SAN DIEGO (CNS) - Four local restaurants and gyms are suing the state and county over its coronavirus restrictions as a shutdown of indoor operations looms for many county businesses.The lawsuit was filed Thursday in San Diego Superior Court on behalf of Cowboy Star Restaurant and Butcher Shop, Home & Away Encinitas, Fit Athletic Club and Bear Republic.The suit comes as San Diego County is slated to shut down indoor operations for nonessential businesses at midnight due to its recent entry into the most restrictive, purple tier of the state's coronavirus reopening plan.The businesses allege that San Diego's increased case numbers are not a result of exposures at restaurants, gyms and other types of businesses that will be impacted by the impending closures. The lawsuit cites recent figures indicating restaurants/bars, retail businesses, places of worship, schools and gyms make up a small percentage of confirmed community outbreaks.San Diego County Public Health Officer Dr. Wilma Wooten recently submitted an adjudication request to the state seeking to have San Diego County remain in the red tier. The request was rejected by the state last week."Penalizing the impacted sectors for case increases is wrong, as these sectors continue to do the right things, while trying to weather the ongoing pandemic and the back forth of reopenings," Wooten's request states.The businesses allege in their complaint that they may be forced to shut down permanently if the shutdown is not averted. Each business said it has had to undergo significant closures due to the pandemic, despite abiding by public health orders and implementing safety measures to remain in compliance with the orders. 1708

SAN DIEGO (CNS) - A man accused of ambushing a janitorial worker at a Little Italy coffee shop and trying to sexually assault her pleaded not guilty Wednesday to a half-dozen felony charges, including kidnapping with the intent to commit a sex offense.Christopher Merron, 28, was ordered held on million bail. He faces life in prison if convicted, said Deputy District Attorney Nicole Roth.Merron allegedly attacked the woman as she was cleaning the coffee shop in the 1700 block of India Street about 4:30 a.m. last Sunday, pushing her into a back room, taking her car keys and threatening her with a knife.Following a struggle, the victim, whose name was withheld, was able to break free and run out of the building, said San Diego police Lt. SAN DIEGO (CNS) - A Vista man who possessed child pornography and also secretly recorded an underage girl showering at his home via hidden camera was sentenced Friday to seven years in federal prison.Following his release from custody, Jeffrey John Lenhof, 41, will also be on supervised release for 10 years, during which he will be required to comply with conditions that include a prohibition from having contact with minors or accessing the Internet.Lenhof pleaded guilty last year to a receipt of child pornography count, following a law enforcement investigation into suspected child pornography on his computer.Homeland Security Investigations found that from as early as March 2017, child pornography files were made available from his home via a peer-to-peer file-sharing program, the U.S. Attorney's Office said.A search warrant served at his home in April of 2019 resulted in the seizure of three computers, an iPhone and an SD card that contained child pornography or were used to download or view child pornography, according to the U.S. Attorney's Office.Investigators also found videos that appeared to have been recorded with hidden cameras in his home and other locations.One video showed a teenage girl, aged 13 or 14, entering the bathroom of his home, undressing and showering, with no indication she is aware of the camera's presence, court documents state. The U.S. Attorney's Office said a man witnesses confirmed was Lenhof can be seen setting up the camera prior to the girl entering the bathroom and retrieving it after she left.A second search warrant served at his home last year led to the seizure of three additional hidden cameras, prosecutors said."Today's sentencing highlights the hard work of our agents and the U.S. Attorney's Office to take a child predator offline, and should serve as a warning to others who perpetuate the exploitation of children," said Cardell T. Morant, Special Agent in Charge of Homeland Security Investigations (HSI). SAN DIEGO (CNS) - Authorities reached out to the public Wednesday for help in tracking down a motorist involved in a fatal hit-and-run on a Clairemont- area street last month.The unidentified driver's black four-door sedan struck and killed 44- year-old Shane Moore as he was crossing the street in the 5500 block of Clairemont Mesa Boulevard shortly before 7:30 p.m. Jan. 22, according to San Diego police and the county Medical Examiner's Office.The motorist continued driving and fled the area to the east. An SUV then ran over the mortally injured pedestrian.Moore, who apparently was homeless, died at the scene, despite efforts by witnesses to render first-aid.Based on broken-off car parts found at the site of the traffic fatality, investigators believe the vehicle that struck Moore was a 2016 or 2017 Honda Accord, police said.Anyone who might be able to help identify the hit-and-run driver is asked to call San Diego County Crime Stoppers at 888-580-8477 or contact the agency online at sdcrimestoppers.org. SAN DIEGO (CNS) - A veteran San Diego fire captain pleaded guilty Wednesday to a felony domestic violence charge for injuring his girlfriend during an argument.Steven Michaels, 54, faces up to a year in jail when he is sentenced Feb. 7.As part of his plea agreement, Michaels -- a 30-year firefighter with San Diego Fire-Rescue -- will be on probation for three years, said Deputy District Attorney Stephen Marquardt.Judge Timothy Walsh also ordered the defendant to have no contact with the victim, Marquardt said.RELATED: Trial begins for man accused of stabbing two San Diego firefightersAt his arraignment in August, a prosecutor said Stevens shoved his girlfriend against a wall on July 21 and refused to let her use a cell phone to call for help after she was injured.Michaels has been arrested twice in the past for alleged domestic violence -- once in 2006 and again in December 2015.His run-ins with law enforcement were brought up during the trial of a man who stabbed two San Diego firefighters at an East Village trolley stop in June 2015.Defense attorney Gretchen von Helms didn't immediately comment on how Stevens' felony guilty plea will affect his job status. 1189
