SAN DIEGO, CA (KGTV) - A modern way to recycle your cell phones is meant to be good for the environment and a good way for you to make a little money, but some people worry the real winners could be thieves. 10News investigative reporter Jennifer Kastner visited ecoATM's company headquarters in Sorrento Valley to ask about the controversial kiosks. The company has more than a dozen kiosks around the City of San Diego and thousands of more kiosks across the country. The kiosks buy unwanted devices like cell phones.Less than one percent of sold devices get stolen but some cities have banned the kiosks because of security concerns, a spokesperson told 10News.In San Diego, the booths are located in busy shopping areas like inside the Ralph's in the Midway District and inside the Fashion Valley mall."We offer cash on the spot at our kiosks," says ecoATM's Chase Freeman.Retired law enforcement officer Phil Ramos says, "It's a great, convenient thing for a legitimate consumer, but it really invites crime. It's an easy, quick way for bad guys to make money." The concern is that criminals can make money by trying to sell stolen or fake phones.10News asked Freeman if his system is bulletproof?"I don't think that any system out there is bulletproof but what I can tell you is that we're very on top of every transaction," he responds.The ecoATM kiosks have been banned in Baltimore and in Riverside after backlash from law enforcement. 10News obtained a copy of a photo taken this August by a concerned citizen in Las Vegas. The background of the image shows a stack of phones on top of an ecoATM kiosk.In the frame of the photo, you can see the elbow, leg, and the shoe of a man who reportedly brought those phones to the ecoATM kiosk.10News asked Freeman about that man. "It seems that many of those devices were, in fact, fake devices," says Freeman. On the day the photo was taken, the man apparently sold 13 devices but only four of them were real phones.EcoATM says it didn't contact police because none of the phones were reported as stolen. Freeman says that the man is now banned from making any sales at the kiosks.Georgia police report that a 17-year-old used a stolen ID to cash in on 26 stolen phones. She was later caught and prosecuted with the help of ecoATM. "Every transaction that is conducted at a kiosk across the country is kept in a database that is available to local law enforcement," says Freeman.The company reports that 8,993 devices were purchased in San Diego from January 1st, 2019 to October 1st, 2019, but only 27 were of investigative interest and requested by law enforcement. The San Diego Police Department couldn't tell 10News how many stolen phones have been found at ecoATMs because it doesn't track the location of recovery.Freeman tells 10News that there are extensive security measures in place. Some of those measures include a camera that takes your photo while your driver's license is verified. For many kiosks, you have to provide a fingerprint. Live agents are constantly monitoring all transactions.The company says that the nationwide sale of stolen devices is a very minor issue. "It's something that does not happen frequently at all. SAN DIEGO (KGTV)- San Diego County barely avoided falling back into the purple tier of the state’s reopening system, staying in the red for now.The color-coded tier system has been difficult for many business owners to deal with as they wonder if they will face more restrictions in the coming weeks.“We are working with the state to share our concerns and thoughts about the metrics they are using to put our county in the different tiers,” said Greg Cox, San Diego County Supervisor. "The reality is we remain at risk of being moved to the more restrictive tier in the future if we don’t do those things that we know we need to do.”Dr. Wilma Wooten, the county’s public health officer, said she and other health officers across the state have been pushing for the state to improve its metrics system to go beyond case rate and positivity rate.She would like to see three things happen.“If counties are maintaining hospitalizations and hospital capacities to somehow get credit for that, and also get credit for contact tracing,” she said.Wooten said the county should also get credit for providing access to COVID-19 testing in vulnerable communities hit the hardest.“San Diego has done an excellent job to date of getting access to testing in those communities that are hit the hardest,” she said.On Tuesday, the County Board of Supervisors passed a motion in a 4 to 1 vote to send a letter to the state backing Wooten’s effort in revising the reopening criteria.Wooten is urging members of the public to continue wearing a facial covering, washing hands, avoiding large gatherings, and staying home when sick, especially as flu season is on the way.“We do not have a vaccine for COVID-19, but we have a vaccine for the flu,” she said. “Getting the flu vaccine is the most important step in preventing the flu.” 1822

