SAN DIEGO (KGTV) - Hundreds of criminal cases are being examined and reviewed to make sure prosecutors got the right result. That mission is part of the San Diego County District Attorney’s Conviction Review Unit. The unit has been around for about two and a half years, but there are new visible results of its work.Investigators say Donnell Fulcher shot and killed Roberto Rodriguez shortly after midnight on September 10, 2006.Rodriguez’s pregnant girlfriend was wounded but survived. According to court records, investigators connected Fulcher to the scene in part through DNA evidence found on a glove. Fulcher has always maintained his innocence. “We argued that he was not involved at all,” said his defense attorney, Knut Johnson. “There was also in my view, evidence of some other people who are very likely candidates for people who might have committed this crime.”Because of changes in the way DNA is now analyzed, Fulcher got what most defendants will never see—a chance at a new trial.“The prosecutor’s role is to ensure justice before, during, and after trial. This unit is just another way we can fulfill that mission,” said Bryn Kirvin, the deputy district attorney who leads the conviction review unit. Part of their efforts went into looking at all cases where there could be DNA mixtures, meaning more than one DNA profile in a sample.That’s because guidelines by SWGDAM (Scientific Working Group on DNA Analysis Methods) changed the way they interpreted DNA. “They decided [they wanted] to take a more conservative, a more cautious view when analyzing low-level mixtures,” Kirvin said.According to the District Attorney’s office, approximately 1,525 defendants were tried to jury verdict between 2003 to 2016 for serious or violent crimes. Most did not involve DNA, but in 351 cases, DNA was used at trial.Of those, 254 defendants’ cases involved mixtures. That included Fulcher’s case. Team 10 was in court on October 29th when Fulcher chose to plead guilty to voluntary manslaughter and assault with a firearm, instead of going through another trial.The judge sentence Fulcher to 14 years, but he received credit for time already served. He has since been released.Prosecutors with the unit did not talk specifically about Fulcher, but emphasized their mission of finding justice. “Anything about the case that gives us doubt that we lose our confidence in the conviction, we shouldn’t be afraid to act. We should be running to the courthouse to act,” said Deputy DA Brent Neck who also works with the conviction review unit.In Fulcher’s case, prosecutor Hector Jimenez still believes they got the right individual. “We still believe that we have the right guy, but we lost confidence in the conviction, so we wanted to give the defendant a chance to have a new trial if he wanted,” he told Team 10 on October 29.“He chose to plead guilty instead, so at the end of the day, I believe justice was done.” Anyone can apply to get a conviction reviewed, but there are guidelines.The conviction must have happened in San Diego County Superior Court, the person must still be in custody, and the conviction must be for a violent or serious felony.There must also be some type of credible evidence of innocence. “It doesn’t matter how old the case is. We’re going to be willing to go back and look and make sure that we got it right,” Kirvin said.  3412

They met when they were young and growing up in Mosul, Iraq.Now over 100 years old, Elias is a little hard of hearing, but still loves his wife deeply. The couple celebrated their 75th wedding anniversary this week, and one of their granddaughters, Lana, helped share their story"He used to tutor her when she was in high school, and they fell in love," Lana says. "The American dream they wanted, they wanted a better life, of course, they were under Saddam Hussein's reign at that time, so they just wanted a better life for their future."That was more than 30 years ago. So why did they choose Rancho San Diego as their new home?"Because it was similar weather to Iraq and they just wanted a similar, warm and sunny environment," Lana said.The celebration came with a trip to the Hotel del Coronado and a cake. SAN DIEGO (KGTV) -- Gov. Gavin Newsom on Thursday ordered a statewide "limited Stay at Home Order" for San Diego County and other counties in the state's COVID-19 purple tier.In a release on the governor’s website, the state’s curfew will take effect Saturday, Nov. 21. It will be from 10 p.m.-5 a.m.The curfew is set to expire on Dec. 21 at 5 a.m.The state said the restrictions are similar to the stay at home order issued in March.This time, however, the order only applies to counties in California's purple tier status under its COVID-19 reopening plan.Newsom said, “The virus is spreading at a pace we haven’t seen since the start of this pandemic and the next several days and weeks will be critical to stop the surge. We are sounding the alarm. It is crucial that we act to decrease transmission and slow hospitalizations before the death count surges. We’ve done it before and we must do it again."San Diego County Supervisor Greg Cox, in response to the statewide curfew, said, "Look, we know we all want to see this pandemic end. And believe me, we do too. But those who float the public health orders, those who refuse to use masks and facial coverings are just prolonging the misery."“Bottom line is, wear those damn masks out there. Socially distance. And the sooner we do that, the sooner we’re going to get through this crisis,” said San Diego County Sheriff Bill Gore.Gore says they are devoting four two-men deputy teams to work full time with county compliance officers.He says they are not going door-to-door but following up on complaints about businesses or entities violating public health orders. They will attempt voluntary compliance and education first. Retail giants like Kohl’s and Target have announced huge holiday openings, with Kohl’s planning to hire 90,000 holiday associates. Target is also opening up 130,000 seasonal jobs. Although big box stores are hiring a lot of seasonal employees, local businesses are also increasing staffing. SAN DIEGO (KGTV) - Dozens of San Diego short-term vacation rental hosts sounded off Wednesday against a bill that could limit how much they're able to rent out some of their properties on sites like Airbnb and VRBO.The hosts implored the California Coastal Commission to oppose the bill at its meeting on Shelter Island.The bill, by North County Assemblywoman Tasha Boerner Horvath, is specific to San Diego County's coastal zone and would sunset in five years. It would limit how much hosts can rent out their non-primary residences on sites like Airbnb and VRBO to 30 days a year. "I can't believe this has even come up as an actual bill," Airbnb host John Wilson told the commission.Hosts also said they are using the income to put their kids through college, and that their rentals provide families affordable, large accommodations near the coast, allowing visitors to avoid renting multiple hotel rooms and resort fees. But Boerner Horvath said the bill is needed because short-term rentals are adding to the region's housing supply crunch."When the upper level of housing stock is removed for short-term vacation rentals, the folks that would have actually lived there move down the market; they usually want to live in a certain area," she said. The bill passed the Assembly and is now scheduled for state Senate committee hearings. The legislation comes after an Airbnb-led signature drive essentially blocked restrictions the San Diego City Council approved in 2018. The commission heard 90 minutes of testimony, overwhelmingly opposed to the bill. Still, it remained neutral on the legislation. Boerner Horvath said the reason the testimony was so one-sided was because her bill's supporters were likely busy working day jobs. 1745
