KENOSHA — Attorneys representing Kyle Rittenhouse, the teen charged with homicide in the shooting deaths of two protesters and the injuring of a third in Kenosha, says the 17-year-old has been wrongfully charged after "acting in self-defense."According to a news release Friday evening, attorney John Pierce of Pierce Bainbridge announced the firm will be representing Rittenhouse.Pierce argues that Rittenhouse "has suddenly found himself at the center of a national firestorm and charged with murder after defending himself from a relentless, vicious and potentially deadly mob attack in Kenosha, Wisconsin."That’s a far different narrative than what local authorities have publicly stated. The Kenosha police chief called the shootings a senseless act of violence on protesters.On Thursday, Kenosha prosecutors described in a criminal complaint that Rittenhouse shot and killed two protesters and injured a third. The charges against him include one count of first-degree intentional homicide; one count of first-degree reckless homicide; one count of attempted first-degree intentional homicide; and two counts of first-degree reckless endangerment.In the release, Pierce described what the attorneys will be arguing in court on Rittenhouse's behalf.Pierce argues that when Rittenhouse finished his shift as a lifeguard in Kenosha last Tuesday, he decided he wanted to help clean up damage in Kenosha left amid unrest over the police shooting of Jacob Blake.He and a friend went to a local high school to remove graffiti, according to Pierce. Later that day, they received information about a call for help from a local business owner, whose downtown Kenosha auto dealership was largely destroyed, Pierce says. The business owner said he needed help defending his business.So Rittenhouse and his friend armed themselves with rifles and headed to the business. Pierce added that the weapons were in Wisconsin and never crossed state lines.It was a gun Rittenhouse legally couldn’t carry in Wisconsin due to his age.Rittenhouse and others stood guard at a mechanics shop near the car depot, even after the curfew was in effect.Law enforcement soon began to clear Civic Center Park of protesters, pushing many of these people to where Rittenhouse was standing guard, according to his attorneys.They argue that several times, protesters threatened and taunted Rittenhouse, but he never reacted. "His intent was not to incite violence, but simply to deter property damage and use his training to provide first aid to injured community members, according to the attorneys.They argue that Rittenhouse soon became concerned about protesters injured in clashes with police, and went to provide first aid at a gas station. As he was returning to the mechanics shop after providing aid, he found that police formations had blocked his way, so he returned to the station.Attorneys say protesters then began to chase Rittenhouse, still armed with a long rifle, and he attempted to run away. "Upon the sound of a gunshot behind him, Kyle turned and was immediately faced with an attacker lunging towards him and reaching for his rifle. He reacted instantaneously and justifiably with his weapon to protect himself, firing and striking the attacker," according to Pierce.Court records claim one of the victims, Joseph Rosenbaum of Kenosha, threw a plastic bag at Rittenhouse before the teen shot and killed him. Rittenhouse’s attorneys share a different story.Rittenhouse soon found he was facing against a "mob" as people kicked and swung at him, Pierce argues."In fear for his life and concerned the crowd would either continue to shoot at him or even use his own weapon against him, Kyle had no choice but to fire multiple rounds towards his immediate attackers, striking two, including one armed attacker. The rest of the mob began to disperse upon hearing the additional gunshots," according to Pierce.After allegedly shooting three people, two of whom later died, Rittenhouse walked toward police columns with his hands in the air. "The police did not take Kyle into custody at that time, but instead they indicated he should keep moving," according to the attorneys.But the criminal complaint shows that as he was walking away, Rittenhouse called his friend to tell him that he just killed someone.Kenosha Police Chief Daniel Miskinis said Friday that the shootings never should have happened.“We’ve had two people lose their lives senselessly while peacefully protesting,” Chief Miskinis said.TMJ4 News captured video of Rittenhouse holding his hands in the air as he approached police after the shootings, but officers are seen moving past him to tend to the victims. Daly convinced his insurance company to allow a CAT scan. The CAT scan had a shocking result. Daly had a 30-pound tumor in his abdominal cavity."I never drank beer,” he told WCBS. “Don’t like it, always been athletic, never had a belly.”Daly had the tumor surgically removed, but the procedure was lengthy, lasting six hours. According to WCBS, the tumor was a low-grade, fatty cancer that had wrapped around an organ. Daly's doctor said that a kidney also had to be removed to ensure the tumor was completely removed. Because the tumor was slow growing, he will not need any sort of radiation or chemotherapy treatment. Daly will continue to be monitored with MRIs as a precautiion.  1035

