SAN DIEGO (CNS) - San Diego-based medical technology company Phamatech and its CEO have agreed to pay more than million to resolve allegations that they submitted false claims to Medicare and received government reimbursements for unnecessary lab testing, the U.S. Attorney's Office said Friday.Prosecutors allege the company paid kickbacks to a medical clinic, which in return ordered Phamatech lab testing for its patients enrolled in Medicare.Over the course of about two years, Phamatech, which manufactures diagnostic devices and provides lab testing services such as drug and alcohol tests, paid a per-specimen fee to Imperial Valley Wellness in exchange for referrals of urine samples from Medicare beneficiaries, according to the U.S. Attorney's Office.Many of the samples referred to Phamatech were not necessary and thus ineligible for Medicare reimbursement, prosecutors said.The company, along with its CEO and founder Tuan Pham, agreed to pay ,043,484 to settle allegations that Phamatech violated the federal Anti- Kickback Statute and the False Claims Act.The U.S. Attorney's Office said the allegations were originally brought in a lawsuit filed by former Phamatech employee John Polanco, who will receive 7,392 from the settlement proceeds. 1273

SAN DIEGO (CNS) - The San Diego City Council received a handful of presentations Tuesday intended to help the city address homelessness as well as the lack of transitional and permanent affordable housing.Entities presenting to the council included the Regional Task Force on the Homeless, San Diego County, Mayor Kevin Faulconer's office, the San Diego Housing Commission, San Diego State University's Institute for Public Health and the council's Select Committee on Homelessness.Representatives from each office discussed challenges and successes fighting homelessness in San Diego last year. SAN DIEGO (CNS) - San Diego Mayor Kevin Faulconer announced Tuesday that gyms and places of worship would be able to use San Diego's parks to conduct operations outside beginning Monday morning.City Councilman Chris Cate proposed the idea in mid-July, and the San Diego County Board of Supervisors approved a similar ordinance for county parks on Aug. 5.Faulconer said lack of guidance from the state -- even as the city and county expects to learn more Tuesday about possibly being removed from a state watchlist monitoring counties with high prevalence of COVID-19 -- prompted the action."There is no direction currently from the state of California about what a county can and cannot do once it sheds the watchlist designation," he said. On Friday, myself and Supervisor [Greg] Cox sent a letter to the governor asking for direction.San Diego County was placed on that state watchlist by Gov. Gavin Newsom's office for testing higher than 100 positive COVID-19 cases per 100,000 people in the county. The county has been below that number for six days now and is expected to be removed from the list Tuesday. What that means is unclear.Per Faulconer's executive order, San Diego's more than 300 parks, 26 miles of shoreline and 57 recreation centers could be used for gyms, fitness classes and worship services starting Monday. Social distancing and face coverings are still encouraged, but Cate said this could help struggling businesses."Mayor Faulconer's executive order will allow gyms, such as Hardcore Fitness, to bring their physical fitness classes to our city's parks," said Cate, chair of the City Council's Economic Development and Intergovernmental Relations Committee. "Opportunities like this will allow our gyms and churches the ability to welcome back their customers and parishioners in a safe manner."The directive defers park permit fees for 60 days. Faulconer will bring an ordinance to the council once it is back in session in September that would make the waiving of fees permanent.Faulconer made the announcement at Mira Mesa Community Park. Joining him were Cate, the city Park and Recreation Department Director, the Mira Mesa Chamber of Commerce, and the owner of Hardcore Fitness on Miramar Road.It was Faulconer's third executive order allowing for some businesses to operate outside. Previously, he had allowed for some retail and restaurants, and subsequently for gyms, barbershops, hair salons and massage businesses to expand to sidewalks and private parking lots."As San Diego continues to navigate the ever-changing rules regarding doing business during this pandemic, we must become more creative at every turn," said Bari Vaz, president of the Mira Mesa Chamber of Commerce. "This executive order will allow residents to continue participating in fitness classes and sharing their faith, until such time as we may safely return to the indoor venues."Outdoor religious services and outdoor fitness classes and camps are all eligible under the executive order. Businesses must display their San Diego County safe reopening plan, hold insurance naming San Diego as an additional insured, and have a city business tax certificate prior to August 1, 2020. SAN DIEGO (CNS) - The ride-hailing company Lyft announced an expansion Wednesday of its pilot program at Camp Pendleton that streamlines access to the U.S. Marine Corps base for military members, their families and civilians who work at the military installation.Lyft launched the pilot program in collaboration with Marine Corps Community Services last year to make it easier for people living on the base to book a ride with a company like Lyft or Uber, which previously required security clearance to enter the base. The ``Base Mode'' feature is now integrated into the app, automatically matching base residents with eligible drivers.In addition, a new state law allows active-duty military members and their families to drive for companies like Uber or Lyft in California with a valid driver's license from any U.S. state. According to the company, military veterans make up roughly 13% of Lyft drivers in San Diego County and more than 1,000 drivers throughout the county have access to the base.``It can be costly or prohibited for military personnel to bring cars from their home state, so they rely heavily on services like Lyft to get around,'' said Lyft driver Victor Gonzalez, a member of Lyft San Diego's Driver Advisory Council.As part of the expansion, the company said it will also share revenue generated by the pilot project with the MCCS, which will use the funds to support Marine Corps recreation programs.``Marine Corps Community Services and Lyft continue to facilitate efficient and economical transportation options for the residents of Marine Corps base Camp Pendleton with this pilot program,'' Camp Pendleton spokesman Capt. SAN DIEGO (CNS) - Opening statements are scheduled Monday in the murder trial of a man accused in the 2015 shooting death of a customer during a robbery at a Clairemont-area gas station convenience store, as well as a shootout with police two days after the killing.Ahmed Hassan Mumin, 34, is charged with murder, robbery, burglary, and being a felon in possession of a firearm in connection with the April 16, 2015, death of 48-year-old Eric Schade. Mumin also faces a special circumstance allegation that the killing happened during the course of a robbery, meaning he faces life imprisonment without the possibility of parole if convicted.He's also charged with two counts of attempted murder on a peace officer for opening fire on two arresting officers in an April 18 shootout at a City Heights apartment.At his preliminary hearing, surveillance footage was shown allegedly depicting Mumin inside an Arco am/pm at around 3:45 a.m., pointing a gun at the clerk and demanding cash. The store clerk testified that the robber was wearing a dark beanie and a bandana covering his face.The clerk testified that he put the cash drawer on the counter. But Schade -- a neighborhood regular -- took a swipe at the robber's gun as if to push it out of his face, and Mumin took a step back and shot the victim once in the chest, prosecutors alleged.The footage shows the shooter rifling through the cash drawer, then fleeing with an undisclosed amount of cash.Two days later, officers tracked Mumin to an apartment complex on Winona Avenue in City Heights. Police officers testified that Mumin hid behind a set of doors in a community room. As a detective tried one of the doors, the defendant opened fire from behind another door, prompting the detectives to return fire, according to testimony.Mumin was shot in the abdomen by police and hospitalized.Co-defendant Adan Ibrahim -- allegedly the getaway driver -- was previously charged with murder, though that count was dismissed earlier this year by San Diego County Superior Court Judge Kenneth K. So through application of the state's new felony murder rule. He still faces trial on robbery charges.Ibrahim's girlfriend, Kristine Mariano, was also in the getaway car during the robbery, according to prosecutors.