San Diego will seek to invalidate its landmark pension law, a citizens' initiative 65 percent of voters approved in 2012.The City Council voted 6-3 Monday to go to court to invalidate 2012's Proposition B, which switched most new hires from a pension to a 401(k) style plan. The decision came after multiple courts ruled the city skipped a key step in the campaign. The courts said then-Mayor Jerry Sanders' involvement meant the city needed to meet and confer with unions, but didn't. The courts required the city to make employees whole plus a seven percent penalty, but didn't invalidate the law. The city will now to go to court along side its employee associations to get it off the books. "It's illogical for the city to believe that having broken the law in order to get Prop B into the charter that you should be allowed to keep it in there," said attorney Ann Smith, representing the Municipal Employees Association. Firefighter John Hernandez II said he's seen a number of his colleagues leave for other departments, which offer better benefits - namely a pension."In my line of work, we can't work as long as most people, and that's why we need pensions," he said. But Councilman Scott Sherman, who voted to protect Prop B, said ultimately going back to pensions could cripple the city. "Every single year we make a 0 million minimum payment on our pension debt from the old system that too us to that point, and now they're asking us to go right back to that system," he said.Sherman said it's low unemployment, not a lack of benefits, leading to the city's worker retention issues. Former City Councilman Carl DeMaio, a major proponent of Prop B, said he would seek to defend the measure in court. 1722

SAN FRANCISCO (AP) — A beloved gorilla has died at the San Francisco Zoo & Gardens. The zoo says Zura, a 39-year-old Western lowland gorilla, was being treated for “long-term digestive issues” but her condition recently had worsened and she died Friday.Zura arrived in San Francisco in 1982 from the Columbus Zoo, where her grandmother was Colo. Colo, who died in 2017, was widely known as the first gorilla in the world to be born in captivity. Tanya Peterson, CEO of the San Francisco Zoological Society, says Zura “had a beautiful, distinctive face and a one-of-a-kind personality" and she will be missed. 620

SAN DIEGO (KGTV) --Concertgoers have questions about show refunds with tickets bought from third party vendors.Danny Memeo is one of those people. He went to Kaaboo in Del Mar last year. It was a special time for him and his wife, Kelly.“We got to see Tom Petty right before he died, so we're super thankful,” Memeo said. They had a great time, so decided to go again this year.“So we got the tickets, and then all this stuff happened,” Memeo said.He bought the tickets through Vivid Seats. It cost roughly ,800 for their entire family. “That’s a lot for anybody,” he said.Meanwhile, his family got devastating health news. Kelly’s cancer returned. Danny said her prognosis is not good, with an estimated 12 months left to live.“[We’re] thankful for 12 months, thankful for family,” Danny said. “But wow, what a difficult year for a lot of people.”Back in July, Kaaboo officially announced there would be no event this year. “All pass holders will have the option for a full refund,” said a statement on its website.Because Danny’s family bought tickets through a different site, it’s a different story. As of Monday morning, he did not have any luck getting his money back.“They just said… when it does get rescheduled, you’ll get those tickets and you can sell them if you don’t want them,” Danny said the company told him.Vivid Seat’s website said that if an event is canceled, customers “will receive a Rewards Cash loyalty credit for 110% of the full value of your order total.”For postponements, customers “will need to hold onto [their] tickets for now.”Team 10 contacted Vivid Seats and informed them of the Memeo family’s situation.A spokesperson said they would refund them immediately.“Vivid Seats was happy to refund Kelly. At Vivid Seats we have refunded thousands of orders totaling tens of millions of dollars since the global pandemic shut down all live events in America. We have also provide an over million dollars in extra store credit to customers during this difficult time. As one of the few marketplaces still offering a full cash refund, Vivid Seats is communicating with each consumer once an event is canceled.” 2151
