SAN DIEGO (AP) — Combat veterans from the Navy and Marines were among possible jurors Monday in the trial of a decorated Navy SEAL charged with killing an Islamic State prisoner in his care in Iraq.All but one of the potential jurors in the court-martial of Special Operations Chief Edward Gallagher had served in a combat zone and all but two were veterans of conflicts in Afghanistan and Iraq.The trial of Gallagher follows months of turmoil in one of the Navy's most prominent war crimes cases.The lead prosecutor was removed from the case earlier this month for tracking the defense team's emails and President Donald Trump has suggested he may pardon Gallagher.Gallagher has pleaded not guilty to premeditated murder in the killing of the prisoner in his care and attempted murder in the shootings of two civilians in Iraq in 2017. Gallagher says disgruntled platoon mates fabricated the allegations because they didn't like his tough leadership.The seven Marines and five sailors were seated in the jury box, given copies of the charges and asked a series of questions about the case.Each said they thought it possible that Navy SEALs could lie and that they could turn in a comrade on false allegations.They also said they could convict someone in the killing of a member of the Islamic State and in the case where no body was recovered. The prisoner's corpse was never found.If Gallagher is convicted, the panelists said they would consider post-traumatic stress disorder and traumatic brain injury at sentencing, if relevant, along with his military record.Five said they had personally faced the enemy and five had experience with detainees. Eight had lost friends or shipmates in combat.Defense lawyers unsuccessfully sought to have a Navy judge dismiss the case because they say investigators and prosecutors withheld evidence that could help Gallagher and violated his rights to a fair trial by embedding tracking software in emails sent to them.The judge, Capt. Aaron Rugh, refused to dismiss the case, but took steps to make sure Gallagher gets a fair trial and remedy violations of his constitutional right against illegal searches and the right to counsel.Rugh released Gallagher from custody, removed the lead prosecutor and reduced the maximum penalty he faces if convicted to life imprisonment with parole — instead of no chance of parole.Evidence at hearings last month showed an intelligence specialist from Naval Criminal Investigative Service conducted criminal background checks on three of Gallagher's civilian lawyers and a Navy Times journalist who has broken several stories based on documents that are only to be shared among lawyers in the case.Prosecutors downplayed the effort to find the source of news leaks, saying it only gathered data, such as internet protocol addresses, and did not snoop on the content of emails. The government said the investigation did not find who leaked the documents.Gallagher's family maintains he cannot get a fair trial."The court's ruling, recognizing a direct violation of Chief Gallagher's constitutional rights but not dismissing the case, sends a chilling message to every man and woman in uniform," his family said in a statement.The prosecution also tracked emails of the lawyers of Gallagher's commanding officer, Lt. Jacob Portier, who faces charges of conduct unbecoming an officer after being accused of conducting Gallagher's re-enlistment ceremony next to the Islamic State militant's corpse.The defense discovered the tracking code hidden in a suspicious logo of an American flag with a bald eagle perched on the scales of justice beneath the signature of lead prosecutor Cmdr. Christopher Czaplak.Rugh removed Czaplak from the case because he said the potential for an investigation into his actions could present a conflict. He said it was not within his power to determine whether Czaplak engaged in misconduct.The judge said the effort also harmed the public's perception of the military justice system, which has been criticized for being ineffective and has gained few war crime convictions.Republicans in Congress have lobbied for Gallagher, claiming he's an innocent war hero being unfairly prosecuted. Trump, who intervened to move Gallagher to less restrictive confinement in March, said last month he is considering a pardon for several American military members accused of war crimes. 4385

SAN DIEGO (CNS) -- A 76-year-old woman who died on May 24 is the first local fatality of e-cigarette or vaping-associated lung injury, the San Diego County Health and Human Services Agency announced Thursday.Three vaping-associated lung injuries in young adults were confirmed in recent weeks and are the first reports of the lung illness in San Diego County since 2019.All the newly reported local cases tested negative for the novel coronavirus, which causes COVID-19, and all reported recently vaping products containing THC.The California Department of Public Health recently recognized new reports of confirmed lung-injury cases in persons vaping THC-containing products in April, after no cases had been reported since February.Since July 2019, a total of 52 EVALI cases have been reported in San Diego County residents. All patients had to be hospitalized."While our community is understandably focused on COVID-19, it is important to remember that lung injury from vaping is still a major public health concern," said Dr. Wilma Wooten, county