SAN DIEGO (KGTV and CNS) — A felony assault charge with a hate crime allegation has been filed against a man who allegedly assaulted a 16-year-old Syrian refugee and used a racial epithet during the attack while the two rode a San Diego trolley.Adrian Vergara, 26, pleaded not guilty to the charge Thursday afternoon.Vergara hid from view Thursday with his head down, at one point standing on the table with his back to the judge. RELATED: Man accused of San Diego trolley hate crime has long rap sheetProsecutors say the victim was on the trolley speaking to his friend in Arabic when Vergara reportedly asked “what trash are you speaking.” When the victim replied that he was speaking Arabic, Vergara reportedly hit the man repeatedly in the face. "The defendant started saying 'F***ing' Arabs, and he began assaulting the teenager while he sat on the trolley," said deputy district attorney Leonard Trinh. Trinh says Vergara hit the boy 5 to 6 times, causing minor injuries to below his eye. "My parents brough us to this country so that we may be safe and go to school and have better lives, and this attack brought fear to them," the victim said. "However, I am very happy I reported this crime and that the attacker was found."Vergara is being held without bail because he violated probation for a prior robbery and vehicle theft. He faces up to 11 years in prison if convicted of the assault by force likely to cause great body injury, which carries hate crime escalation. In 2013, Vergara completed an anger management program. In 2015, a case was dismissed accusing Vergara of attacking another man and in 2016, he was charged with grand theft and burglary for breaking into the Central Library. In late 2016, documents show Vergara violated a restraining order against his ex-girlfriend, kicking her front door, texting her and in a phone call, cursing at her and saying, "if you don't talk to me I'm going to go to your job and cause a scene. I don't care about my life."Documents show he called her 20 times in 30 minutes.Court documents also show a carjacking charge at the beginning of 2017.Later in 2017, Vergara was charged for beating a man at the MTS Imperial Transit Center. The most recent document shows he violated a court order, put in place to prevent domestic violence in January 2019. 2659

(AP) — Airbnb will prohibit one-night rentals over Halloween weekend as part of its ongoing effort to crack down on party houses. The action comes nearly a year after a deadly shooting at an Airbnb in Orinda, Calif. Five people were killed in the shooting, which happened during an unauthorized Halloween party. Airbnb says it will ban one-night rentals of entire homes in the U.S. and Canada on Oct. 30 or Oct. 31. Previously booked rentals will be canceled and Airbnb will offer refunds. (AP/KGTV) — The U.S. Navy is expected to honor a World War II hero when a new aircraft carrier is named for Mess Attendant 2nd Class Doris Miller. "Dorie" Miller enlisted in September 1939 as a Mess Attendant Third Class. He was recognized for manning a machine gun on the USS West Virginia and returning fire against Japanese planes during the Dec. 7, 1941, attack on Pearl Harbor. He then helped rescue injured sailors as ship evacuations were ordered. Miller was awarded the Navy Cross for valor for his actions, the first African American to receive the award.This will be the second ship named after Miller and the first aircraft carrier ever named after an African American.“In selecting this name, we honor the contributions of all our enlisted ranks, past and present, men and women, of every race, religion and background,” said Acting Secretary of the Navy Thomas Modly. “Dr. Martin Luther King, Jr. observed, ‘Everybody can be great - because anybody can serve’. No one understands the importance and true meaning of service than those who have volunteered to put the needs of others above themselves.”Miller served aboard the USS Indianapolis from December 1941 to May 1943, before being assigned to the escort carrier Liscome Bay. (CNN) - A Boston area man came home from work with his son to find something amiss.He thought that maybe they had been robbed. But upon further inspection, he discovered that nothing was missing and his home was sparkling clean.Nate Roman lives in a single-family home in Marlborough, Massachusetts. Roman tells CNN he left for work the morning of May 15 and came home from picking up his son to find his door was unlocked."[My son said], 'Dad! The door is unlocked.' Which I have done once every blue moon and didn't think anything of it. But when we walked in immediately there was a vibe that something was wrong in the house."He realized that someone may have been in his home because a door he normally keeps open was firmly shut. Roman then went upstairs to check the rest of the house.He discovered his son's room, which was a wreck when they left that morning, was neat as a pin. He found his room in the same pristine condition."Rugs were vacuumed, everything was neat and put away," Roman said.He immediately called the police, and they took the incident very seriously. They cleared the house to make sure no one was still there.Police told CNN affiliate WBZ-TV that they spoke with the neighbors and no one saw anything suspicious. There are no suspects."No crime happened, nothing was missing or damaged, so the police have very little to go on," Roman said.The security system was also not set so cameras that would be activated when the alarm goes off did not get images of the intruder. The time stamp on the door sensors indicated that whoever it was stayed in the house for about 90 minutes.Later, he discovered roses made from toilet paper in the bathroom, a detail that made him realize this was probably the work of a professional. His theory is that a cleaning service came to the wrong address, but his kitchen was untouched which makes him second guess his suspicion.He has since changed his locks and admits that he is still opening cabinets very carefully in case something unexpected was left behind.Roman is hoping to move past the ordeal, but he did keep the toilet paper roses as a souvenir. 2129
