(KGTV) - Hundreds of active duty service members and family members attended a memorial this Wednesday for a medic who mysteriously died this summer on a Southern California military base.Team 10 investigative reporter Jennifer Kastner first broke the story a few weeks ago when 10News reported that he may have been killed by someone else. It’s been three months since HM3 Michael Vincent de Leon died but investigators still won’t release details on his death. He was a Navy corpsman, which is a medic, stationed at the Twentynine Palms Marine base in San Bernardino County.At the memorial service, rubber duckies were handed out to attendees. Ducks were Michael’s favorite type animal. "Michael was special. He thought that life was water and whatever life would throw at him, he was going to act like the duck and the water would fall right off," says Corpsman Michael Joseph Navarro. “If you needed something, he was there in a heartbeat,” explains former Corpsman Benjamin Clark. He and wife Lisa were some of Michael’s closest friends, yet they're nowhere near understanding his sudden death in August.Clark adds, “To this day, we [still] don't know a whole lot.” “I've been to memorials and I've always seen [them] through the viewfinder. Today, I was front row,” says Jose de Leon, Michael’s father. Jose is a former news photojournalist. He and the rest of the immediate family flew in from Texas for the memorial. 10News spoke with Jose via video chat last month. He had contacted 10News for help after claiming that the military stonewalled him from getting answers about his son's death. 10News learned from a source with close military ties that the Naval Criminal Investigative Service (NCIS) confirmed that Michael's death was being investigated as a homicide. It's a very different story than what the family says they were led to believe in the hours just after the death, when they say the word "suicide" came up from service members on base. After digging for information, Jose says he spoke to a service member who is close to the case. “I begged him, ‘Just tell me, did Michael pull the trigger or did someone else? There was a long pause and [then he said], ‘Mr. de Leon, someone else pulled the trigger,’” he explains.He says other service members who knew Michael said he was shot on base at another corpsman's going-away party in the military housing area. Days went by until, he says, an NCIS agent told him there was, in fact, a shooting on the base at a housing unit and other corpsmen were present.“We're not a vengeful family. [We’re] not vengeful at all, but we do want justice,” Jose tells 10News.This week, NCIS Public Affairs sent 10News the following statement.“Out of respect for the investigative process and to protect witnesses, NCIS does not comment on or confirm details relating to ongoing investigations.” 2882

TUCSON, Arizona — Ballot counting continues across Arizona Friday in a Senate race separated by only a few thousand votes, and less than one percent.With hundreds of thousands of ballots left to be counted, it may be days before Arizonans know whether Republican Martha McSally or Democrat Kyrsten Sinema won the race to replace Jeff Flake in the upper chamber of Congress.But there's one not-unlikely scenario in which Arizonans may be represented by both Congresswomen in the Senate.After John McCain's passing in August, the responsibility fell to Arizona Republican Gov. Doug Ducey to appoint an interim replacement for the beloved senator in Washington. Ducey made a safe choice in former Arizona Sen. Jon Kyl, who retired from office in 2013. Kyl, however, only committed to serve in the role until early January, after which Ducey will once again have to choose a replacement until Arizonans make their choice to fill the seat in a 2020 special election.So who are the potential candidates? There was speculation over the summer that Ducey might appoint his own chief of staff to the role or even Cindy McCain -- the Arizona senator's widow. But should Sinema eek out a win after ballot counting is completed, McSally will be out of a job, having vacated her seat in Congress to campaign.If Ducey decides to appoint McSally, that could leave both candidates serving in the Senate until at least 2020. After that, the Republican appointee will have to decide whether or not to run in the special election.Ducey has left no indication so far about his intentions for the appointment, but McSally's name certainly isn't out of the picture. 1691

Read more about the case in the Team 10 report below. SAN DIEGO (KGTV) - A local doctor is accused of sexually assaulting patients who were under anesthesia. In an exclusive interview, 10News investigative reporter Jennifer Kastner spoke to a former patient who says he was abused. She also sat down with the accused doctor for an interview. The doctor was cleared to return to work and denies any abuse.Edward Braun of Alpine is the former patient. He says he found out when Scripps Mercy Hospital in Hillcrest called him and said that a nurse had reported the allegations. “I’m sad. I can't believe somebody would do this,” Braun tells 10News. Braun details the day he got the life-changing call from Scripps Mercy, notifying him that he may have been sexually assaulted by his anesthesiologist, Dr. Robert