SAN DIEGO (CNS) - A federal judge Tuesday ordered correctional officers at the Richard J. Donovan Correctional Facility in Otay Mesa to wear body cameras while interacting with inmates, a first for California.The ruling comes in a civil rights lawsuit over disabled inmates' rights, in which a federal judge found evidence to support allegations of physical abuse of prisoners at the prison, the Los Angeles Times reported.The order applies to interactions with all inmates with disabilities inside the Otay Mesa facility, according to The Times.Attorneys for the inmates with disabilities had asked the judge to issue an order mandating body cameras for correctional officers after documenting widespread physical abuse of the inmates, the Los Angeles Times reported."Body cameras have never been used in California prisons. This is a very important order to help put an end to physical abuse and broken bones of those with physical disabilities at this most dangerous of prisons," attorney Gay Grunfeld told The Times. Her law firm, along with the Prison Law Office, represents the plaintiffs."Body cameras can bring sound and context to situations that involve the use of force which surveillance cameras cannot."U.S. District Judge Claudia Wilken gave the California Department of Corrections and Rehabilitation a timetable that effectively gives it five months to get the body-worn devices into use. She also ordered that records from body cameras be preserved from use-of-force incidents and that policies be created, The Times reported.Dana Simas, the press secretary for the Department of Corrections and Rehabilitation said in a statement to The Times the department takes "the safety and security of the incarcerated population very seriously, and vigorously work to protect those with disabilities. We will be carefully evaluating the order."Wilken also ordered the installation, within four or five months, of widespread surveillance camera systems at critical areas of the prison and the establishment of third-party expert monitor oversight of evidence gathered at the prison, according to The Times.Wilken ordered those actions as part of an injunction she granted as part of a bigger plan to address allegations of repeated physical abuse and retaliation against disabled inmates who complain about the prison facility, The Times reported.Wilken, an Oakland-based judge, is handling a class-action lawsuit that seeks to guarantee the rights of state prisoners under the Americans with Disabilities Act, according to The Times.The ruling Tuesday applies to the single prison, but Wilken is expected to hear another motion next month that examines evidence of abuses across the state prison system and seeks to implement the use of body cameras across 35 prisons, The Times reported.The injunction Tuesday was granted based on 112 sworn declarations from inmates that lawyers said showed staff "routinely use unnecessary and excessive force against people with disabilities, often resulting in broken bones, loss of consciousness, stitches or injuries that require medical attention at outside hospitals," according to The Times. 3151

SAN DIEGO (CNS) - A gunman who allegedly tried to mug a man he met online under the pretense of buying a gold chain outside a Chula Vista Costco, was behind bars Wednesday, facing a robbery charge.Albert Molina, 30, was arrested Tuesday after a scuffle in which the 23-year-old alleged victim snatched away his gun, fired a shot and held him at gunpoint while calling 911, according to police.Prior to the confrontation, Molina and the other man had communicated via OfferUp, an online service that facilitates private sales of used goods, Lt. Dan Peak said.Meeting the seller outside a Costco store in the 1100 block of Broadway, Molina agreed to buy a gold chain and provided a money order to supposedly pay for it. The two men tried to cash the check together, but found it was no good, according to police.They went to Molina's car and were sitting in it when the seller asked Molina to return his chain, which Molina was wearing, Peak said, adding "the suspect refused and pulled out a gun."The two men wrestled over the gun, which ended up in the seller's possession as he fell out of the vehicle. Believing Molina was going to run him over, he fired a round in Molina's direction, then held him at gunpoint while summoning police.Patrol officers arrived shortly after 7:30 p.m. and took both men into custody. SALT LAKE CITY, Utah — The United States Attorney’s Office is asking anyone who might have gotten their immigration paperwork “lost” in the mail to please give them a call.Federal prosecutors have contacted 181 potential victims whose documents may have actually been intentionally destroyed by a former United States Postal Service employee in Salt Lake City.Special agents with the USPS identified the suspect as 77-year-old Diana Molyneux from West Jordan.Many of the victims were legal immigrants residing in Utah and Nevada who were waiting for their Permanent Resident Card, commonly referred to as a Green Card.“I pray for her. I really do,” said Eloisa Mendoza, the proprietor of Elko Hispanic Services. “I personally think she knew what was in those envelopes.”Mendoza told KSTU she worked with approximately 60 victims in Elko, Nevada. Whenever a client’s mail had a tracking number, Mendoza said it seemed like the documents always got stuck in Salt Lake City.“It’s really difficult for me to understand why (the suspect) would do something like that,” Mendoza said. “Issues. Personal issues… I do not know her, so I really cannot say if she’s racist or not. To me, I think her issue was just ‘aliens.’”According to Mendoza, some of the victims lost their jobs due to the inability to provide proof of legal residency in the United States. Others had to pay more than ,000 in fees.Mendoza said although most of the victims were Hispanic, some were from Russia and the Philippines.“The emotional suffering they went through is very harsh,” Mendoza said. “I saw the emotion, the stress, the nightmare that these people went through. SAN DIEGO (KGTV)- A spokesperson for the County of San Diego said over two days, they have received approximately 580 complaints of businesses and entities not following the proper restrictions under the purple tier.The county has already sent out dozens of cease and desists orders since Monday. That includes at least two churches, Foothills Christian Church and Awaken Church, but the warnings are not stopping some churches from shutting down indoor operations.Since the pandemic began, Awaken Church has received two cease and desist letters. Once in July for its Balboa Campus, and the latest on Monday for the Carlsbad location, but it appears the church has no intentions of shutting down indoor services.A statement posted on the church’s website said in part, “In keeping our First Amendment right, we will continue to minister to those who are the most affected by all the COVID-19 lockdowns. Specifically tending to those who are struggling with depression, anxiety, hopelessness, suicidal thoughts, and addiction.”Bishop Arthur Hodges is a Senior Pastor at South Bay Pentecostal Church. As bishop, he oversees more than 100 churches in Southern California, including 25 in San Diego County.“About 50 percent are electing to remain indoors for worship,” he said. “About 30 percent are outdoors, and 20 percent are online only.”Hodges has taken the fight to stay open to the U.S. Supreme Court once, and it about to again, hoping a ruling could benefit all houses of worship nationwide.“We are filing either today or tomorrow back in the Supreme Court to reopen churches and for our constitutional guarantees to be recognized,” he said. “We are hopeful for an expeditious ruling, and we think it’ll be favorable to churches, and that’ll affect churches not only in California but across the nation.”A county spokesperson said if a cease and desist order is ignored, the next step would be a closure order. SACRAMENTO, Calif. (KGTV) — California’s Senate has approved a measure to increase the scrutiny of hunting licenses used in gun sales, prompted by last year’s fatal shooting at a Poway synagogue. Senate Bill 914, introduced by Democratic Sen. Anthony Portantino, would require gun stores and the state Department of Justice to both check the validity of hunting licenses during a waiting period after gun buyers purchase a weapon and before they pick it up.
