SAN DIEGO — SAN DIEGO (KGTV) -- A life science development firm has unveiled plans to transform eight acres along San Diego's waterfront into a mixed-use hub that could attract numerous leading edge companies to the city.Development firm IQHQ announced Monday that it closed on the site along Harbor Drive and will break ground on the project's first phase this week. The firm says it has entitlements and key permits for new office, lab and support retail space for the complex, called the San Diego Research and Development District, or RaDD. In a news release, the firm said this would be the largest urban commercial waterfront site along the Pacific Coast. The development is sure to bolster an already vibrant life sciences industry in San Diego, with biotechs clustered mostly in the Torrey Pines area. This could attract more to relocate downtown. The project would be the third major commercial development in downtown, along with the Padres plan to build office space at Tailgate Park, and the redevelopment of Horton Plaza into a tech hub."This is probably, in terms of the commercial sector, the most important pivotal moment in San Diego's modern redevelopment history," said Gary London, of commercial real estate consulting firm London Moeder Advisors.IQHQ chief executive Stephen Rosetta told ABC-10News this was the premier site to build on the west coast, if not the entire USA. "This project is really special to us because we're headquartered here in San Diego, and the partners live locally and have for most of our lives," he siad. IQHQ bought the property from Manchester Financial Group for undisclosed terms. Manchester Financial recently completed the new U.S. Navy Headquarters, on the north end of the site, with move-ins scheduled for October. SAN DIEGO (AP) — Combat veterans from the Navy and Marines were among possible jurors Monday in the trial of a decorated Navy SEAL charged with killing an Islamic State prisoner in his care in Iraq.All but one of the potential jurors in the court-martial of Special Operations Chief Edward Gallagher had served in a combat zone and all but two were veterans of conflicts in Afghanistan and Iraq.The trial of Gallagher follows months of turmoil in one of the Navy's most prominent war crimes cases.The lead prosecutor was removed from the case earlier this month for tracking the defense team's emails and President Donald Trump has suggested he may pardon Gallagher.Gallagher has pleaded not guilty to premeditated murder in the killing of the prisoner in his care and attempted murder in the shootings of two civilians in Iraq in 2017. Gallagher says disgruntled platoon mates fabricated the allegations because they didn't like his tough leadership.The seven Marines and five sailors were seated in the jury box, given copies of the charges and asked a series of questions about the case.Each said they thought it possible that Navy SEALs could lie and that they could turn in a comrade on false allegations.They also said they could convict someone in the killing of a member of the Islamic State and in the case where no body was recovered. The prisoner's corpse was never found.If Gallagher is convicted, the panelists said they would consider post-traumatic stress disorder and traumatic brain injury at sentencing, if relevant, along with his military record.Five said they had personally faced the enemy and five had experience with detainees. Eight had lost friends or shipmates in combat.Defense lawyers unsuccessfully sought to have a Navy judge dismiss the case because they say investigators and prosecutors withheld evidence that could help Gallagher and violated his rights to a fair trial by embedding tracking software in emails sent to them.The judge, Capt. Aaron Rugh, refused to dismiss the case, but took steps to make sure Gallagher gets a fair trial and remedy violations of his constitutional right against illegal searches and the right to counsel.Rugh released Gallagher from custody, removed the lead prosecutor and reduced the maximum penalty he faces if convicted to life imprisonment with parole — instead of no chance of parole.Evidence at hearings last month showed an intelligence specialist from Naval Criminal Investigative Service conducted criminal background checks on three of Gallagher's civilian lawyers and a Navy Times journalist who has broken several stories based on documents that are only to be shared among lawyers in the case.Prosecutors downplayed the effort to find the source of news leaks, saying it only gathered data, such as internet protocol addresses, and did not snoop on the content of emails. The government said the investigation did not find who leaked the documents.Gallagher's family maintains he cannot get a fair trial."The court's ruling, recognizing a direct violation of Chief Gallagher's constitutional rights but not dismissing the case, sends a chilling message to every man and woman in uniform," his family said in a statement.The prosecution also tracked emails of the lawyers of Gallagher's commanding officer, Lt. SAN DIEGO (AP) — A son of one of the founders of the Sinaloa drug cartel has appeared in a U.S. court on trafficking and other charges after he was extradited from Mexico. A lawyer for Ismael "El Mayito Gordo" Zambada-Imperial says he pleaded not guilty to the charges in the federal court in San Diego and his next court hearing is scheduled for Feb. 7. Zambada-Imperial is accused of smuggling large quantities of cocaine and marijuana from Mexico to the United States, as well as the laundering of profits from the illegal drug trade. SAN DIEGO (CNS) - A 20-year-old man who pleaded guilty to a voluntary manslaughter charge for last year's fatal beating of a 56-year-old man near a pedestrian bridge behind Petco Park was sentenced Friday to six years in state prison.Dominick Wells admitted his role in the Nov. 18, 2018, beating of Edward Starlard, who was left comatose as a result of the attack by Wells and a group of juveniles.Three of the juveniles involved were also charged in juvenile court, with at least two of the minors pleading guilty so far, according to prosecutors.Witnesses said Starlard had been fighting with a group of young people the afternoon of Nov. 18 when he was thrown down and beaten unconscious, suffering injuries that included fractures to his face and ribs. When witnesses started yelling at the attackers to stop, they fled east on Imperial Avenue, police said.Starlard was placed on life support and never regained consciousness. He died Dec. 3 at Scripps Mercy Hospital.A cell phone video recorded by a bystander captures Starlard, Wells and the juveniles exchanging words, none of which can be heard in the video. At some point, both men grab objects to seemingly defend themselves. Wells picks up a broomstick, while Starlard lifts a bicycle over his head.Starland later tosses the bike to the ground, and is then knocked down to the sidewalk by Wells and the juveniles, who begin punching and kicking him.A medical examiner testified that Starlard's death was the result of a heart attack, which could have been caused by stress or trauma from the fight.Prosecutor Mary Loeb asked San Diego County Superior Court Judge Amalia L. Meza to impose the maximum possible term of 11 years, stating that Wells had multiple opportunities to withdraw from the altercation, but chose instead to attack Starlard even after he put the bike down, then beat him while he was helpless on the ground.She also said that while both men bore responsibility for their roles in the argument, Wells landed the first blow, and only stopped when bystanders intervened."There was no indication that this was going to stop except for people running across the street, seeing what was happening and yelling at the defendant and his friends to stop," Loeb said, which highlighted "the viciousness of this attack."Wells' attorney, Stewart Dadmun, said his client rightfully defended himself against Starlard, who was attacking him, but was guilty of manslaughter for responding with excessive force.Dadmun said the altercation was sparked by Starlard making a lewd comment toward one of Wells' friends, a 14-year-old girl, then threatened to attack Wells and the teens.The attorney said that while the prosecutor noted Wells could have walked away, "It's also worth pointing out that a 56-year-old man could have walked away."Dadmun also noted Wells' young age and lack of prior criminal record in asking for a three-year prison term.Meza said she understood both men played a role in the fight, but said Wells responded with force that was "excessive, brutal and unnecessary when the victim was trying to retreat," and imposed the mid-term of six years.Wells was previously charged with murder in the attack, but that charge was dismissed when he entered his guilty plea in September. He was also previously charged with torture for beating Starlard after he'd been knocked to the ground, but a judge dismissed that count at Wells' preliminary hearing. 3437
