FALLBROOK (KGTV) -- A couple looking to buy a home in the North County wants to share an experience they're describing as negative as the new solar energy law goes into effect in 2020.The law requires that homes built in California starting in 2020 must have solar panels. It has caused confusion among potential homebuyers, like Brian and Carmen McKay. They recently left Las Vegas, looking to move back to San Diego County.“I used to work at Fallbrook skilled nursing many years ago,” said Carmen McKay. The couple found a home they liked in the Horse Creek Ridge development, a new housing project in Fallbrook.“When we realized it was a corner lot… oh my gosh, we loved it,” Carmen said.They were told the cost was roughly 5,000—which sounded like a reasonable price for San Diego, according to the McKays. That is when they say they got a surprise from the sales representative.“Then she says, by the way, once we were sold on the house and the price… there’s solar panels on the house. You have the option to lease it or buy it. And we’re like, why?” Carmen said.They said during the home tour, solar panels were not mentioned at all. Carmen said the sales representative only mentioned it when they were back in the office, ready to sign documents to buy the home. As the McKays were questioning solar, they were told “it’s required by the state.” That is only partially true. A spokesperson for the California Energy Commission told Team 10 that “the law only applies to homes that have been permitted after Jan. 1, 2020.”“If that’s not the case with the home in question that you mentioned, then the mandate does not apply,” wrote energy commission spokesperson Edward Ortiz.The McKays were told it would be about ,000 extra to buy the solar panels.“I think that it was misleading because we were buying a house that we were told it was 5, but it’s actually 5 or we’re paying a higher monthly out of pocket,” said Brian McKay.The seller knew they were on a time crunch.“We sold our property [in Nevada]. We’re at an AirBnB… we need to buy,” Carmen added.Nobody at the sales offices at Horse Creek Ridge would comment. Team 10 was directed to public relations. Through email, the spokesperson said:“Two separate state energy requirements guide D.R. Horton in its decisions regarding home design options in the state of California – the current State Energy Code requirements (commonly known as Title 24) and the State‐Mandated Solar requirements, which take effect in 2020. In most communities, we have found that solar is the best, most cost‐effective option for both D.R. Horton and our homebuyers to meet the current Title 24 Energy Code requirements. Thus, Horse Creek Ridge was designed using solar to meet the current Title 24 requirements, and as a result, we are required by the state to have solar on each home in the community.”When asked why that was not told to the potential homebuyers from the beginning, during the tour of the home, D.R. Horton spokesperson added that “solar requirements are communicated to customers via numerous marketing materials… and as an addendum to the home purchase agreement.” She pointed to an 8-page brochure, where solar is mentioned once on page 7. She also sent Team 10 an image of solar displayed on a model home—something the McKays said they never saw.There is no mention of solar or photos of any homes with solar on Horse Creek Ridge’s website. “I feel like I was deceived,” Carmen said. “We fell in love with the place. I felt like I was pushed in the corner.”Dan Zimberoff is an attorney not involved in this case, but he has seen solar disputes in the past. “A buyer needs to be aware,” Zimberoff said. “If you’re purchasing a new home and you see what that price is, ask the details. Is that really going to be the final price?” “We’re starting to remember why we left California,” Carmen said.The McKays ultimately decided not to buy the home. They hope their experience teaches others about the right questions to ask. “We were willing to pay the higher cost to live here, but I don't like being misled by builders,” Brian said. ESCONDIDO, Calif (KGTV) -- A Palomar Water delivery man is being credited for saving the life of an elderly woman who fell and couldn't get up to call for help. On Monday, Marco Perea showed up to deliver water for his 88-year-old customer in Escondido. When he knocked on her door, he could hear her, but she wouldn't come to the door. After several attempts to get her to open the door, she was able to tell him that she'd fall on Sunday afternoon and hadn't been able to get up since then. Perea called 911 and paramedics and firefighters were able to make entry into the apartment. The woman was rushed to the hospital. Perea says the woman does have a caregiver, but only from Monday through Fridays. The woman's condition is still unknown. 755

ENCINITAS, Calif. (KGTV) — Cardiff Elementary School in Encinitas must pay 0,000 just so it can resume a project to modernize its campus.The payment is part of a settlement to a group that sued the district over a project to rebuild much of the school, which had upwards of 60-year-old buildings.In 2016, voters approved a million bond measure authorizing the project. The group that sued, Save the Park and Build the School, challenged the plan's environmental impact report and its plan to build a multipurpose facility on part of a grassy area of district property that doubles as a public park in off hours. Late last year, a judge ruled in the group's favor and issued an order to halt work on the project. This week, the school and the group reached a settlement to allow campus construction to resume, and put the multipurpose center back into a federal approval process because it involves the National Park Service. The group got 0,000 for legal fees. "It was a flex and it cost our kids and the taxpayers 0,000 to bring us right back to where we were in December," said Morgan Gates, a parent at the school. Eleanor Musick, who heads the group, said the park is cherished and one of the only open spaces nearby. "It was not that we intended to stop the construction specifically to spite them or anything like that, That's the law. If a project is out of compliance with [The California Environment Quality Act] it must stop," Musick said. The delay in construction means the facilities won't be ready for the start of the 2020-21 school year, as originally intended. 1599

  

ENCINITAS, Calif. (KGTV) - Police are investigating an elaborate phone scam that cost an Encinitas woman ,400.Lauren Kennedy says she was driving to work Wednesday morning when she received a phone call around 8:30 a.m. She says she had just gotten off the phone with her mother when all of a sudden she was calling her back.But when she answered, it wasn’t her mother’s voice.“It was a man’s voice telling me he had abducted my mother and he was going to kill her if I didn't do exactly as he told me,” Kennedy said.Kennedy said it became so real when she heard her mother’s voice on the other line.“At that point, that’s when I knew it was real," she said. "I heard her in the background, and I thought for sure that they had taken her.”The man on the other line directed her to go to the nearest grocery store and put money into Money Pak cards. Then they demanded the card numbers over the phone and ordered her to destroy the cards afterward.They told her to cut up the cards and email them photo evidence that they had been destroyed.“At that time he hung up and never called me back,” she explained. “So within a minute or two, I called my mom’s phone and at that time, she answered.”That’s when Kennedy’s realized she had fallen victim to an elaborate phone scam.The Sheriff’s Department says the scammers used a “spoofing device” to make it look like the phone was made from her mother’s phone number.The scammers also called Kennedy’s’ mother in the middle of the fake ransom call. They got her worked up by saying they had her daughter.“They just wanted her to be scared and sound scared. All I heard was her saying my name. I still can't believe it," Kennedy said. “I think their whole intention with calling her was to have her voice in the background while they were asking me to do whatever they wanted me to do." Kennedy says she not sure how the scammers got her information or her mother’s. She says she is always careful with her information and weary of scams.“I don't answer phone calls I don't recognize,” she said. “I don't answer blocked numbers. I let people leave voicemails to determine if it’s legit or not. I feel like the public needs to know about this (scam) because if I can fall for this, anybody can fall for this.”In an email, to 10News the Sheriff’s Department says people should hang up when they get phone calls like this and should immediately call law enforcement.Kennedy says that's what her mother did when she go the call, but for her  - it’s easier said than done.“This was life or death," she said.
