SAN DIEGO (KGTV) -- The retrial began Thursday for Constantino Banda Acosta, the man prosecutors say was drunk and angry from a fight when he caused a hit-and-run crash that severely injured a 6-year-old returning from a family trip to Disneyland. The jury was deadlocked Thursday on whether or not Banda was even at the wheel. Throughout the trial, Banda sat quietly in the courtroom and could be seen smiling at the jury as attorneys laid out their case.The central question in the retrial is whether Banda or an employee of his construction company, Jorge Adame Ariza, was the one driving.RELATED: Verdict reached in trial for driver accused in hit-and-run crash that injured boyAriza was captured in security footage driving the truck from a restaurant where the two men were drinking.Ariza claims he turned the wheel over to Banda before the accident happened, which severely injured 6-year-old Lennox Lake of San Ysidro. Authorities say Banda had also been deported at least 17 times before the crash.Prosecution in the case say the two men were heatedly searching for a man who beat up Banda. Lake’s father says the young boy is expected to testify in the trial later Thursday.Lake is still receiving extensive treatments for his injuries.RELATED: Jury deadlocked in case against driver accused in San Ysidro hit-and-run?Banda was speeding west on Camino de La Plaza around 11:30 p.m. on May 6 when he reportedly ran a stop sign at Dairy Mart Road and crashed his pickup into a Honda Accord carrying the Lake family. In September of 2017, a jury found Banda guilty of misdemeanor charges of driving without a license, battery and vandalism. The jury was hung, however, on felony charges of hit and run causing death or permanent injury, DUI causing injury and driving with immeasurable blood alcohol causing injury.  1866

SAN DIEGO (KGTV) - Three businesses were destroyed last weekend by an act of hate in Mission Hills.It happened at the 'Capello' and 'Beautiful You' salons Saturday morning. Leather chairs were slashed and destroyed. Appliances and flooring were completely flooded after the culprit left the sinks running all night. "They slashed all of the chairs, styling chairs, shampoo chairs, there was detergent everywhere, shampoo everywhere," said 'Beautiful You' manager, Shanell Cedeno.Even an architecture studio one floor down took a hit from the water that went seeping through the salon's ceiling, damaging blueprints and computers. Management thinks the culprit is a former employee of the salon. "Clearly it has to be someone who has a key," said Cedeno. "It's targeted and it was a hateful act someone who clearly dislikes what we're doing here."The damage is estimated at tens of thousands of dollars. "Karma will definitely take its place first before they find them, I'm sure," said Cedeno. "If it's not happening already, it's coming for them."An investigation is underway. SAN DIEGO (KGTV) -- The San Diego Fire-Rescue Department has a new million tool to fight wildfires.The department unveiled its S-70i Firehawk helicopter Thursday, a modified version of the military’s Black Hawk helicopter.The aircraft is bigger, faster and capable of dropping more water than the city’s other two helicopters combined. The Firehawk has a 1,000-gallon tank compared to the 375-gallon tanks in Copters 1 and 2.San Diego Fire-Rescue Department Chief Colin Stowell said the Firehawk, dubbed Copter 3, represents the “latest and greatest in fire suppression and rescue capabilities.”RELATED: Chula Vista brush fire highlights rare night water drop technique“San Diego has over 45,000 properties adjacent to canyon rims and open spaces, posing a significant fire risk in our city. The speed of our response and capabilities of our equipment during the initial attack of those vegetation fires is critical,” he said.With a retractable snorkel, firefighters can refill the Firehawk’s water tank in less than a minute, allowing the helicopter to make more drops in less time, Stowell said.“Our ability to quickly get into the air and to make a difference will absolutely help to save lives,” said Mayor Kevin Faulconer.In addition to the crew of three, the Firehawk can carry up to 12 passengers, meaning it can shuttle six more firefighters than its predecessors to hard-to-reach places.RELATED: Blackhawk Helicopter joins the SDG&E firefighting arsenalThe helicopter also has advanced capabilities for night missions, with a high-intensity searchlight and a state-of-the-art obstacle avoidance system.San Diego Fire operates the only helicopters in the county outfitted to fight fires at night.To accompany the new helicopter, the city is building a .7 million hangar to house all three helicopters.“The state-of-the-art, 30,000-square-foot facility will help protect the helicopters from rust and corrosion as well as allow for indoor maintenance work,” said city spokesman Gustavo Portela in a statement. The city recently completed an Air Ops Division building to house the crew. Previously, pilots and crew members were housed in RVs and trailers and the helicopters were kept outside, Stowell said. 2228

  

SAN DIEGO (KGTV) — Thursday, San Diego Sheriff's investigators asked the public for help locating a Fallbrook man who disappeared in 2018.Officials say 50-year-old Arnoldo Loaiza Franco was reported missing on Aug. 10, 2018, by his family in Fallbrook, But the last time Franco had communication with anyone was on Aug. 1. At the time Franco went missing, he was reportedly working somewhere in Escondido or San Marcos at an avocado grove.Franco is described as a Hispanic man, with brown eyes and brown hair, weighing about 140 pounds and about 5-feet 8-inches tall.Anyone with information on Franco's whereabouts is asked to call SDSO's Homicide Unit at 858-285-6286 or the Crime Stoppers at 888-580-8477. 716