Stephens, while Braun was under anesthesia for surgery. “I was stunned. I was shaking,” he adds. “What I was accused of never happened,” Dr. Stephens tells 10News. He says he doesn't even remember Braun's surgery. “Given that I've done 5,000 plus surgeries, only the remarkable ones stand out and that entire day was thoroughly unremarkable,” he adds. However, it doesn't end with that day and that patient. The allegations are from 2017 and are detailed in a report published by the California Department of Public Health. In the report, three nurses came forward, and mentioned multiple patients. One nurse claimed to have witnessed the anesthesiologist's hand "underneath the sheets on four other occasions" when patients were "under general anesthesia". The report reveals that the nurse who allegedly witnessed Braun's assault claimed that the doctor's hand was under Braun's blanket, by Braun's groin. “She tried to pull the blanket off and he pulled it back and then she yanked it off and saw what he was doing,” says Braun. “I was still under anesthesia, unconscious when it happened,” he adds. “I have never been inappropriate with any of my patients, nor would I ever be,” says Dr. Stephens. We ask, “Why would three nurses falsely accuse you of something so egregious?” “It's speculation and I don't want to speculate. I don't see any benefit of me speculating in that respect,” he responds. According to the state report, the doctor said he sometimes may have had his hand "under the drapes" to "check EKG leads" and "monitor leads". In the report, it appears the nurses were the ones who got in trouble for not immediately and appropriately reporting what they allegedly witnessed. However, there's no mention of any corrective action for the doctor. “[The nurses] report something and they get reprimanded for it? That's not right,” Braun tells us. The hospital sent 10News the following statement: “Patient safety is a top priority at Scripps. While we are unable to comment on pending litigation, we can share that following allegations of improper conduct, the Medical Staffs of Scripps Mercy Hospital, Scripps Green Hospital and Scripps Memorial Hospital, Encinitas suspended Robert Stephens, M.D., and initiated a hearing before an arbitrator. After five full-day evidentiary sessions, the arbitrator found that, while the initial action was reasonable, the suspension was no longer reasonable and Dr. Stephens should be permitted to return to work. Subsequently, the parties reached a confidential agreement. After the agreement was reached, Dr. Stephens voluntarily resigned his Scripps Medical staff memberships and all clinical privileges.” Dr. Stephens says the arbitrator reviewed all the records and witness testimony. “[The arbitrator] ruled that not only was their story changing on that side but that their witnesses were not credible [and] their witnesses were not believable [and] I was credible and honest,” he explains.San Diego Police have an active criminal investigation, according to a Deputy District Attorney who's involved in the case. That DA confirmed that prosecutors have fought all the way up to the California Supreme Court to get records from Scripps Mercy Hospital, but have so far been unsuccessful. The DA agreed that his office is putting up a more aggressive fight than what's typical, but he wouldn't comment further about why. “I put my life in this guy's hands to take care of me and he abused his power,” says Braun. Last month, Braun sued Dr. Stephens, Scripps Health and Anesthesia Service Medical Group for assault, battery and negligence, among other complaints. Anesthesia Service Medical Group is Dr. Stephens’ former employer. It sent 10News the following statement: “ASMG was shocked and saddened to learn of the allegations made against Dr. Robert Stephens, a former employee of ASMG. From the moment ASMG learned of these allegations, Dr. Stephens has not provided care to any ASMG patients. Dr. Stephens was hired after very extensive background and credentialing checks, and up until the time these accusations were made, there was nothing to indicate that Dr. Stephens might present a risk to patients. ASMG is committed to hiring only those physicians who will provide the highest level of patient care, and will aggressively defend itself against any claim that it negligently hired or negligently employed Dr. Stephens.” “The initial allegations are very catchy and they do pack a punch but they aren't the truth,” says Stephens. The other patients who may have been affected don't know it. According to the state report, they couldn't be identified. VALLEY CENTER, Calif. (KGTV) -- The San Diego County Sheriff’s Department is searching for a North County man who disappeared November 14. According to authorities, 54-year-old Brian Lee Danelson was reported missing November 20 after disappearing from the Harvest Farms Market in Valley Center days earlier. Danelson left without his wallet and his cellphone was disconnected, according to his family.Deputies have searched the area surrounding his home in Valley Center and have checked with hospitals to see whether or not he was admitted. According to the Department, Danelson has a tattoo of a tiger on his inner left calf. He is described as six foot tall with gray hair and blue eyes.
