SANTA ANA (CNS) - A man who drove drunk and veered into oncoming traffic while making a turn, slamming head-on into a minivan and killing a mother of three in Lake Forest, was convicted today of second-degree murder.William Joseph Carroll, 51, of Mission Viejo, had a blood-alcohol level of about 0.23 -- nearly three times the legal limit -- when his Ford F- 250 pickup truck slammed into a Toyota Sienna minivan driven by 36-year-old Ana Martinez about 11:40 p.m. May 7, 2013, Deputy District Attorney Daniel Feldman told jurors during the trial.Martinez, who was driving to work at the time, was "crushed to death" in the crash, Feldman said.The prosecutor said Carroll was making a left turn from El Toro Road to Santa Margarita Parkway in Lake Forest when he veered into oncoming traffic.A witness told investigators that Carroll ran a red light, he said. Witnesses "describe Mr. Carroll's truck like a train out of nowhere," Feldman said, adding that the force of the collision was like "100 mph" when combining the speeds of both vehicles.Carroll's attorney, Sara Ross, told jurors it was " a case of government overreach." Ross acknowledged that Carroll was "responsible for the killing of Ana Martinez, but he's not guilty of murder."Both drivers attempted to avoid each other, she said, adding that the intersection is "a bit confusing." "It's a very confusing road and you're going to need that context to determine whether this was a murder," Ross told jurors.Feldman said Carroll was charged with second-degree murder rather than vehicular manslaughter because when he was convicted of DUI on Sept. 11, 2008, he was warned he would be charged with murder in the event of involvement in a DUI-related death.Carroll faces 15 years to life in prison when he is sentenced Jan. 19. 1797
Say goodbye to another 40 Sears and Kmart stores.Sears Holdings (SHLD), the bankrupt parent company of the two retailers, said Thursday that 11 Kmart locations and 29 Sears stores will close their doors in February 2019 — adding to the nearly 200?locations the company has already said will shut down in coming months.The closures are part of Sears Holdings' efforts to drastically reduce costs and find a viable way forward as it moves through bankruptcy proceedings. The company has?been struggling for several years and is drowning in debt.Liquidation sales at the 40 locations "are expected to begin late next week," the company said.Sears Holdings operated about 1,000 stores as recently as February but has been shuttering underperforming stores. When the company filed for bankruptcy last month, it said it only had about 400 stores that could turn a profit. Now, it's in the process of shedding more dead weight.In its bankruptcy filing, Sears named 142 of its worst-performing stores that would shut down in the coming months. SAN FRANCISCO, Calif. (AP) — Gov. Gavin Newsom says California is turning the corner in its fight against the coronavirus pandemic. He cited a significantly lower number of confirmed new cases as California begins to clear backlogged cases caused by a technical error. Newsom says he's also encouraged by the downward trend in hospitalizations, which have fallen 21% in the past two weeks. Dr. Roger Lewis, director with the Los Angeles County Department of Health Services, says there’s been “a clear decline” in hospitalizations there. SEATTLE (AP) — Cookware and kitchen chain Sur La Table is closing 56 of its 121 stores as it seeks bankruptcy protection, the latest retail casualty of the coronavirus pandemic. The privately-held Seattle-based company says it has agreed to sell its remaining stores to affiliates of Fortress Investment Group following the bankruptcy procedure and store closures. “This sale process will result in a revitalized Sur La Table, positioned to thrive in a post-COVID-19 retail environment," CEO Jason Goldberger said in the press release. "Sur La Table will have a balance sheet and retail footprint optimized to position the Company for a bright future that continues our nearly 50-year tradition of offering high-quality cooking products and experiences to our customers.”The post-sale company will also include its in-person and online cooking classes and its e-commerce business. Sur La's chefs typically teach 60,000 cooking classes a year to more than 700,000 people, the company said.Sur La Table had its start in Seattle's Pike Place Market in 1972. 1062
