While many Americans do it, taking a selfie with a completed ballot is considered a crime in many states.For much of American history, ballots were intended to be secret. But as social media usage has exploded, more and more Americans are taking pictures with their ballots, and or at polling places. Most of these photos are harmless, but that doesn’t mean they’re fully legal in some states.In response, seveal states have changed their laws regarding ballot selfies.According to the National Conference of State Legislatures, California, Colorado, Hawaii, Nebraska, Oklahoma, Oregon and Utah have made changes to their laws in the last five years which allow some form of ballot selfies.Other states, however, have tried to curtail ballot selfies. For instance, Alabama passed a law last year that prohibits taking a photograph of a ballot, or otherwise revealing the contents of a completed ballot.Another state, New Hampshire, attempted to pass a law to restrict ballot selfies.However, a federal appeals court ruled 3-0 that the state had not shown that it was using the least restrictive means to achieve a compelling state interest of prohibiting voting fraud. According to the ruling, New Hampshire Secretary of State William Gardner was unable to show examples of how ballot photography led to voting fraud."The restriction affects voters who are engaged in core political speech, an area highly protected by the First Amendment," the ruling states. "There is an increased use of social media and ballot selfies in particular in service of political speech by voters. A ban on ballot selfies would suppress a large swath of political speech."Indiana also had a law passed in 2015 that would have made ballot selfies a felony struck down by a federal judge.In Colorado, the state made it legal in 2017 to take ballot pictures.Nationally, laws vary from state to state. WINDSOR, Ontario — Caesars Windsor Hotel and Casino is temporarily closed due to a labor dispute with a local union.According to the company's website, the closure is the result of a labor disruption. A message on the site says, "At this time, hotel reservations booked between Friday, April 6 until Thursday, April 12 have been canceled."The Unifor Local 444 Facebook page says there was a tentative deal in place as of April 3 but that fell through.On Thursday night, only 41 percent of union members voted in favor of the new deal, which caused the strike. The 444 handles everything from janitors and food/waitstaff to hotel clerks.The casino says that Friday’s Johnny Reid concert has been postponed. Ticketholders can use their tickets when the show is rescheduled, or get a refund. However, tickets purchased at the Caesars box office will not be refunded until it reopens following the labor dispute. Right now, the casino says all other shows are scheduled until further notice.It's not clear how long the employee strike will last. While there are still questions about whether trick-or-treating will happen in 2020 and how neighborhoods will make it possible, there is no question Americans like their Halloween candy.Sales of Halloween candy and chocolate at grocery stores are up 17 percent over 2019 so far this season, according to the National Confectioners Association. Total sales, including online purchases, is up 13 percent year-over-year.The National Confectioners Association, NCA, represents manufacturers and suppliers of sweet treats, gum, mints and chocolates.Their research showed chocolate is driving the increase. Halloween chocolate sales are up 25 percent over 2019 so far. The NCA released data over the summer showing chocolate was the treat of choice of Americans during the pandemic, with sales increasing five percent March through August over the same time period in 2019. Sales of premium chocolate during that time was up 12 percent year-over-year. Ferrara Candy, which makes Sweetarts, Nerds, Brach’s Candy Corn, Gobstoppers and more, said Halloween sales bring in about .5 billion in sales. In an interview with Axios, CEO Todd Siwak said their company learned a lot from the drop in sales for Easter. This was also the time many stores were closing because of lockdowns to stop the spread of the coronavirus. Even as shopping has picked up a little, they have made some changes.“As the frequency in-store is reduced by the shopper, so fewer trips but bigger baskets, we wanted to make sure we were there presenting the opportunity to consumers,” Siwak said. He added Ferrara Candy created more individually-wrapped confections and got product to stores earlier to extend the selling season.There are still about three weeks until Halloween, and the industry expects sales to increase. Siwak says about 60 percent of the sales for Halloween candy happen in the last few weeks before the holiday.The NCA data also suggested Americans are getting more excited for Halloween in 2020.