KANSAS CITY, Mo. — For the Guidino family, the work at their mechanic shop is nonstop.Deyanira Gudino's father works to fix engines, mirrors, replace tires, and other parts to make sure it's the right fit for customers' cars.But there was something bigger in their lives stalling."It's something we've been waiting for for years and it's something we wanted ever since we arrived in the United States," Deyanira Gudino said.At nearly two years old, Deyanira and her parents moved from Mexico City to Kansas City."I’ve always said I love my country (Mexico) but thanks to God, this country has given me the opportunity to give my children a place and give them a chance to go to school," Deyanira Gudino's mother, Azucena Cruz said. "Something we couldn’t do in our country.”The transition wasn't easy and oftentimes scary.“It’s very difficult because when she (Deya) arrived here, she was going to turn two years old and when I had to work, I had to leave her," Cruz said. "I remember I enrolled her in an army nursery where she could stay all day."Deyanira said the hardest part was feeling safe. Her parents would stay in much of the time unless it was a necessity to go out."We would go wherever we needed to go but we would never travel the U.S.," she said. "We would never do any of that exploring stuff because they were always in fear that something could go wrong."The language was also a barrier."We had no clue how to communicate with anyone here. And it was very difficult for me to learn once I started school because at home, all we spoke was Spanish," Deyanira said. "The little bit of English I knew, I had to help my parents translate, even just going to the store, finding something, anything that my parents had to speak English for. I had to use my little bit of language that I knew to translate for them. So it was really difficult for all of us, but eventually, I started learning a lot more English. And they got used to being here, so they adapted to the language a little so they started understanding the basic words in English."For roughly 10 years, they've been working on becoming permanent residents, and recently Deyanira received the phone call they'd been waiting for."We were just so happy and full of emotions whenever we received the call saying that we were residents," she said.But it wasn't her parents who heard the news first."I was the one that actually got the call and I just wanted to find a nice way to surprise them," she said.And she did. She and her younger sister, Carmen, had gifts waiting for their parents, recording their reaction when they found out they were now residents of the United States:"It was really exciting for all of us and I was just full of emotions," Deyanira said."We were at a party and my daughter was reading me the comments," Cruz said. "I cried all day, knowing that so many people were sending us blessings, that they wished us the best.”For Deyanira, it's a moment of resiliency and perseverance."I really fought for everything that I have now, so I know now that I have my residency nothing else is really going to stop me," she said.And it's not just for her, but her parents."They sacrifice so much leaving their country to give me a better future," Deyanira said. "I definitely have done everything I have done for them because I know that it's all they wanted to see me succeed."And that's still the case.“Well very emotional, happy, more than anything for my family. Well because it’s 20 years that we can’t see our family. That my daughter (Deya) more than anything didn’t have the opportunities that citizens have, that people who with documentation have," Cruz said.The biggest message they have for others? Keep going."Don’t give up. It is possible for things to be done if someone comes to country and they come to do them right," Cruz said."Don't stop fighting," Deyanira said. (KGTV) - A Jamul couple made a heartbreaking return to what remains left of their home, destroyed by the Valley Fire.Late Saturday afternoon, Irving and Anita Beeman shot cellphone video from the back yard of their home on West Boundary Truck Trail."The smoke blowing straight above our our house, so I knew we were in big trouble," said Irving Beeman.The fire seemed a good four to five miles away, but that changed quickly."In about 15 seconds, it went over a quarter mile ... The flames were between 100 and 200 feet tall," said Irving.Irving scrambled to a ridge and peered over."Looked like waterfall of fire from the top of the ridge to the bottom of the valley. A wind vortex or something took it straight down to valley floor," said Irving.Anita left first, while Irving left in another vehicle soon after. The couple only had time to load up what amounted to a truck bed of belongings. A photo taken by Irving shows his property, as it began burning."We watched it catch fire and then tore out of there," said Irving.The next day, the couple got back to their property, and their fears were realized. Their home of 20 years was no more. One of their trucks and their son's van were destroyed."Just devastating. Still had been holding out hope," said Anita.Buried under the remains of their home, were boxes containing the ashes of Anita's parents. In the rush, it didn't get packed."In the middle of night, you think of things that are gone, things you couldn’t save," said Anita."I would wake up and saw her crying. Just hugged her. Not much you can say. Just hug each other," said Irving.They'll continue to lean on each other, as they begin their long road to recovery."It'll be real tough to rebuild, but we’re going to," said Anita."We’re very grateful we’re alive and have a chance to rebuild," said Irving.The couple's home was insured.
