SAN DIEGO (KGTV) — St. Augustine High School, an all-boys Catholic school in North Park, has filed a lawsuit against California Gov. Gavin Newsom and other state officials to allow the school to reopen for in-person instruction.The school says that after holding its summer school and athletic programs in-person for more than 400 students without any reports of COVID-19 cases, they are seeking to stop the state's enforcement against in-person classes during the pandemic this fall."At Saints, we don’t believe remote learning is sufficient to provide a quality education our students are entitled to and our families have come to expect," said Principal James Horne. "We are confident we can open our school safely, consistent with CDC and San Diego County health guidance. We ran a safe and successful summer school program and believe it is an indicator that we can safely return to school in the fall."The school says it adhered to the county's public health guidelines and safety measures during its summer programs, including required to face masks, social distancing requirements, air conditioning systems using UV lights to sanitize the air, and buildings and classrooms being regularly sanitized with an electrostatic disinfecting mist system.St. Augustine also said a distance learning option would still be offered for families who don't want to send their children back to school in-person."After appeals from many families to return to the classroom, Saints is pursuing the best way to offer opportunities that are the right fit for all its students and families," the school said. 1604

SAN DIEGO (KGTV) — Still many unanswered questions after alleged Poway synagogue shooter appeared at his readiness hearing in San Diego Superior Court.The Deputy District Attorney, David Grapilon, said he doesn't know if this will be a death penalty case and can't tell 10News how the 19-year-old legally obtained the gun used during the shooting.In the state case the shooter faces one count of murder, three counts of attempted murder and a count of arson against an Escondido mosque."We have still not received recordings of the witnesses, we expect that there's going to be firearms analysis which will be crucial for this case, we also expect that there's going to be computer evidence involving my client's computer which is going to be very relevant in this case," Public Defender John O'Connell said.The evidence is already extensive, more than 700 pages handed over from the Deputy District Attorney to the defense. More evidence includes surveillance video of the shooting from the time he entered to the time he left the synagogue."The Sheriff's Department did a pretty exhaustive investigation along with the FBI, and allied agencies and there's a lot of statements of witnesses that we're taking," Grapilon said. He added those statements will be redacted when turned over to the defense.While the shooter's family was in federal court two days ago, no one was in the gallery Thursday.10News went to the family's neighborhood to see how they're faring. SAN DIEGO (KGTV) - Saturday a new curfew went into effect for San Diego businesses, in an attempt to slow the sky-rocketing coronavirus cases across the state.Saturday, the county announced 1,478 new coronavirus cases, the highest number in a single day we've seen. San Diego County's total is now 70,709 cases. Six more people have died from the virus, bringing the local death toll to 966.This alarming rise in cases urged California Governor Gavin Newsom to issue a limited stay-at-home order for counties in the purple tier, shutting all businesses down 10 p.m. - 5 a.m. until Dec. 21.That cuts restaurants down about an hour from the way they were operating prior, according to Mike Hess, founder of Mike Hess Brewing."It gets my crew home earlier, it's just another thing to deal with, it's a month maybe it's longer we'll see, we'll keep going," he said.He's not worried so much about the latest change."This has been the year of hits, I mean it's one after another," Hess said he's concerned about winter weather coming."Heaters are in shortage, you know covered space, you know that kind of thing, it's tough to shelter people on a sidewalk," he said.He's also worried about keeping cans in stock, "there's plenty of aluminum there's just a shortage of manufacturers making cans."He said he's thankful for his incredible team who is taking the punches with him."Everybody says pivot I think it's more than pivot, you have to be flexible," he said.Hess said he's thankful his doors are open and business is good, "production is up this year, we're putting everything in cans so that's been good, and our on-site locations have been doing pretty well this year."Hess longs to bring a sense of community back, "I long for those days when people can mingle and say hey! SAN DIEGO (KGTV) — SeaWorld's new dive coaster has shed its "Mako" moniker and will now nod to another of the park's coolest animals.SeaWorld announced Tuesday its dive coaster will be called "Emperor," a nod to Emperor penguins. The name is "a tribute to the Emperor penguins’ journey from chilly, frosted cliffs to their deep dive into the depths of the ocean," the park says.The ride will still be modeled after SeaWorld's other "Mako" coasters, taking riders more than 150 feet high, before sending them into a 143-foot face-down drop and through loops and turns at up to 60 miles per hour.
