VISTA, Calif. (KGTV) — The jury deciding former NFL star Kellen Winslow Jr.'s fate in a rape trial, sent a note to the judge asking two questions. The questions lending a window into what's happening as the jury continues deliberating.10News spoke with Defense Attorney Gretchen Von Helms, to gain insight. On the surface, the questions seem obvious: "The jurors could benefit from an explanation as to what being under oath means. Additionally, how we should follow the law and not what we think the law should mean."RELATED: Kellen Winslow Jr. rape trial: More accusers set to testify"Every fourth-grader knows what under oath is and so also, should we follow the rules? Yes, you're supposed to follow the law," Von Helms said. She said the note made her think the jury was not agreeing, "the jury's trying to be nice here and say there's one person who just doesn't want to follow the rules, that's what it sounds like."The first question, she said, could indicate questions the jurors have, "sometimes police officers have to take an oath to be a police officer and maybe they feel that the police officer didn't do their job and follow up correctly or maybe they feel that their definition of that oath is different from the jurors oath."In regards to the second question, she said "the gut versus law issue, they must follow the law, even if they don't like the defendant, even though some people may not want to convict him because he's a football legacy, you can't do that. You have to look at the evidence and make a determination, is there enough?"RELATED: Accusers set to testify in Kellen Winslow Jr. rape trialVon Helms said the most important take-away from the note and the time spent during deliberations is that it appears the jury is taking the case very seriously. She said the prosecution's job is to lay out the evidence so clearly that the jurors have no doubt on the verdict. She added, the more time they take to come to a decision, the more reasonable doubt there may be.Winslow faces three counts of felony rape, misdemeanors of sexual misconduct among other charges. 2096

WASHINGTON — Ivanka Trump has been deposed by attorneys alleging that President Donald Trump’s 2017 inauguration committee misused donor funds. A new court filing, first reported by CNN Wednesday, notes that Ivanka Trump, the president’s oldest daughter and a senior White House adviser, was interviewed Tuesday by attorneys from the Washington, D.C., attorney general’s office. The office has filed a lawsuit alleging waste of the nonprofit’s funds, accusing the committee of making more than million in improper payments to the president’s Washington, D.C., hotel for event space during the week of the inauguration in 2017.In a Thursday morning tweet, Trump confirmed that she had met with the D.C. attorney general in connection with the investigation. She said she shared an email with investigators in which she asked staff at the hotel to charge a "fair market rate" for hotel rooms."This 'inquiry' is another politically motivated demonstration of vindictiveness & waste of taxpayer dollars," Trump said. 1027

WASHINGTON — President-elect Joe Biden introduced his picks for top health positions in his administration Tuesday, and listed three goals his administration will take to fight the COVID-19 pandemic in his first 100 days. The first of those goals has already been widely reported — Biden says he will ask American to "mask up" for the first 100 days of his administration. He said Tuesday that he will enact mask mandates where he can, like on federal property or on airplanes and other inter-state travel. But he said he's asking the rest of the country to join him in wearing masks even where they are not mandated.Biden also said Tuesday that he hopes to administer 100 million doses of COVID-19 vaccines in his first 100 days. In order to aid his administration in his goal, he says he hopes Congress can pass additional funding that would assist in distribution. Finally, Biden said he hopes to get as many children back into schools for in-person learning as he can within his first 100 days.Biden ended his remarks by reminding Americans that while a vaccine is coming, there are a few difficult months ahead."It's daunting, but I promise we will make progress starting on Day 1 ... we can beat this," Biden said. The health care team assembled by President-elect Joe Biden points to stronger federal management of the nation's COVID-19 response, a leading role for science and an emphasis on fair and equitable distribution of vaccines and treatments. With Monday's announcement of his health secretary and a half dozen other key officials Biden is aiming to leave behind the personal dramas that erupted under President Donald Trump. He hopes to return the federal response to a more methodical approach focused on achieving results by applying scientific knowledge in a transparent and disciplined manner. But Biden doesn't yet have a tested team — just players drafted for key positions. According to the Associated Press, only a few had previously been with Biden's coronavirus advisory board, but the president-elect will need new members to hit the ground running. While Trump has mostly delegated virus response to states, Biden's selection of businessman Jeff Zients signals a stronger federal response in the next administration. Among Zients past credits includes his rescue of the HealthCare.gov website, which had faltered shortly after launching in 2013.Biden also signaled a heavy reliance on scientific experts, particularly with his pick of infectious disease expert Dr. Rochelle Walensky to lead the CDC and the return of Dr. Vivek Murthy as Surgeon General. He's also asked Dr. Anthony Fauci to join his administration as a medical adviser while still stating in his role as the director of the National Institute for Allergies and Infectious Diseases. Finally, Biden announced Tuesday he's creating a COVID-19 Equity Task Force that will work to correct racial and wealth disparities exploited by the pandemic. Leading that panel is Dr. Marcella Nunez-Smith, a associate professor of medicine and epidemiology at Yale. 3047

Walmart just unveiled a new online shop for officially licensed military-branded products. The company said the showcase features about 3,000 items emblazoned with logos from the five branches of the U.S. military -- Army, Air Force, Navy, Marine Corps and Coast Guard. The items include a "Air Force Dad" T-shirt, a Marines dartboard, and a Coast Guard toy helicopter. The Walmart collaboration aims "to build brand awareness and create multiple touch points for Americans to show support to the U.S. Army," according to a statement from Paul Jensen, the U.S. Army's director of trademark licensing.Walmart says each military branch has approved the suppliers, and the licensing deals mean that the military will collect royalty payments on all of the sales. The company says it expects to add more products as additional vendors apply."As a 31-year U.S. Army veteran I'm proud to wear my Army gear, and I'm thrilled that Walmart is providing a way for all of us to shop for officially licensed military merchandise with confidence and convenience," retired Brigadier General Gary Profit, Walmart's senior director of military programs, said in a statement.Walmart says the "showcase builds upon Walmart's already-robust support for veterans," the cornerstone of which is the company's promise to hire 250,000 veterans between 2013 and the end of 2020. Walmart said Friday that it's just 62,000 shy of reaching that goal. 1438

WASHINGTON — The Senate returns to Washington as all eyes are on Republican Sens. Mitt Romney of Utah and Chuck Grassley of Iowa for clues to whether they will support any effort to approve a Supreme Court justice before November's election. President Donald Trump and Majority Leader Mitch McConnell are moving quickly to set up a nominee, confirmation hearings and a vote to replace the late Justice Ruth Bader Ginsburg. Democrats oppose a Trump appointment so close to an election. Trump's Democratic rival, Joe Biden, is urging other Republican senators to join Lisa Murkowski of Alaska and Susan Collins of Maine in opposing a confirmation vote before the race is decided. In an interview on Monday, Trump said he thought that both Murkowski and Collins would be "badly hurt" for choosing not to vote for a Supreme Court justice nominee. The Republican caucus currently holds a 53-47 voting edge in the Senate. With Murkowski and Collins promising not to confirm, the GOP can only afford to lose two more Senate votes and still confirm a Supreme Court justice. Vice President Mike Pence would hold the tiebreaker in the event of a 50-50 vote, and would likely vote to confirm a Trump-appointed justice. 1213
