SAN DIEGO (KGTV) — The California Department of Corrections and Rehabilitation said up to 8,000 inmates statewide could be released early in order to stop the spread of coronavirus within prisons, and the San Diego District Attorney Summer Stephan is now working to alert victims and families as people are released.“Those are people that cause a public safety risk and a real concern for us,” said Stephan.One known inmate being released in the next week is David Herbert, an Oceanside man who was convicted of torturing and killing dogs. He was sentenced to nine years in 2019 but has served a fraction of that. Now, Michelle Plaketta, whose dog was killed by Herbert, is worried about the safety of her family.RELATED: Oceanside man who tortured neighbors' dogs may be released early due to COVID-19“The system is basically failing us as victims to allow him to be released on such a short time,” Plaketta said.Stephan said at the end of July, about 300 inmates from San Diego County who had committed lower-level crimes were released early and returned back to society. In that group was Martin Alvarez, the man suspected of stabbing another man to death in a Pacific Beach bathroom in August. Now, the DA’s office will get five days notice before inmates are released, giving them time to reach out to victims and survivors with an emergency team that was created for this purpose.“What do you need from us? Do you need us to help you with a restraining order? Do you need us to help you relocate?” Stephan said, referring to questions they ask victims and survivors.The San Diego District Attorney’s office has so far received notice that another 221 inmates could be released early, but this time it’s for different types of crimes, putting Stephan on alert.“They are serving life in prison for a murder or something like and now that timeline that the victim counted on through a justice system is shortened,” said Stephen.The CDCR’s website outlines the eligibility requirements for early release.People can be released if they have less than 180 days left on their sentence, are not currently serving for domestic violence or a violent crime, have no current or prior sentences that require them to register as a sex offender and finally do not have an assessment score that indicates a high risk for violence.People can be released if they have 365 days or less on their sentence, are not currently serving for domestic violence or a violent crime, have no current or prior sentences that require them to register as a sex offender and finally do not have an assessment score that indicates a high risk for violence.People who are deemed “high risk” for COVID-19 can be released early. SAN DIEGO (KGTV) -- The brother-in-law of a woman killed in a murder-suicide in Paradise Hills spoke to 10News about her relationship with the father of her young sons.On the morning of Nov. 16, 29-year-old Sabrina Rosario and her four sons were shot by the boys' father in a home on Flintridge Drive, according to San Diego police.Rosario and three of her sons died, and the boys' father -- identified as 31-year-old Jose Valdivia -- shot himself to death after killing the family members.As of Sunday afternoon, Rosario's 9-year-old son, Ezequiel, was in an induced coma at Rady Children's Hospital.RELATED: Parents, 3 children killed in Paradise Hills murder-suicideKarl Albright, Rosario's brother-in-law, told 10News, "No one thinks it's going to happen until it's happened."Albright said he has so many questions about what led Valdivia to gun down his wife and children. "He wanted it back. And he tried to, the love way, and then he tried the fear way, and he tried every way in between to try to break through, but she stood her ground."Albright said Valdivia's threatening texts and stalker behavior escalated six months ago when he bragged about purchasing a gun.Albright explained Valdivia would tell Rosario, "I'm going to come over and kill myself in front of you guys. I'm going to kill you guys, then kill myself."Rosario told him that he sounded like the boy who cried wolf, according to Albright.A records search shows two cases of domestic violence in 2019. On Nov. 15, police said Rosario spent the whole day at court obtaining a restraining order against her husband.When he called that night, she told him she had no other choice. He never called back.Albright said she told him that their problems would be solved, and her children would be safe."Even what they were living in, and what she was going through in the house, she had an umbrella over the kids, and it never fazed them," Albright said.Instead, the next morning, police said the children's father came into the granny flat on Flintridge Drive and shot his wife and four children in the head before shooting himself.Rosario and 3-year-old Enzi died at the home. Five-year-old Zuriel, 9-year-old Ezequiel, and 11-year-old Zeth were rushed to the hospital. Zuriel and Zeth did not make it.Life will never be the same for relatives who live next door."Now that Thanksgiving is coming up and Christmas. SAN DIEGO (KGTV) — The future of Horton Plaza was teased in a new set of renderings released by the firm that purchased the aging mall.Stockdale Capital Partners purchased Horton Plaza in June 2018 with the aim of revitalizing the center into a mixed-use high-tech office and retail space. Wednesday, the firm gave a glimpse at The Campus at Horton, showing a completely transformed Nordstrom building from a concrete facade into a glass-covered office space. SAN DIEGO (KGTV) - The family of a man killed in 2013 is pleading with the community for new leads as the case has now been left unsolved for more than half a decade.Ralph Green was killed on October 20, 2013.  He was murdered on Jewell Street in the Mountain View neighborhood, on the porch of his daughter’s home while at her 32nd birthday party.His daughter, Chanel Green, says the shooting happened suddenly, catching everyone by surprise.“My mother was on her way outside, so it was a blessing I didn't lose both my parents that day,” Chanel said. “I remember (my mother) shrieking, ‘oh my god, Ralph’s been shot.’ And I ran to the door to see my dad walk holding his neck.”Green says he was shot three times, once through this throat.“My brother catches him, and I moved my brother out of the way, and I laid (my father) down on the ground, and I start screaming, “oh my god, my dad’s been shot, call the police,’” she said. “My dad bled out on the floor, and all I could hope was that he heard me when I told him I loved him.” Channel’s aunt, Jennetta Pierce, was also shot.  Pierce is Ralph’s cousin-in-law.Pierce says she was inside the house, by the window, when the bullets started flying. One of them hit her on the lower back.“I got hit, but I didn’t let anyone know I got hit because my kids were there, and I just told them to get up under the table,” Pierce recalled.  After that, emergency crews came inside the house and took her to the hospital, where she spent two weeks.  She says she spent the next five years focused on moving forward.Police have said the shooting was random.  Chanel says there have been tips, and potentially leads given to the police but none have panned out.  But she’s convinced that there are people out there that know something, that can give her and her family the closure they need.“For anybody who knows somebody that knows something to come forward, now is the time, to tell the truth,” Chanel said. Anyone with information can contact San Diego Police or Crime Stoppers at 888-580-8477. 2087
