(KGTV) - After Monday's arrest in the death of a Carlsbad woman found on a hiking trail, prosecutors must now decide whether to charge the teenage suspect as an adult.A 17-year-old teen from Carlsbad was booked on murder charges weeks after Lisa Thorborg, 68, was found stabbed to death along Hosp Grove Trail.Investigators tell ABC 10News police work led them to the teenager, before DNA evidence confirmed their suspicions. Former District Attorney turned criminal defense attorney Paul Pfingst says prosecutors must now decide whether the accused should be tried as an adult."An adult for a first-degree murder case can receive a 25 years-to-life sentence. A juvenile can only be kept until the age of 25," said Pfingst.A decade ago, Pfingst represented Heather D'Aoust. At the age of 14, she killed her mother with a claw hammer. D'Aoust was charged as an adult, pleaded guilty and was sentenced to 16 years to life.Pfingst says unlike in that case -- thanks to new state laws -- if prosecutors do charge the 17-year-old as an adult in the Carlsbad case, a judge will have the final say."The more dangerous that person is, they most likely they are to be charged as an adult," said Pfingst.Pfingst says the biggest factor is the crime itself."Is the act is such that it demonstrates such a wanton disregard for life and for people around them that the person needs too be confined?" said Pfingst.Pfingst says the background of the suspect will heavily scrutinized."Including whether they've been involved with gang activity, prior acts of violence, prior acts of rebellion," said Pfingst.Police in the Carlsbad case declined to say if the teen has a criminal history. CHAPEL HILL, N.C. – The pandemic ignited a global fight against a fast-moving and deadly virus. “In the beginning, a lot of manufacturers shifted gears and started doing more COVID manufacturing," said Dr. Melissa Miller, a clinical lab director.Manufacturers began ramping up testing production and diverting supplies to combat the virus. But in the months ahead, laboratories started facing another threat due to a strained supply chain. Not only were labs facing shortages of supplies needed for COVID-19, but several other common illnesses. “Probably the biggest one was for sexually transmitted diseases, chlamydia, gonorrhea being the most common ones we diagnose in the labs," said Dr. Miller. The American Society for Microbiology (ASM) partnered with the Association of Supply Chain Management to track shortages across the country. ASM leaders say the data collection tool provides a near real-time visualization into the capacity, utilization, and resources necessary to meet consumer and patient demand for testing.“It was a bit of a surprise of how overwhelming it was throughout the country and that there weren’t just hot spots; it really indicated that this was a major national issue," said Dr. Miller. “The first week of the survey, almost 90% of the laboratories that responded reported a shortage of tests for STI’s.”Dr. Miller has a leadership role within ASM and has also been experiencing shortages in the lab firsthand."It’s a guessing game. Many times we don’t know when the next shipment is coming for some of the items we’re short on," said Dr. Miller. Since September, 134 CLIA-certified labs have responded to the survey, which is updated every week. Dr. Miller says the figure for STI testing supplies has improved but is still too high around 50%. And she says 47% of labs have a shortage of non-COVID-19 testing supplies to detect routine bacteria, including the bacteria that cause strep throat, pneumonia, bronchitis, and urinary tract infections."Since June, I have been worried about this exact moment," said Dr. Miller. “You have the COVID surge, the upcoming holidays, and the winter season, and you have respiratory season."The survey also showed 74% of labs have a shortage of commercial testing kits for COVID-19.She says the hope is to include more labs in the weekly survey to get a clearer picture of the supply chain issues.“Data is power; we need the data that this is a problem. And getting some federal action on this, I think, is critical," said Dr. Miller. (KGTV) — Shortly after the De Luz Fire ignited on Camp Pendleton Wednesday, an unnamed Gunnery Sergeant jumped into action to evacuate more than 70 students.The brush fire broke out on base just after 12 p.m., prompting several precautionary evacuations of nearby structures, including schools, businesses, and hundreds of homes in the DeLuz Housing area.While there were no students or staff at Mary Fay Elementary School at the time of the fire, the base says, there were 73 students at the nearby Child Development Center that needed to be evacuated.An unnamed Gunnery Sgt. with the Provost Marshall’s Office commandeered a city transit bus to evacuate the children and residents, the base said. Emergency Services Battalion police and fire crews, along with NCIS agents, also helped transfer each student to the evacuation point to be reunited with their families."This Gunnery Sgt. exhibited but one example of the brave, fast-thinking actions that were taken this day," a release from Camp Pendleton officials said.Within three hours of sparking, the De Luz Fire was largely stamped out by firefighters as high temperatures brought an elevated threat of wildfires to the county on Wednesday."Their quick and heavy response, deploying all available units and requesting aid from CAL FIRE/San Diego County Fire Authority, allowed for residents to return to their homes within four hours after evacuating," the release added.The only loss from the fire was an NCIS government vehicle, according to officials.
