SAN DIEGO (KGTV) -- A judge ruled Wednesday that a Navy commander will face a third trial on charges he tried to rape a junior officer in her home.John Michael Neuhart II asked the judge to dismiss all charges after a second jury was unable to reach a verdict.The judge dismissed charges of assault with intent to commit rape during burglary, burglary and resisting or delaying a peace officer.RELATED: Mistrial declared for former Navy commander accused of rapeThe judge added that prosecutors can proceed with a third trial in January on charges of attempted forcible rape and assault with intent to commit rape.Neuhart now faces six years behind bars and lifetime sex offender registration if found guilty. Neuhart had previously been facing life in prison.In the two trials combined, 21 out of 24 jurors voted to convict Neuhart. The alleged victim said Neuhart sexually assaulted her after they spent time drinking and hanging out with colleagues in 2016.RELATED: Mistrial declared in trial of former Navy commanderThe woman said Neuhart took off her pants and underwear and was physically violent with her. SAN DIEGO (KGTV) – A new alliance of San Diegans with a mission to end gun violence launched their new collation Tuesday night.More than 200 people were there for the formation of San Diegans for Gun Violence Prevention, made up of four local chapter of national groups:  Brady Campaign, Moms Demand Action, Survivors Empowered and Sandy Hook Promise.”“We really think expanded background checks in every state would go a long way,” said Wendy Wheatcroft, the driving force behind the creation of the coalition. “California definitely has the strongest gun laws and should be an example to the rest of the country, and we’re hoping other states follow suit.”“I want to emphasize all the organization here’s support the second amendment, and we’re not trying to take anyone’s guns away,” Wheatcroft said.Michael Schwartz is with the San Diego County Gun Owners; he says the country before looking at gun laws. The country needs to take a hard look at the mental health system.“If you look at the mass shooting that made the headlines,” Schwartz said, “There have been mental health issues, they raised red flags, and no one was there to help.”Like President Trump, Schwartz also believes in exploring the idea of teachers packing heat.“If there is a teacher that is licensed and trained and wanted to protect themselves in the classroom, she shouldn’t be stopped by state law,” Schwartz said, “Her right to defend herself doesn’t end in the classroom.”  1470

SAN DIEGO (KGTV) - A Hillcrest woman says the sounds that wake her up every day also make her dread going into her own home.After retiring, Mary Alsop moved from New Jersey two years ago and bought a condo on Centre Street."I was going to read all these books I said I was going to read," said Alsop.But her retirement dream has been interrupted by a constant stream of announcements from the Hillcrest branch of the DMV, starting around 8 in the morning and ending sometime past 6 at night.  A woman's voice can be heard rattling off ticket numbers and the windows that customers should report to."It's endless, repetitive and numbing," said Alsop.In late February, several loudspeakers were installed outside the DMV building. Between her condo and the DMV office are trees, a row of condos and apartments, along with four lanes of traffic and a large median.  Yet, when 10News was in her condo, those sounds could clearly be heard in her bedroom. The joy of reading is now a chore."It intrudes on your thinking and concentration," said Alsop.Shutting the windows reduces some of the noise, but makes it stuffy inside.Alsop isn't alone.  On the app Nextdoor, neighbors have been voicing their frustration for months.  Alsop says she and others have complained in person and online.  She says a few times, the volume has been turned down, only to go back up days later."I"m tremendously stressed out.  I just want my home back," said Alsop.A DMV spokesperson emailed 10news saying they've already agreed to turn down the volume.  10news responded, informing them the neighbors still feel the noise is too loud.  We are awaiting their response.  1698

  

SAN DIEGO (KGTV) -- A Marine killed in a motorcycle crash on I-15 Friday has been identified as 21-year-old Logan Parkhurst.The crash happened in the southbound lanes of Interstate 15 near Miramar Way just after 6:30 a.m.According to the California Highway Patrol, Parkhurst hit the back of a Toyota while attempting to exit onto Miramar Way, causing him to be ejected. Officers say he was then struck by two vehicles.RELATED: Motorcyclist dies in crash on I-15 near Miramar WayParkhurst was taken to Sharp Memorial Hospital where he died from his injuries.Video from the scene shows drivers stopping on the side of the road to help Parkhurst before paramedics arrived.A GoFundMe has been started in Parkhurst's name to raise money for the family.  771

  

SAN DIEGO (KGTV) - A San Diego man claimed four off-duty San Diego Police officers beat up him outside of a local bar.“I have a laceration on the back of my head, three staples, a lot of bruises a lot of cuts on the face,” said Jonathan Felix.Standing in his attorney’s office, Jonathan Felix described a November night he’ll never forget."All I remember is waking up in my own pool of blood a few times,” Felix told 10News.Felix said that after working a shift at a restaurant in the Gaslamp Quarter, he stopped by a Mission Valley bar for a drink.He said he lives nearby and uses its parking lot because parking in the area is scarce.According to Felix, before he headed home for the night, he saw four men standing near his car. He said he didn’t know them, but wanted to make sure the valuables he had in his vehicle were safe.He said after a few interactions with the guys, they didn't leave and appeared to be intoxicated.He claimed the men never identified themselves as San Diego Police officers."I felt threatened for my life,” Felix said.Felix's attorney said at some point, Jonathan Felix pulled a gun and held it at his side. The officers surrounded him, and the situation escalated.The San Diego Police department saw it differently, calling the off-duty officers victims of assault with a deadly weapon.
