CORONADO, Calif. (KGTV) - For the first time, a local coaching legend is speaking out, 5 months after he was banned from the campus of Coronado High.Retired water polo coach Randy Burgess is accused in a complaint of molesting a former middle school student.A mural of Burgess remains over the pool his water polo teams has used during his 3 decades of coaching, which includes nearly 20 section championships for high school boys' and girls' teams. Three of his players have competed in the Olympics.It's a legacy now in danger."My feeling is beyond frustration. A lot of hurtful things have happened," said Burgess.In May, the former middle school student - now 18 - filed a complaint with Coronado unified.In it, the teen claims during the 7th grade while playing for a club polo team that shared the pool with Burgess' teams, Burgess hugged, kissed, and eventually raped the child, in places like bathrooms and Burgess' car.The school district removed Burgess from the classroom in April, before denying the claim in May.Burgess says his attorney learned the District Attorney's office has declined to prosecute, but 10News is still working to confirm that."My immediate response was this was a case of mistaken identity.  My coaching and teaching career never paralleled with this this individual," said Burgess, who denies ever interacting with the student.Burgess tell us he doesn't know why someone would make up such a claim. He's now suing for reinstatement to teach physical education at Coronado High. In 2015, he retired from coaching, but was still mentoring coaches."I've told my children and my athletes: It's not always what happens to you, but how you handle it. I'm trying to live through those words now," said Burgess.It's not the first time Burgess has been named in a complaint.In 1995, a city supervisor sued him and the city of Coronado, claiming Burgess berated his players, made sexually inappropriate statements in front of students and sometimes allowed male swimmers to swim naked.Burgess says that case was settled with a confidentiality clause."I can only repeat to myself that the people who know me, know me, and the others will come up with their own conclusions," said Burgess.In a statement, Coronado Unified declined to discuss personnel matters, but did say "...the District takes such claims very seriously.  When the allegations became known, the District followed policy and protocol by taking immediate action to protect the safety and security of District students and staff ..."10News reached out to the lawyers representing the former student but have yet to hear back. 2638

CRAWFORD COUNTY, Ind. — A Wisconsin man drowned on Sunday when he jumped into a southern Indiana lake in an effort to save two women who fell off a towable tube and were struggling to stay afloat.According to a report from the Indiana Department of Natural Resources, an Indiana conservation officer was on boat patrol on Patoka Lake in Crawford County around 2:51 p.m. Sunday when witnesses alerted him to a possible drowning. Multiple 911 calls came in shortly after reporting that a man had disappeared in the water.Conservation officers said two females were aboard the towable tube affixed to a stationary rental boat by a rope when they fell off the tube and struggled to stay afloat.Multiple people from the rental boat jumped in to assist and rescued one of the females. One of the people who jumped in to help, Travis Ray St. Martin, 33, of Racine, Wisc., disappeared under the water.The other female, K'neisha Adams, 25, of Burke, Virginia, was rescued by a group of people from a separate boat. She was taken by medical helicopter to University of Louisville Hospital and later released.Conservation officer public safety divers recovered St. Martin's body around 7:30 p.m. Sunday.The Crawford County Coroner's Office has preliminarily ruled the cause of death as accidental drowning.Conservation officers said alcohol and drugs are not suspected of being contributing factors.The DNR said although there were adequate life jackets on the rental boat, none were in use.This story was originally published by Bob Blake at WRTV. 1545

(KGTV) - Two political opponents running against each other for the Coronado City Council have formed a special bond which they refuse to let be ruined by the campaign."She's my opponent, but I love my opponent. She's like a mother to me," says candidate Derik Mundt about fellow candidate Mary Sikes.The two have been friendly since Mundt was a teenager volunteering for the Coronado Film Festival, which Sikes ran until her retirement this year. However, they did not realize when they decided to run that they would be doing so against the other."She's a saint," Mundt said. "When you're sick, she brings you soup. That's what she does. She's like the mom of Coronado."Mundt recently found out how true those sentiments were. Last week he began feeling sick, with a fever topping 102. It turned out to be a case of the flu so bad, he was taken to the emergency room. Mundt ended up hospitalized for five days. One of his first calls was to Sikes."My first thought was just to get there and just be there," Sikes said.Sikes visited Mundt in the hospital each day and stayed in touch with his mother to update her on his status. When it became clear he would not be released in time for the final candidate forum in the race, Sikes made a surprising offer."You've come this far and it's so close," she told Mundt. "I'll give your speech tomorrow because I know it by heart."When Mundt was finally released from the hospital Monday afternoon, it was Sikes who came to pick him up and drive him home."Dirty politics don't belong in politics," Mundt says. "This is how it's supposed to be."There are six total candidates running for two open seats on the Coronado City Council, meaning it's possible Mundt and Sikes could both win or lose."What we've been saying to each other all along is if at least one of us gets on, we know that this town will be in good hands," Sikes said. 1917

  

Complaints are growing nationwide about workplace safety issues related to coronavirus. The Occupational Safety and Health Administration, or OSHA, has received more than 6,500 nationwide on a federal level since February.One trial lawyer who works in employment law says she expects the number of complains will keep going up.“Where I really think the numbers are going to escalate is in the retaliation world, where employees bring issues to their employers' attention about failing to implement appropriate administrative or engineering controls or social distancing measures and then they feel that they have suffered an adverse employment action as a result of bringing this to their employer's attention,” said trial lawyer Laura Lawless.OSHA recently updated its guidance on COVID-19-related workplace safety. It now suggests wherever possible and feasible employers should require masks at work.This guidance is something Lawless says everyone was waiting on. She says for states or cities that already had a mask mandate it was easier to enforce at work already, but for states that don't have this mandate, it was harder until now.“At least you can now turn to CDC guidance and OSHA guidance as an employer and say look even if you disagree with us for a political reason or personal expression reason, we're following the guidance from agencies that are meant to look out for your health and safety,” said Lawless.Still, there are concerns OSHA isn't going far enough in other areas. One big criticism among employee protective organizations, workers organizations and unions is that OSHA’s guidance on COVID-19 isn't a regulation and doesn't really have any teeth.Virginia and Oregon are two states looking to fill in the gap with their own worker protections.If you see issues in your workplace, the employment lawyer recommends being reasonable in your approach and not getting too emotional in your reaction.
