WASHINGTON (AP) — A federal appeals court said Thursday it plans to review a decision ordering the dismissal of the Justice Department’s case against former Trump national security adviser Michael Flynn.The action by the U.S. Circuit Court of Appeals for the District of Columbia is likely to prolong the fight over Flynn’s fate and represents yet another dramatic development in a case that has taken unexpected twists and turns over the last year and turned Flynn into something of a cause celebre for President Donald Trump and his supporters.Flynn pleaded guilty in 2017 to lying to FBI agents about his conversations with a Russian diplomat ahead of the inauguration of President Donald Trump.The court set arguments for Aug. 11. It did not offer an explanation for its decision in a brief order posted online, saying only "FURTHER ORDERED that oral argument before the en banc court be heard at 9:30 a.m. on Tuesday, August 11, 2020. The parties should be prepared to address whether there are 'no other adequate means to attain the relief' desired."A three-judge panel of the court ruled 2-1 last month that U.S. District Judge Emmet Sullivan had overstepped his bounds by not granting the Justice Department’s request to dismiss the case against Flynn.The Justice Department in May moved to dismiss the case against Flynn, one of the signature prosecutions of special counsel Robert Mueller’s investigation into Russian election interference.The motion followed a review by a U.S. attorney appointed by Attorney General William Barr to scrutinize the case.But rather than immediately dismiss the case, Sullivan appointed a retired federal judge to argue against the Justice Department’s position and to consider whether Flynn could be held in criminal contempt for perjury. WASHINGTON (AP) — President Donald Trump and his allies are taking what appear to be increasingly frantic steps to subvert the results of the 2020 election, according to law scholars, including summoning state legislators to the White House as part of a longshot bid to overturn Joe Biden’s victory. Trump also has personally called local election officials in Michigan who are trying to rescind their certification votes in Michigan. His legal team has suggested that a judge order Pennsylvania to set aside the popular vote there. And his allies are pressuring county officials in Arizona to delay certifying vote tallies. During a press conference Thursday, the president's personal attorney, Rudy Giuliani, who is working on the campaign's lawsuits, made accusations of voter fraud in a handful of states, and seemed to suggest officials in several big cities were working together. "It’s not a singular voter fraud in any one state. There is a pattern in several states," Giuliani said. "To any experienced prosecutor, it would suggest that there was a plan." However, he did not give any evidence or further details about what led him to believe there was a "plan," other than baseless statements that the cities had "a history of corruption."“It’s very concerning that some Republicans apparently can’t fathom the possibility that they legitimately lost this election,” said Joshua Douglas, a law professor at the University of Kentucky who researches and teaches election law.“We depend on democratic norms, including that the losers graciously accept defeat,” he said. “That seems to be breaking down.”Election law experts see this as the last, dying gasp of the Trump campaign and say there is no question Biden will walk into the Oval Office come January. 1774

Voters in Maine are trying out a new election system this year.“It is going to be used this fall for the first time in the presidential race, and that was a focus of a series of court challenges that went back and forth up though just a few weeks ago before it was finally determined, yes it will be used in the presidential race,” said Mark Brewer, Professor of Political Science at the University of Maine.What is ranked-choice voting? And how does it differ from how you fill out the more traditional “choose one,” or plurality, ballot design?“Normally you'll have a grid of candidates, all the candidate names on the left side and all of your choice columns along the top,” said Chris Hughes with the Ranked Choice Voting Resource Center. “Once we get everybody's ballots in, you count up all the first choices. If anyone has the majority, they get 50% of all those first choices, then that person is the winner.”However, if no candidate gets 50%, “you eliminate whoever has the fewest first choices and count the second choices on those ballots instead,” Hughes said.Ranked-choice voting has already been used for some local elections in states like California.“The big surge we’ve seen in the last 20 years started in San Francisco. San Francisco adopted ranked-choice voting in 2002 to eliminate their run off elections. Now they have a single general election,” Hughes said. “The last 20 years we’ve seen this huge growth, even between 2016 and 2020 we’ve seen five more cities adopt ranked-choice voting.”Why is Maine making the change now, in the brink of a critical presidential race? It’s a decision that was made four years ago. In 2016, the Ranked Choice Voting Act was passed by Maine voters, which meant ranked-choice voting would be used in certain statewide elections going forward.However, with every type of voting -- and there are many methods -- there are pros and cons.“In simpler elections ranked choice voting is probably going to do a decent job. But in more complicated elections where there are a bunch of candidates and it’s a tight race you run more of a risk of anomalies occurring,” said Aaron Hamlin with The Center for Election Science.What does this voting method mean for Maine, and the U.S. as a whole this election?“Ranked choice is going to come into play in the United States Senate race here in Maine,” Brewer said.“It’s not inconceivable that the Maine Senate race ends up deciding control of the U.S. Senate, and we're not going to know the outcome of the Maine Senate rate on election night. I can't imagine we will. It's going to be days after.” That is, if one of the Senate candidates doesn’t receive a 50% majority vote.“You don't have to start the reallocation process unless someone fails to get 50%,” he said.This Election Day, five more cities and two states, Alaska and Massachusetts, will vote on using ranked-choice voting in their future elections as well. 2920

VISTA, Calif. (KGTV) -- The husband of a Vista woman who went missing in 2017 has been arrested for her murder, according to the San Diego County Sheriff’s Department.Hector Martinez was arrested Thursday morning for the murder of Maria Guzman, who was reported missing on October 13, 2017.The couple had been married for 20 years and has three daughters who, at the time of her disappearance, were nine, 15 and 19. According to the department, Martinez reported Guzman missing after the couple got into a fight. Martinez told authorities Guzman went for a walk around 9 p.m., leaving behind her belongings at the family’s Vista apartment. RELATED: Search continues for North San Diego County woman missing for nearly a year  Investigators recently found Guzman's remains in a rural area near Palomar Mountain.
