SAN DIEGO (KGTV) -- Termed-out San Diego City Councilman Scott Sherman is taking aim at what he says is too much outside influence behind the scenes at City Hall.In an interview with ABC 10News, Sherman said too many of his colleagues vote based on their own political preservation."Unfortunately, too many politicians are looking down the road and at what office they are going to run for next," Sherman said. In a recent op-ed, Sherman said in politics he has learned that handshakes and signed memos are worth a "bucket of spit." He said political gadflies, union reps, party reps and political donors are wielding too much power of council members. Sherman believes this is the reason the city still has not come to an agreement on regulating short-term rentals, and is approving labor-friendly development projects."One of the things that bothered me the most in politics is how different special interest groups can literally come down, sit in the front row, and dictate to council members what they will and won't do if they want their support in the future, and unfortunately most of them do," Sherman said. Sherman said he is the exception because he did not base his council career on a run for higher office. He did run for mayor in 2020, losing in the primary. But he said chose to run because of encouragement, and because no other Republican entered the race. Michael Zucchet, who heads the city's Municipal Employees Association, said Sherman and other politicians generally define "special interests" as those that disagree with them. "I wasn't very moved by his comments and they struck me as sour grapes," Zucchet said in an email. "It seems like pure hypocrisy to me. Not to mention baseless, transparent whining."Sherman, who represented the Mission Valley area, is now going back into insurance sales. SAN DIEGO (KGTV) - The coronavirus pandemic has brought the historic Balboa Park Carousel to a halt. Still, it hasn't halted plans to upgrade the 100-year old attraction."We did make lemonade out of lemons here," says John Bolthouse, the Executive Director of the Friends of Balboa Park.The group started a capital campaign fundraiser three years ago, hoping to raise million to overhaul the carousel. When the coronavirus pandemic hit, they saw an opportunity in the closure."We did the best to take advantage of it," Bolthouse says. "People stepped up, and they saw that there was a need and an opportunity to get these things done."A fundraising push brought in 0,000 in 30 days, bringing the total amount raised to .4 million. With the extra cash on hand, the Friends of Balboa Park accelerated the schedule for remaking the ride.They've repainted several of the animals, restoring them to the original design. The group also rewired the entire carousel lighting system. That included changing over every bulb to safer energy-efficient LED bulbs.It also allowed them to bring back some light fixtures that had been removed for safety reasons."100 years ago carousels were burning down due to electrical fires," says Manager Bill Brown. "It's going to be a huge improvement. I think people are going to notice when we reopen."Brown hired a contractor to help with big projects. He also has a team of four people who help work on the carousel every Tuesday.One of the animals that Brown just finished painting is a Golden Retriever, which has a special meaning to one of the donors."We named the dog Goldie George," says Julie Cowan Novak. "Goldie in honor of my three-year-old granddaughter and George in honor of my hundred-year-old uncle."Cowan Novak's family donated ,000 to adopt the animal. She says seeing the work continue has been a silver lining to the Pandemic."I think the carousel is really a balance for what we've all gone through," says Cowan Novak. "It's just sort of a bright light."The Pandemic has also brought some challenges to the ride.The Friends of Balboa Park had to furlough most of their staff from the loss of ride revenue. They've also put bigger plans to revamp the carousel plaza on hold.Bolthouse also says he doesn't know when they'll be able to reopen. Like other theme parks and ride operators, the carousel is still waiting on the state and county to release guidelines for reopening.But, when they get the green light, they plan to have as much of the restoration work as possible finished."We did the best to take advantage of it," Bolthouse says. SAN DIEGO (KGTV) - The man accused of killing a Church’s Chicken employee in Otay Mesa West waived extradition in Tennessee Monday. Investigators and U.S. Marshals tracked down Albert Lee Blake in Memphis last week.Blake was wanted for the murder of Maribel Ibanez and shooting of two other employees at the South San Diego County restaurant earlier this month.According to the Shelby County District Attorney’s office, Blake’s fugitive from justice without a warrant case was dismissed by the judge, which means San Diego authorities will head to Tennessee and pick him up and bring him back to answer to charges in San Diego.RELATED: Suspect in Church's Chicken shooting arrested in MemphisIn addition the murder charge, Blake is also facing two counts of attempted murder, accused of willfully and deliberately shooting Mario Rojas and Humberto Gerardo Cota.According to court documents, Blake has a lengthy criminal history dating back to the 1990s.In 2016, he was charged with counts of manufacturing a controlled substance, possession of marijuana for sale, possession of firearm by a felon and more. He also violated probation earlier this year. SAN DIEGO (KGTV) -- The Carlsbad Police Department released body camera footage Saturday night in response to public concerns over officer misconduct during an incident involving a 27-year-old black man.The June 11 incident gained attention after cell phone video surfaced showing officers using a Taser on the man and pressing his head into the pavement in an attempt to subdue him."A video is circulating showing a police use of force incident from Thursday night. Open lines of communication between the Police Department and the community are more important now than ever," Carlsbad police said in a statement."As with all uses of force, we fully