SAN DIEGO (KGTV) — New details are emerging about the death of a man in San Diego Sheriff’s deputies’ custody. A recently released Medical Examiner’s report says an arrestee’s death last year was a "homicide." The District Attorney's office said last year that none of the deputies involved in the in custody death will face any criminal charges. Oscar Leal died last February 28 after deputies responded to his apartment in Vista and detained him. The Medical Examiner’s homicide classification is not a legal term, but a medical assessment. The DA's office wrote in part of a nine-page summary and statement in December last year: "... His level of methamphetamine intoxication combined with his active resistance combativeness in the duration of the struggle, all contributed to his death ... The deputies involved in his detention acted reasonably under the circumstances in bear no state criminal liability for their actions."The Sheriff Bill Gore wrote in a statement:"I am aware of the Medical Examiner's conclusion regarding the manner of death of Mr. Leal. I respectfully disagree with the classification of the manner of death in this case as a homicide.The pathologist wrote that his death was due to acute methamphetamine toxicity in the setting of agitation, physical altercation, and prone restraint. It was purely due to Mr. Leal's agitation that he was restrained. Peace officers have a duty to restrain those who are agitated and under arrest, as Mr. Leal was. Were it not for Mr. Leal's abuse of methamphetamine he would be alive today. The deputies and nurses on scene rendered immediate aid to Mr. Leal.Mr. Leal brought upon his own death with his choice to use methamphetamine. His manner of death is more accurately classified as an accident."It has not been made clear yet why the medical examiners report took 13 months to be released. 2135

SAN DIEGO (KGTV) -- National Forests throughout Southern California will close Monday night as wildfires continue to ravage the state.Stanislaus National Forest, Sierra National Forest, Sequoia National Forest, Inyo National Forest, Los Padres National Forest, Angeles National Forest, San Bernardino National Forest, and Cleveland National Forest will all close Monday at 5 p.m., according to the US Department of Agriculture.The agency also prohibited the use of any ignition source on all National Forest System lands throughout the state.All developed campgrounds and day-use sited in National Forests throughout the state have will also shutter operations.“The wildfire situation throughout California is dangerous and must be taken seriously. Existing fires are displaying extreme fire behavior, new fire starts are likely, weather conditions are worsening, and we simply do not have enough resources to fully fight and contain every fire,” said Randy Moore, Regional Forester for the USDA Forest Service Pacific Southwest Region.“We are bringing every resource to bear nationally and internationally to fight these fires, but until conditions improve, and we are confident that National Forest visitors can recreate safely, the priority is always to protect the public and our firefighters. SAN DIEGO (KGTV) — Police have identified the man stabbed to death in a Pacific Beach bathroom this week.San Diego Police said officers were called on Sunday to a public restroom at 700 Grand Ave. to reports of a man who had been stabbed. Nearby lifeguards and firefighters were the first to arrive and started providing first aid to the man.Police said the victim, 39-year-old Michael Wagley, had puncture wounds to his upper torso and was taken to a nearby hospital, but died of his injuries. Police said Wagley was new to the San Diego area and had no established residence.RELATED: Man fatally stabbed in Pacific Beach bathroom, San Diego police sayAfter police arrived to the scene, several witnesses reported the suspect fled after the stabbing. A man matching the suspect description, later identified as 33-year-old Martin Alvarez, was detained in the area and later arrested for murder.Police are still investigating the events that led up to the stabbing and a possible motive. SAN DIEGO (KGTV) — Naval aviators and Marines from NAS North Island and Camp Pendleton are helping firefighters battle the Valley Fire.They joined four aircraft from the Army National Guard who came nearly straight from fighting fires in Northern California, according to Army National Guard officials."Due to the increased fire activity throughout the state of California up to and including Southern California, we are extremely short on resources, private, state, and federal resources. So we've enacted our emergency response agreement with the military here in San Diego including the Navy out of North Island and the Marine Corps out of Camp Pendleton and Miramar," Cal Fire Capt. The crews flying out of Pendleton have years of training to qualify for this mission. It takes hundreds of hours of maintenance to keep the helicopters running during these missions.Thursday, the fire had burned about 17,565 acres and was 32% contained. The fire has destroyed 20 "habitable structures" and 17 "minor structures" and resulted in two injuries, though it was not clear if the victims were firefighters or civilians. 3137

SAN DIEGO (KGTV) -- Neighbors are concerned after they say a registered sex offender moved into their Rancho Bernardo community, just feet away from an elementary school playground.Anthony James Morgan, 32, was convicted of possession of child pornography and lewd and lascivious acts with a child in Tennessee in 2013.Neighbors say they became concerned after Morgan moved into a townhouse in their neighborhood weeks ago. According to records on the Megan’s Law website, Morgan lives on the 17000 block of Caminito Baya, about 100 feet away from a playground at Westwood Elementary School.According to the Safe Task Force, which monitors local sex offenders, Morgan’s living situation is legal because of the California Supreme Court.In 2015, the court tossed out blanket restrictions on where sex offenders may live. The ruling came after sex offenders said the restrictions made finding housing impossible for them.  Authorities say while probation or parole agents can implement living restrictions, due to the fact that Morgan is no longer on parole or probation, he is now allowed to live wherever he wants.Neighbors say the rule doesn’t make sense. “I think the rules definitely need to be changed when it comes to sexual predators,” said Linda Vasquez.Vasquez added that she is relieved to hear that Morgan will be moving out of the area in April. “I’m very happy for that. We don’t need that in a neighborhood full of children.”The neighborhood is particularly sensitive to the sex offender issue. Neighbors say registered sex offender John Gardner was spotted at this mother's home - less than 500 feet from Westwood Elementary - in the years before he murdered two teens, including Chelsea King.Father Brett King helped lead a successful fight for tougher laws, including stricter punishments for sex offenders.  When he learned about Morgan's living situation, he told 10news: "As a society, we have lost our common sense ...
