Jurors have found Border Patrol Agent Lonnie Swartz not guilty on the Second Degree Murder charge of shooting through the border fence and killing 16-year-old Jose Antonio Elena Rodriguez.Jurors could not come to an agreement on a verdict on the two lesser charges, voluntary manslaughter and involuntary manslaughter.If they wish, prosecutors can retry Swartz on the lesser charges only.Friday jurors told Federal Judge Raner Collins they could not agree on a verdict.  The judge told them to continue deliberating. They could choose to convict Swartz on lesser charges of Voluntary Manslaughter or Involuntary Manslaughter.Swartz testified he was protecting himself and other officers from rocks thrown over the border fence by people on the Mexican side trying to interfere with efforts to arrests smugglers who were trying to climb over the fence and into Mexico.In closing statements to the jury, prosecutors said in his two years as a Border Patrol Agent, Swartz had rocks thrown at him six or seven times, and each time had responded by using less lethal weapons. Border Patrol may use items like guns that shoot an irritating pepper.But the night of October 10, 2012, Swartz had been on duty at the DeConcini Port of Entry.  He had only his gun and used it to fire 16 rounds through the fence. Ten shots hit the 16-year-old Mexican teen.Prosecutors say the threat against Swartz and other officers was not severe enough to justify deadly force and that they could have easily removed any threat by taking cover.They say other agents took cover but Swartz was fed up with rockings, wanted to send a message, and did it by calmly walking to the border fence, taking careful aim, and firing 16 shots into Mexico.Defense attorney Sean Chapman told the jury rocks are enough of a danger to justify deadly force and that there is no evidence to conclude Swartz fired out of anger over rock attacks. KANSAS CITY, Mo. — More and more women are seeking help getting pregnant. With that help has come an increase in the number of women freezing eggs and embryos.The Centers for Disease Control recently released preliminary numbers for 2016, the latest data available for assisted reproductive technology, or ART, because it takes two years to finalize births and verify data.The data was collected from 463 reporting clinics in the US.There were 76,930 babies born in 2016 as a result of fertility treatments. About 11,000 of those were sets of twins.Of the 263,577 ART cycles (the two-week process of stimulating egg production with the intent to transfer embryos), 65,840 were done so to freeze all resulting eggs or embryos for future pregnancy attempts.The CDC points out the use of assisted reproductive technology is relatively rare, “its use has doubled over the past decade” resulting in 1.7 percent of all infants born in the United States every year are conceived using ART.One of the reporting clinics is Midwest Reproductive Center in Olathe, Kansas.Dr. Dan Gehlbach started the practice in 2004 and has been a reproductive endocrinologist for 25 years. He says he’s moved to almost exclusively freezing all embryos.“Once the data was clear that transferring an embryo soon after egg retrieval was not the optimum time for a transfer, and we could freeze an embryo and allow the uterus to recover from all the hormonal changes that had occurred, and then place the woman on a much lower dose of hormones that just prepare her uterus for an embryo to attach…then we were able to show an improvement in pregnancy rates by transferring a single embryo that had been frozen and thawed verses where we used to transfer two fresh embryos almost routinely,” said Dr. Gehlbach.Gehlbach says this is not only increasing the chances of a successful pregnancy, it is also lowering the risk of twins or triplets. He’s now been following this plan for three years at his clinic.The doctor said advances in medicine may also keep costs down. If a couple can commit to even one round of in-vitro fertilization, fertility doctors can freeze multiple eggs or embryos so the future costs are for thawing and implantation, verses more rounds of IVF.An IVF cycle typically runs ,000 to ,000 when all costs are considered. If no embryos are frozen, the full IVF cycle must be repeated for another attempt.If embryos are frozen after one IVF cycle, thawing an already frozen embryo and implanting it in a woman’s uterus is significantly cheaper than a full IVF cycle. Kevin Spacey made the set of Netflix's "House of Cards" into a "toxic" work environment through a pattern of sexual harassment, eight people who currently work on the show or worked on it in the past tell CNN. One former employee told CNN that Spacey sexually assaulted him.The former production assistant, whose account has never previously been disclosed, told CNN that Spacey sexually assaulted him during one of the show's early seasons. All eight people, each of whom spoke to CNN on the condition of anonymity for fear of professional repercussions for speaking out, described Spacey's behavior as "predatory," saying it included nonconsensual touching and crude comments and targeted production staffers who were