Prosecutors have charged a West Seneca, New York, man with criminally negligent homicide after a dispute over wearing a face covering left an 80-year-old man dead.Donald Lewinski, 65 of West Seneca, was taken into custody Monday following an incident September 26 at Pamp's Red Zone Bar and Grill.According to Erie County District Attorney John Flynn, Lewinski got into a verbal confrontation with Rocco Sapienza - another regular at the bar - after Sapienza noticed Lewinski was not wearing a mask while bringing buckets of beer to a band playing outside.At one point, Flynn said Sapienza got up and confronted Lewinski. That's when Lewinski stood up and pushed Sapienza "hard" with both hands, the D.A. said. Sapienza fell back and hit his head on the ground. Sapienza was taken to Erie County Medical Center in nearby Buffalo, where he was unresponsive for four days. He died on September 30.The cause of death is blunt force trauma to the head, authorities said.The owner of Pamp's Red Zone released this statement:"We are all deeply saddened by the loss of Rocco. He was a part of our Red Zone family and loved by all. Our deepest sympathies go out to Rocco’s family."Lewinski is set to appear in court on Tuesday.A celebration of life for Sapienza will take place Tuesday at 11 a.m. at the Southtown Christian Center. Days after a dad was caught on camera being shot as he shielded his children from gunfire at Bronx car dealership, a family friend says he has lost his job.An innocent bystander, 39-year-old Anthony Jefferson was struck in the right thigh when the shooting erupted Monday, officials said.On a GoFundMe campaign page started Thursday by close friend Serena Wingate, she wrote that Jefferson had lost his job due to the injury and also has to have surgery to remove the bullet.Jefferson's wife, Danica Jefferson, told TMZ that the injury left him temporarily unable to walk. This has resulted in the heroic dad being fired from both of his two jobs as a construction worker and head painter at a maintenance company, TMZ reported.Wingate said she set up the GoFundMe to help the dad with medical bills and help his kids with therapy after the traumatic experience.According the family friend, the father and his three kids were at the dealership shopping for a new vehicle to surprise his wife for her birthday.That's when shots rang out inside the Boston Road business. Three men opened fire on another man, who fired several rounds back, police said.Surveillance video shows the dad diving and huddling over the kids on the floor behind a couch. "It's been a very heavy burden. ... No one wins. No one wins here."The announcement about the decision came Tuesday afternoon, after some downtown Indianapolis businesses boarded up their windows in preparation for potential unrest in the city.Due to the legal processes of a grand jury, Khoury couldn't discuss a lot of the evidence in the case.Dreasjon Reed was shot following a police pursuit on May 6 on Indianapolis' north side. Reed was streaming live on Facebook as he led police on the chase. The stream continued when Reed exited his vehicle near 62nd Street and Michigan Road.IMPD says Reed tried to run and the responding officer, identified as Dejoure Mercer, deployed a taser, striking him. IMPD reports allege that after being struck with the taser, Reed fired a gun and Mercer returned fire, striking him multiple times.Family members have argued that evidence suggests that Reed did not point a weapon at officers, although that evidence has not been shared."I don’t believe there could have been another prosecutor assigned to this case who was as neutral as I am or as objective as I have been over the last five months," Khoury said.
