine, or PCP, as contributing factors.New York Attorney General Letitia James’ office took over the investigation of the death in April. It is ongoing.Rochester Mayor Lovely Warren announced the suspension of the officers Thursday. She said the officers would still be paid because of contract rules. “Mr. Daniel Prude was failed by the police department, our mental health care system, our society and he was failed by me,” Warren said.Messages left with the union representing Rochester police officers were not immediately returned Thursday. 1630

(AP) -- California's earthquake early warnings will be a standard feature on all Android phones, bypassing the need for users to download the state's MyShake app in order to receive alerts.The Governor's Office of Emergency Services worked with Google, the maker of Android, to build the quake alerts into all phones that run the operating system.The technology does not predict earthquakes. RMH Franchise Holdings, a company that operates a number of Applebee's restaurants, announced this week that customers who used credit cards at some locations may have been subject to a data breach. "Upon learning of a potential incident, RMH promptly launched an investigation and obtained the help of leading cyber security forensics firms," the company said in a statement. "Based on the experts’ investigation, RMH believes that unauthorized software placed on the point-of-sale system at certain RMH-owned and -operated Applebee’s restaurants was designed to capture payment card information and may have affected a limited number of purchases made at those locations."The company said that customers’ names, credit or debit card numbers, expiration dates and card verification codes were subject to the breach. Customers who used Applebee's tabletop payment system, or its online ordering system were not subject to the breach.RMH said that customers should closely monitor their payment card statements, and check for any unauthorized transactions. If customers notice any unauthorized transactions, they should contact their bank.RMH said that it learned of the incident on February 13, and has since contacted law enforcement. "RMH is continuing to closely monitor its systems and review its security measures to help prevent something like this from happening again," the company said. The company did not say why it waited three weeks before notifying the public. Many of the affected transactions took place from December 6 through January 2. (AP) — A California judge has thrown out a 2016 state law allowing the terminally ill to end their lives, ruling it was unconstitutionally approved by the Legislature.Lawyers for advocates and opponents say Riverside County Superior Court Judge Daniel Ottolia did not rule on the legality of physician-assisted death. He issued an oral ruling Tuesday saying lawmakers acted illegally in passing the law during a special session devoted to other topics.Ottolia kept the law in place and gave the state attorney general five days to appeal.RELATED:  579