typically young and male.The new accusations follow an explosive article published less than a week ago by BuzzFeed News, in which actor Anthony Rapp said Spacey made sexual advances toward him in 1985, when Rapp was 14 years old.On Monday, Spacey released an apology in response to Rapp's account. "I honestly do not remember the encounter, it would have been over 30 years ago," Spacey said. "But if I did behave then as he describes, I owe him the sincerest apology for what would have been deeply inappropriate drunken behavior, and I am sorry for the feelings he describes having carried with him all these years." Spacey's publicist said in a statement on Wednesday that the actor is seeking unspecified treatment following Rapp's allegations.On Thursday, that publicist -- Staci Wolf -- said she and Creative Artists Agency were parting ways with the actor. "He was a man in a very powerful position on the show and I was someone very low on the totem pole and on the food chain there."The production assistant asked that what happened next in the car not be described, for fear that it would identify him.Once they had arrived on set, the production assistant says he helped the actor take his belongings from the car to Spacey's trailer on set. While the two men were in the trailer, the production assistant says, Spacey cornered him, blocked his exit and made inappropriate contact with him."I told him, 'I don't think I'm ok with this, I don't think I'm comfortable with this,'" the production assistant said. That's when the actor became "visibly flustered," fled the trailer, got in his car and left for the remainder of the day, according to the production assistant.The production assistant did not report the incident to any managers of the series or the police, but he did tell a coworker at the time. The supervisor's solution was to never let the production assistant be alone with Spacey while they were on set, the production assistant says.The assistant said the harassment then stopped for long enough for him to feel comfortable driving with Spacey to the set."I have no doubt that this type of predatory behavior was routine for him and that my experience was one of many and that Kevin had few if any qualms about exploiting his status and position," he said. "It was a toxic environment for young men who had to interact with him at all in the crew, cast, background actors."The other people who worked on "House of Cards" with whom CNN spoke all supported the idea that the set could be toxic for young men because of Spacey.A crew member who worked on the show for all six seasons said that Spacey routinely harassed and touched him."He would put his hands on me in weird ways," the crew member said. "He would come in and massage my shoulders from behind or put his hands around me or touch my stomach sometimes in weird ways that in normal everyday conversation would not be appropriate."This crew member said he did not "feel comfortable" telling Spacey to stop. "That's the worst part about this whole thing. Netflix is not aware of any other incidents involving Kevin Spacey on-set. We continue to collaborate with MRC and other production partners to maintain a safe and respectful working environment. "As the producer of the show, creating and maintaining a safe working environment for our cast and crew has always been our top priority. KENOSHA, Wis. (AP) — Two people died and one person was injured as shots were fired late Tuesday in Kenosha during the third night of unrest in Wisconsin following the shooting of a Black man by police, Kenosha police said. Kenosha police Lt. Joseph Nosalik said in a news release that the shooting was reported at about 11:45 p.m. in an area where protests have taken place. The injured victim was taken to the hospital.The Associated Press said authorities are hunting for a possible vigilante seen on cellphone video opening fire in the middle of the street with a rifle. JEFFERSON COUNTY, Miss. – Three men have been arrested in connection with the murder of an off-duty officer state trooper.Mississippi Highway Patrol says 58-year-old Troy Morris was found fatally shot in a vehicle on US 61 in Jefferson County early Friday morning. There were reportedly no signs of theft from the vehicle.Morris was a 27-year veteran and a lieutenant with MHP.Along with being trooper, Morris also worked as a highway contract driver with Blackwell Hauling Inc, which has a contract with the U.S. Postal Service to transport mail between USPS facilities. Officials say he was found in the commercial truck that he used to transport mail.“This is a sad day for law enforcement, the Mississippi Highway Patrol, and the State of Mississippi. Our thoughts and prayers are with the family of Lieutenant Troy Morris. Local, state, and federal agents will work tirelessly to ensure justice,” said Commissioner Sean Tindell.Saturday, MHP announced that Treyon Washington, 24, was taken into custody in Jefferson County and has been charged with Morris’ murder. He’s being held in the Jefferson County Detention Facility with no bond.Meanwhile, Cdarrius Norman, 17, and Damion Whittley, 25, were arrested in New Orleans.
