ESCONDIDO (CNS) - An argument between two men at a northern San Diego County gym Tuesday turned into a baseball bat assault that sent one of them to a hospital, authorities said.A bystander made a 911 call shortly after 9 a.m. to report the fracas outside LA Fitness in the 300 block of West El Norte Parkway in Escondido, according to police.Witnesses told officers the dispute started as a quarrel inside the business, Sgt. Mike Graesser said.The bickering men eventually made their way outside the gym, at which point one of them went to his car, retrieved a bat and attacked the victim with it, hitting him on the head at least once, Graesser said. The attacker then got into the vehicle, a black sedan, and drove off.Medics took the victim to a hospital for treatment of injuries that were not believed to be life-threatening.The assailant remained at large Tuesday afternoon, though police had "a pretty good idea who he is," according to Graesser, who noted that a witness videotaped the assault."We have some good leads," the sergeant said. 1056

EXETER, N.H. — A voter bared her arms, and more, after she was told she couldn't wear an anti-Trump shirt at a polling place and responded by whipping it off and doing her civic duty topless.The woman wore a "McCain Hero, Trump Zero" T-shirt at the polling place in Exeter, New Hampshire, on Tuesday's primary election.In New Hampshire, voters are not permitted to wear any "campaign material" inside a polling station. Moderator Paul Scafidi told the woman that she could not wear the shirt while voting, according to Sea Coast Online.Scafidi said the woman asked why another woman in the polling station was allowed to wear a shirt with an American flag while voting. Scafidi said he determined that an American flag shirt did not constitute as electioneering — a judgment call that he, as the moderator, is required to make.Scafidi then told Sea Coast Online that the woman asked if she should take her shirt off, even though she was wearing nothing underneath."I said, I'd rather she not," Scafidi said, according to Sea Coast Online. "But she took it off so fast, no one had time to react. So the whole place just went, 'woah,' and she walked away, and I let her vote. She could've just gone into the hallway and turned it inside-out."The woman could have faced public indecency charges, but Scafidi said he chose not to involve the police because he "didn't want to escalate the situation further." The woman put her shirt back on before she stepped out of the voting booth.According to InStyle, electioneering laws vary from state to state, but most prevent voters from wearing clothing that directly advocates for (or against) a particular candidate, party or issue while voting. The issue gets trickier when considering articles of clothing with more generic political slogans, like "Make America Great Again" or "Resist." FALLBROOK, Calif. (KGTV) -- A tortoise is recovering after falling 10 feet from a wall Sunday, cracking its shell.The tortoise was found by a good Samaritan after falling from a 10-foot wall while being chased by a dog, according to the County News Center.The 70-pound tortoise was taken to a veterinary hospital where animal services were called.Officials say that’s when they learned it would cost several thousand dollars to fix the 35 to 40-year-old tortoise.“We have a donor-driven Spirit fund that we can use for severe medical cases such as this one,” said County Animal Services Director Dan DeSousa. “This tortoise will get the extensive, aggressive care and long-term observation that he needs to regain his health and hopefully live to a great, old age.”The tortoise underwent surgery Tuesday, where veterinarians put screws into the shell then used ties on the screws to hold the broken pieces together.Veterinarians then used the same paste material that dentures are made from to seal the cracks.For more information or to donate to the Spirit fund, click here. 1098

  

ENCINITAS, Calif. (KGTV) - The Encinitas City Council hopes that a compromise on a controversial bike safety plan will be able to satisfy casual cyclists who feel Coast Highway is not safe, as well as sport cyclists who like being able to zip along current the bike lanes.The route through the Cardiff community between Encinitas and Solana Beach is believed to be the most frequently ridden corridor for bicyclists in San Diego County.The debate began when the city began looking at replacing the current bike lanes with "protected" bike lanes. These will use curbs and bollard posts to separate the lanes from vehicle traffic.City Councilmember Kellie Shay Hinze believes this plan will make the area safer for commuters, beach-goers, and families who would prefer a safe option to ride bikes over driving. Furthermore, she believes there will be environmental benefits, as well."If residents are able to access this beach on foot or by bike, then we free up parking spaces for people that might be coming from farther away and we reduce the congestion that we generate as a city on our roads," Hinze said.However, avid sport cyclists believe protected bike lanes are more dangerous."That is a trap to a cyclist going fast," said cyclist Karl Rudnick. "I would never ride in that."Rudnick explained that funneling all cyclists into lanes divided from the road by curbs and railings gives cyclists who are riding at high speeds nowhere to go when attempting to pass by slower riders. He was surprised to hear that there were safety concerns along that portion of Coast Highway."It was a real eye opener to realize that there's a lot of people who don't ride their bikes who find that stretch very dangerous- the very stretch that I consider the safest, most beautiful stretch in the county," said Rudnick.Rudnick and Hinze both support the compromise plan. While the city will move forward with the protected lanes, it will also paint "sharrows" in the #2 lane of the highway. These indicate to drivers that cyclists have equal right of way to use that lane of traffic. There will also be signage to let drivers know cyclists have legal access to the highway. This is part of an education process to allay fears that many drivers do not know what sharrows indicate.City staff are still working on the specific plans and there is currently no timetable for installation. 2378
