SAN DIEGO — A lawsuit was announced Monday over the death of Roxsana Hernandez, a transgender woman who died in Immigration and Customs Enforcement custody earlier this year as she sought asylum at the border.Hernandez arrived at the U.S.-Mexico border in San Ysidro in May from her native Honduras, but Transgender Law Center Director Lynly Egyes said Hernandez “came to the U.S. seeking protection and instead was met with torture.”"An independent autopsy report reveals that Roxsana was shackled for a long time and very tightly, enough to cause deep bruising on her wrists. SAN FRANCISCO (AP) — Oakland on Tuesday became the second U.S. city to decriminalize magic mushrooms after a string of people shared how psychedelics helped them overcome depression, drug addiction and post-traumatic stress disorder.The City Council voted unanimously to decriminalize the adult use and possession of magic mushrooms and other entheogenic, or psychoactive, plants. Denver voters approved a similar measure for people 21 and older last month.Speakers overwhelmingly supported the move, describing substances like peyote as traditional plant-based medicines. One man who described himself as a former heroin addict said such plants saved his life. Some offered mystical descriptions of the hallucinogens as providing spiritual healing.The vote makes the investigation and arrest of adults who grow, possess, use or distribute entheogenic plants one of the lowest priorities for police. No city money could be used to enforce laws criminalizing the substances, and the Alameda County district attorney would stop prosecuting people who have been apprehended for use or possession.Council member Noel Gallo, who introduced the resolution, had said decriminalizing such plants would enable Oakland police to focus on serious crime.Amendments offered by Council member Loren Taylor added caveats that the substances "are not for everyone," recommending that people with PTSD or major depression seek professional help before using them and that people "don't go solo" but seek expert guidance and have a trusted friend present during the use.The ordinance also directs the city administrator to come back within a year to provide the council with an assessment of the law's impact on the community."Entheogenic plants and fungi are tremendous for helping to enable healing, particularly for folks who have experienced trauma in their lives," Carlos Plazola, chairman of the advocacy group Decriminalize Nature Oakland, said before the council meeting. SAN DIEGO COUNTY, Calif. (KGTV)— With precipitation numbers up, participation numbers were down for outdoor events around San Diego County. But many who chose to endure the rain said it was worth the extra splash. It’s a rare sight in the heart of San Diego: kids sledding on a giant snowy hill at Montgomery Waller Park. For the Murillo family, it’s an annual tradition. “We go to see Santa Claus, we go to the little stores that they have there, and we come to sled down for a little bit,” mother Diane Murillo said. She and her children were bundled up while having fun at San Diego Snow Day. But this year, Murillo noticed that the crowds were much smaller. “It’s a lot smaller. It’s empty today. There’s actually parking,” Murillo laughed. She said the steady rain discouraged many folks from showing up. The City of San Diego even had to cancel Santa Claus’ helicopter fly-over of the park, due to inclement weather. Murillo also noticed that the snowy hill was very sludgy, and only about half its normal length. But by the looks of the children, the event was still worth it. Meanwhile, in the South Bay, there was a tent full of Christmas-themed games. From Candy Cane trees, ring tosses, to face paint, families enjoyed the free entertainment at the Chula Vista Children’s Faire. “It helps, because that way, we’re not getting wet while they are getting their stuff done and doing the activities. So it’s nice,” mother Felice Navarro said. Her neighbor invited her and her children to join them at the fair this year. The kids also had an option to splash around if they wanted, as they ran through an obstacle course as Chula Vista junior firefighters. Fun was not just reserved for children. Up at Liberty Station, hundreds of people waited in line to join the San Diego BBQ and Beer festival. 25-year-old Victoria Ransom was not going to let the rain dampen her birthday celebration. “We wanted to be able to double fist if that was a possibility. SAN DIEGO (KGTV)-- It's been more than a year since the first legal cannabis transaction took place in the City of San Diego. Marijuana industry professionals gave members of the City Council an update on revenue, but also pushed for updated laws.The City if San Diego found out that going green generated green. Since San Diego voters approved of Measure N or the Cannabis Business Tax in 2016, the City’s general fund has increased by .3 million. It's the culmination of a 5% tax from the 14 legal pot shops within the city in 2018.Dallin Young with the Association of Cannabis professionals also updated Council members that crime numbers around marijuana establishments are close to none. However, Young also expressed the industry's hopes for updated city rules. He said the permits are a massive hurdle for pot shop operators. As it stands now, both public retailers and harvesting facilities are only permitted in areas one thousand feet from parks, schools, and churches, 100 feet away from residential areas, and they must be in industrial zones. “Those properties are a little more expensive, they’re off the beaten path, and there are not many available," Young said. Because of these strict rules, Young said future operators struggle to open. More people are applying for permits than what the city has made available. He said the supply and demand for marijuana facilities in the city of San Diego do not align. “We’re just asking for this business and industry to be treated like any other business when it comes to commercial sales," Young said.The industry is also asking the city to consider a place for customers to use their products. Now, people can only smoke pot products if they own their home, or if their lease allows for pot smoking. That is why Young is suggesting the city to approve the opening of a pot version of a hookah bar.“[We are asking for] Consumption at these retail locations or a separate use like a cigar bar or more like a tasting room for a brewery,” Young said.Lastly, Young is hoping the city extends the operating hours for pot shops to match the State's. Currently, the city only allows pot shops to operate between 7 am and 9 pm. The State of California allows for sales between 6 am and 9 pm.“We want to make sure that this industry is thriving and it does well. So if it’s one extra hour, that’d be great," Young said. Young understands that changing rules for a new industry is not easy. But he is hopeful with small changes, it will shift the industry away from illegal sales."I think a lot of people would rather go to a licensed facility than to someone down the street," Young said. 2650

SAN DIEGO, Calif. (KGTV) - A third gender option will be available for California drivers licenses and ID’s starting in 2019. The law, SB 179, was signed by Governor Jerry Brown in October. It will allow people to apply for a ‘non-binary’ gender marker if they do not identify as either male or female. “For me, it was surprising to see this change,” said Al Johnson, a transgender activist and member of Trans Family Support Services. Johnson is non-binary and uses pronouns they/them. But with that surprise, came excitement. “Not only does it mean we’re being recognized by society and the people around us but were also being recognized by government entities as valid and real people,” they said. Johnson says they know people who plan on changing their gender to non-binary, but so far, they have not decided to do it on their own license. “I’ve definitely considered it, but in the end I don’t think I’m going to,” they said. “I just came out to my parents and in my personal life I’m trying to navigate that.” The DMV’s website is encouraging those who want to apply for the change to schedule an appointment as early as January 2, 2019. 1154
