A Manhattan judge ruled on Wednesday that a bar can legally eject and not serve a customer for wearing a hat containing President Donald Trump's campaign slogan "Make America Great Again," the New York Post reported. The judge ruled that there is not a law against political discrimination. In January 2017, Greg Piatek was asked to leave the New York City watering hole The Happiest Hour because he was wearing a "Make America Great Again" hat. Piatek claimed that a bartender told him that they do not serve Trump supporters. According to the New York Post, Piatek claimed in the lawsuit that the incident “offended his sense of being American.”Piatek's attorney argued that his client wore the hat to pay tribute to victims of the September 11, 2001 attacks. Piatek claimed he visited the 9/11 Memorial before going ot the bar. “The purpose of the hat is that he wore it because he was visiting the 9/11 Memorial,” Piatek's attorney Paul Liggieri said, according to the Post.   Attorneys for The Happiest Hour claimed that political beliefs are not a protected class. While Liggieri claimed that honoring the 9/11 victims was part of his spiritual beliefs, Judge David Cohen ruled that the hat is not faith-based.  1340

A new study suggests misguided antibodies created as a response when someone is infected with the coronavirus could be the cause behind both more severe COVID-19 symptoms and those who report having symptoms for months after initially recovering.Researchers at Yale University found that COVID-19 patients they studied had high levels of antibodies that had turned on them; these wayward antibodies blocked antiviral defenses, wiped out helpful immune cells and attacked the body in several areas including the brain, blood vessels, liver and gastrointestinal tract.“Covid-19 patients make autoantibodies that actually interfere with immune responses against the virus,” Aaron Ring, an immunobiologist at Yale and senior author on the study, told The Guardian.Autoantibodies are antibodies that attack the body’s own proteins by mistake and disrupt their normal functions.“We certainly believe that these autoantibodies are harmful to patients with Covid-19,” said Ring. He added that the harmful effects of these autoantibodies could continue well after the initial infection has been overcome. He said antibodies can last for a long time, and if they are misguided in their attacks, the effects of their attacks on the body could also last a while.The study, which has yet to be peer reviewed and formally published, looked at antibodies from 194 COVID-19 patients and hospital workers with a range of symptoms and severity of symptoms.Other conditions, like lupus, multiple sclerosis and rheumatoid arthritis, are also made worse by the immune system malfunctioning and attacking the body. 1600

A train carrying dozens of Republican members of Congress, including House Speaker Paul Ryan, to their legislative retreat in West Virginia hit a truck on January 31, 2017 leaving one person dead.Wednesday the National Transportation Safety Board released a preliminary investigation into the crash.They said around 11:15 a.m., a 2018 Freightliner truck equipped with a McNeilus Truck & Manufacturing refuse body was traveling southbound on Lanetown Road in Albemarle County near Crozet, Virginia.The refuse truck, operated by Time Disposal LLC, had a 30-year-old driver and two passengers as it drove towards a highway–railroad grade crossing, later identified. The crossing is active and includes advance warning signs and pavement markings on its approach, the National Transportation Safety Board said. The crossing is also equipped with crossbuck signs, warning lights, bells and gates.As the truck neared the highway a westbound Congressional Special Amtrak train was approaching the highway–railroad grade crossing.The NTSB said the train’s lead locomotive was equipped with a forward-facing track image camera. Data that was taken from the camera showed that as the crossing came into view, the gates were down and the truck was on the grade crossing. Witnesses to the crash reported that the refuse truck entered the crossing after the gates were down.The train’s recorder showed the Amtrak train was traveling about 61 mph when the engineer applied emergency braking. The train struck the left rear of the refuse truck, causing the truck to rotate counterclockwise and then collide with a railroad signal next to the tracks. The refuse body separated from the truck, and the truck’s two passengers were ejected, according to the NTSB.As a result of the crash, one passenger in the truck died. The other truck passenger had serious injuries and the driver of the truck had minor injuries. Three Amtrak crewmembers and three train passengers sustained minor injuries, the NTSB said.NTSB investigators and Albemarle County Police Department officials and the Federal Bureau of Investigation documented the crash scene and the characteristics of the crossing, the train and the refuse truck. The track and operational characteristics of the crossing signals were also examined and documented.The crash remains under investigation.  2354

A report released from the Centers for Medicare and Medicaid Services says a patient died after a nurse at the Vanderbilt University Medical Center in Nashville selected the wrong medication to give them, putting at risk the hospital's ability to receive Medicare payments.In fact, the paralyzing anesthetic that was given to the patient by mistake is one of the drugs Tennessee uses to execute death row inmates during lethal injections.The incident happened in December of 2017. According to a report conducted by CMS, the patient checked into the hospital with a subdural hematoma and vision loss.The patient was sent to the hospital’s radiology department for a full body scan. When the patient told caregivers they were claustrophobic, doctors prescribed Versed, a standard anti-anxiety sedative.  The report from CMS said a nurse told the patient they were going to give them "something to help him/her relax."The patient instead received a dose of vecuronium from that unnamed nurse.  Vecuronium is a neuromuscular blocking drug that causes paralysis.  As such, the CMS report says it can also stop the body from being able to breathe, in a painful experience for patients, who remain conscious and aware."Patients can experience intense fear when they can no longer breathe.  They can also sense pain," 1418

A second report in as many days is predicting an “extremely active” hurricane season.The National Oceanic and Atmospheric Administration released their annual August update for the Atlantic hurricane season Thursday. They are predicting 19 to 25 named storms, where 7 to 11 of them become hurricanes and 3 to 6 of those become major hurricanes with winds of 111mph or greater.Hurricane season ends November 30.There have already been nine named storms in 2020, the earliest that has happened since historical records began. Hurricane Isaias was also the fifth storm of the season to make landfall. It’s the fastest we’ve gotten to five land-falling storms since the old record set back in 1916.Historically, according to NOAA’s Climate Prediction Center, only two named storms form on average by early August and the ninth storm typically does not form until October.“This is one of the most active seasonal forecasts that NOAA has produced in its 22-year history of hurricane outlooks,” said U.S. Secretary of Commerce Wilbur Ross. “We encourage all Americans to do their part by getting prepared, remaining vigilant, and being ready to take action when necessary.”On Wednesday, Colorado State University’s Tropical Weather and Climate Research Center released their final predictions for the 2020 hurricane season. They believe there will be roughly 24 named storms, and 12 hurricanes.“The primary reason why we’re forecasting such an active season isn’t as much the storm activity that we’ve already had, but the large-scale conditions we’ve observed during July and what we expect to see during the peak of the season,” said Dr. Phil Klotzbach, from Colorado State University.NOAA says current oceanic and atmospheric conditions are making 2020 an active storm year, including warmer-than-average sea surface temperatures, reduced vertical wind shear, weaker tropical Atlantic trade winds and an enhanced African monsoon.Both groups say their predictions are for overall seasonal activity and do not predict landfall.