investigate incidents to ensure the officers’ conduct is consistent with the Police Department’s policies," police said.The cell phone video doesn't show the start of the incident. The witness video begins with the man on the ground surrounded by paramedics and two officers lying on top of him.The newly released six-minute body cam video starts from the moment two officers respond to the scene. According to the department's timeline of the incident, officers and paramedics responded to a call at 8:48 p.m. about a man found face down on a sidewalk at Ponto Road and Carlsbad Boulevard."Two officers arrived and found the firefighters evaluating the man, who was now standing," police said.Bodycam footage shows the man talking with paramedics, and the group appears to disperse. With the officers approaching, the paramedics step away from the man. The man tells the paramedics, "I'm not complaining about anything else."The man appears to hear something from the group of paramedics and screams out, "are you mocking me?"A paramedic tells the man, "No, I'm not mocking you at all."One officer says, "Hey, they're just here to help you, man."The man stands face to face with the paramedic telling him, "the way he said it is different from how you said it. Because I understand how the f--- you say it. But what do you mean when you say it?"According to the police timeline, "The man walked quickly toward the medics while continuing to yell profanities. Officers, fearing for the safety of the medics, interceded."The report says, "Officers reached out to the man and told him to stop."A struggle ensues and the body cameras are knocked to the ground leaving only an audio recording of the incident for about two minutes. The officers pick up the cameras and resume video recording the scene about two minutes later.The department juxtaposed three camera angles of the confrontation with the man -- two from officer body cameras, and one that was recorded by an unidentified "resident." The witness video fills in a section of lost body cam footage.Carlsbad police said the investigation is still ongoing and are asking the public who may have witnessed the incident to contact the department at their non-emergency line at 760-931-2197.The man in the video, Marcel Cox-Harshaw, 27, of San Diego, was cited and released for resisting arrest. Police also charged him with being drunk in public. He was not injured, but he continued to shout angrily. Officers asked him to calm down, but he refused to comply and continued shouting.At 9:03 p.m. Officers considered the man detained.A mesh bag called a spit mask was placed on the man’s head to protect the officers and paramedics from coming into contact with droplets coming from the man’s nose and mouth This bag is porous and does not restrict breathing.At this time, paramedics were able to place the man on a gurney, where he continued to yell and struggle.At 9:07 p.m. Paramedics transported the man to a local hospital where he was sedated, assessed and released.The man, 27-year-old Marcel Cox-Harshaw of San Diego, was cited and released for resisting arrest. An additional charge of drunk in public has been presented to the District Attorney's Office. The initial investigation indicates that drugs and or alcohol played a role in the incident.The investigation is still ongoing. We are asking any community members who may have witnessed the incident to call the non-emergency police number at 760-931-2197 to share their accounts.Here are some of the department’s policy that pertain to the incidentOfficers shall use only that amount of force that reasonably appears necessary given the facts and totality of the circumstances known to or perceived by the officer at the time of the event to accomplish a legitimate law enforcement purpose.When determining whether to apply force and evaluating whether an officer has used reasonable force, a number of factors should be taken into consideration, as time and circumstances permit. These factors include but are not limited to:o The apparent immediacy and severity of the threat to officers or others – Mr. Harshaw charged unarmed fire personnel while yelling profanities.o The individual’s apparent ability to understand and comply with officer commands – Mr. Harshaw would not comply with officer commands.o The conduct of the individual being confronted, as reasonably perceived by the officer. Mr. Harshaw was yelling and behaving aggressively toward fire personnel.o Proximity of weapons or dangerous improvised devices. – Officers had no way of knowing what was in Mr. Harshaw’s backpack or baggy pants.o The effects of drugs or alcohol. Mr. Harshaw appeared to be under the influence of drugs and or alcohol.o Whether the person appears to be resisting, attempting to evade arrest by flight, or is attacking the officer. Mr. Harshaw was at no time compliant.The TASER device may be used in any of the following circumstances, when the circumstances perceived by the officer at the time indicate that such application is reasonably necessary to control a person:o The subject is violent or is physically resisting. Mr. Harshaw was physically resistant and behaved aggressively toward fire personnel.o The subject has demonstrated, by words or action, an intention to be violent or to physically resist, and reasonably appears to present the potential to harm officers, him/herself or others. – Mr. Harshaw charged fire personnel, while yelling profanities and he was not compliant with officer commands.Supervisory notification shall be made as soon as practicable following the application of force. A supervisor was immediately called to the scene and an investigation was opened. SAN DIEGO (KGTV) - The City of San Diego said Friday Lime Bike, Bird, Skip Scooters and Lyft had violated its terms of operation in regards to geofencing and other scooter operating restrictions. Geofencing forces riders to slow down to 8 miles per hour in busy areas “like Balboa Park and our boardwalks,” San Diego Mayor Kevin Faulconer wrote on Twitter. Bird had violations in nine different San Diego locations on July 13 and 14. Lyft and Lime Bike had violations in seven areas during that time, city officials said.