public health officer. "People who vape, especially those using THC-containing products, are urged to stop."In January, the San Diego County Board of Supervisors voted to restrict the sale of flavored smoking products and e-cigarette and vaping devices in the county's unincorporated areas. These restrictions were proposed as a response to the e-cigarette- or vaping-associated lung injury cases in the county and across the country. Enforcement of these restrictions will begin July 1.THC-containing e-cigarette or vaping products, particularly obtained from informal sources, are linked to most e-cigarette or vaping, lung injury cases. Vitamin E acetate has also been strongly linked to the outbreak and has been found in product samples from patients and in patient lung fluid samples.The Centers for Disease Control and Prevention recommends that people not use THC-containing e-cigarettes or vaping products obtained from informal sources such as friends, family, pop-up shops or online sellers. SAN DIEGO (AP) — More than 30 migrants have tested positive for influenza at a major processing center where a flu-stricken teenage boy died, the latest evidence of growing public health threats posed by inadequate facilities to deal with a surge of families and children reaching the U.S. border.It was unclear if anyone ill came in contact with a 16-year-old Guatemalan boy who was held at the facility in McAllen, Texas, and died Monday, a day after he was diagnosed and transferred to a smaller station. Carlos Hernandez Vasquez was detained for six days, twice as long as generally allowed by U.S. law.The processing center is a converted warehouse that holds hundreds of parents and children in large, fenced-in pens that gained international attention last year when it held children separated from their parents. The government closed the facility after the flu outbreak, sent in cleaning crews to disinfect the building and plans to reopen it soon.RELATED: Border officials say migrants from Texas being transferred to San DiegoThe 32 sick children and adults have been quarantined at a smaller processing center, according to a U.S. Border Patrol official who spoke with reporters on condition of anonymity because there is an ongoing investigation. Their ages were unknown.Since December, five children have died after being apprehended by border agents, putting authorities under growing pressure and scrutiny to care for migrant children. Kevin McAleenan, the acting Homeland Security secretary, came under withering criticism Wednesday from a Democratic lawmaker who called the administration's actions with children "inhumane."The Department of Health and Human Services, which cares for unaccompanied migrant children, said Wednesday that a 10-year-old girl from El Salvador died last year after being detained by border authorities in a previously unreported case. It will loan tents to the Department of Homeland Security, which will manage the camps.The Defense Department will evaluate six potential sites over the next two weeks: Tucson and Yuma in Arizona and Tornillo, Donna, Laredo and Del Rio in Texas. Tornillo, near El Paso, is where unaccompanied children were housed last year.The Pentagon said military personnel will only erect the tents and won't be involved in operations.The 77,000-square foot (7,155-sq. meter) processing center in McAllen is modeled after a similar facility in Nogales, Arizona, built for an influx of Central Americans in 2014. It has separate pods for boys and girls who came alone and parents with their young children.Some older children are split from their parents to avoid having them mix with much younger children.Texas's Rio Grande Valley, which includes McAllen, is the busiest corridor for illegal crossings. The Border Patrol made 36,681 arrests in the area in April, nearly three of every four coming in family units or as children traveling alone.Border Patrol agents have averaged 69 trips to the hospital a day since Dec. 22 and about 153,000 hours monitoring detained population at hospitals, the official said.Authorities have also cleaned other holding facilities in South Texas, including Brownsville, Corpus Christi, Kingsville and highway checkpoints.Migrants are not being vaccinated at Border Patrol stations, but they may be when hospitalized, the official said. The Border Patrol is offering vaccines to agents working.A previous headline indicated the border center was located in San Diego. This is not the case. SAN DIEGO (CNS) - A 40-year-old man was shot and wounded while riding his bicycle early Saturday morning in Logan Heights.The shooting was reported at 1:20 a.m. in the 2900 block of Marcy Avenue, said San Diego police Sgt. Michael Tansey.The victim was riding his bicycle on the sidewalk westbound on Marcy Avenue when someone inside a black Jeep Cherokee that was parked along the north side of the street exited the passenger side and fired several rounds at the victim, Tansey said.The bicyclist was struck twice by the gunfire and fled on his bicycle. He rode into a fast food restaurant in the area of 29th Street and National Avenue, where he was taken to a hospital for treatment of non-life-threatening wounds, Tansey said.The victim sustained a gunshot wound to his buttocks and left lower leg, Tansey said.The gunman was described as Hispanic, in is mid 20s, wearing a black shirt and dark pants, according to Tansey. 935
