A Florida representative's aide lost his job Tuesday after sending an email to a reporter falsely alleging that two students who survived the Florida school shooting -- and were speaking out on TV -- are "actors."Benjamin Kelly, who worked as district secretary for Florida State Representative Shawn Harrison, emailed a Tampa Bay Times journalist with a message that read: "Both kids in the picture are not students here but actors that travel to various crisis when they happen."Several Marjory Stoneman Douglas High School students who have advocated for stricter gun laws, have become the subject of conspiracy theories and smear campaigns.  658

A judge ruled Tuesday the City of Omaha must release a video showing the death of a TV crewman during a shootout at Wendy's in 2014.Bryce Dion, a sound mixer on a shoot at a Wendy's in Omaha for the reality TV show "Cops," was shot and killed Aug. 26, 2014, after Omaha Police returned fire on a man who shot a pellet gun at officers. Officers were called to the restaurant on a report of a robbery.In the video, someone could be heard repeatedly asking, "Bryce, are you alright?" He can be seen slumped against a glass wall in the vestibule of the restaurant.Dion was wearing a bulletproof vest, but was hit with a bullet under his armpit. The suspect, Cortez Washington, who was using an airsoft pellet gun, was also killed.In 2016, Dion's brother, Trevor Dion, filed a wrongful death lawsuit against the city, which had asked a Douglas County District judge to bar the release of the video, according to the Omaha World-Herald. The lawsuit says Dion was doing as instructed when he was hit by gunfire from an Omaha police officer.“Bryce positioned himself where told, when told, and acted in accord with police officer instructions. The perpetrator drew what appeared to be a pistol, but proved to be a pellet gun that simulated discharge. Police responded with live rounds of ammunition. They shot and killed the perpetrator. As they did so, they also shot and killed Bryce who was positioned as directed between at least one police officer who arrived at the scene belatedly, other police officers, and the perpetrator.”Brian Jorde, Dion's attorney, says he plans to use the video and other evidence at trial. The proceedings are expected to begin sometime after July."There's approximately 20 bullet holes just near the area of where Mr. Dion was alone so there's a significant amount of gunfire that was exchanged," Jorde said. "We think the public deserves to know what happens when their taxpayer dollars are at work with the police and otherwise. And I think it sheds light on exactly what happened and that Mr. Dion was caught in the line of the crossfire through no fault of his own."Omaha City Attorney Paul Kratz said the city played the video in court Tuesday to support its motion for the case to be dismissed."The city presented the video to the court in support of its motion for summary judgment, and we believe the video will support that motion," Kratz said when reached by phone Tuesday night. 2468

A Georgia high school teacher is under investigation after he was filmed telling a student he "might" shoot the kid in the head.Paul Hagan, a white physics teacher at Rockdale Career Academy, was filmed ranting against an unidentified black student, according to Atlanta's WSB-TV."Don't smile at me, man," Hagan is heard telling the student. "That's how people like you get shot."In the video, which WSB shared on Facebook, Hagan goes on to say, "I gotta bet by the time you're 21 somebody's gonna put a bullet right through your head. OK? And it might be me the one who does it."The video was apparently shot by another student.Officials at Rockdale Career Academy are investigating the incident. A historic bill to legalize marijuana at the federal level is expected to come up for a vote in the House of Representatives in December.This would be the first time a chamber of Congress has ever voted on removing marijuana from the Controlled Substances Act.Cannabis was included as what is called a Schedule I drug under the Controlled Substances Act in 1970. Schedule I drugs are defined as having a high potential for abuse and no medical benefit. Other Schedule I drugs include heroin, LSD, ecstasy and peyote.“I write to share the busy Floor schedule we have for the remainder of the year,” starts a letter from Representative Steny Hoyer, House Majority Leader. “In December … the House will vote on the MORE Act to decriminalize cannabis and expunge convictions for non-violent cannabis offenses that have prevented many Americans from getting jobs, applying for credit and loans, and accessing opportunities that make it possible to get ahead in our economy.”The MORE Act - Marijuana Opportunity Reinvestment and Expungement Act - includes language that would expunge some cannabis records and create grant opportunities for people who have been negatively impacted by the criminalization of marijuana in addition to removing it from its Schedule I classification.The act is sponsored by now-Vice President-elect Kamala Harris, and co-sponsored by seven other representatives including New Jersey Congressman Cory Booker and Massachusetts Congresswoman Elizabeth Warren.Senate Majority Leader Mitch McConnell is opposed to the act, and some say the odds of it passing the senate, even if it passes the House, are very slim.Marijuana is already legal in more than a dozen states, despite the federal designation as a Schedule I drug.Studies show more people support the legalization of marijuana. A 2019 Gallup poll showed majority-support across major political parties for legalizing marijuana. It showed 51% of Republicans, 68% of independents, and 76% of Democrats are in favor of it.During the November election, medical and recreational marijuana use was on the ballot in a handful of states. Four states, Arizona, Montana, New Jersey, and South Dakota, voted to make recreational marijuana use legal in their states. And Mississippi voters approved marijuana for medical use.Even if the MORE Act passes both chambers of Congress, it would not make sales of marijuana legal. Regulation of marijuana would be left to states to decide how to handle it. 2473
