The Kern County, California District Attorney's Office has decided not to file charges against a man who was on death row for more than two decades, setting him free.Lisa Green made the announcement on Tuesday, saying the case would be nearly impossible to retry in court. She said it would be very difficult to convince a jury beyond a reasonable doubt of Benavides' guilt.According to a decision released by the California Supreme Court last month, the convictions of Vicente Benavides in 1993 "were based on false evidence and that he received ineffective assistance of counsel."The decision also says that "false evidence was introduced at trial and that petitioner's convictions of substantive sexual offenses, special-circumstance findings, and judgment of death must be vacated."Benavides was convicted in 1993 of first-degree murder, rape and other charges. He was sentenced to life. He was serving his term on death row in San Quentin. It was asked that his murder conviction be reduced to second-degree murder. That was also thrown out. The judgment has been vacated entirely. The California Supreme Court cited multiple doctors who evaluated 21-month-old Consuelo Verdugo in November 1991 when she died. The baby was taken from the Delano Regional Medical Center to Kern Medical Center then eventually the UCLA Medical Center where she died November 25, 1991.Multiple reports were made by doctors who said based off the inability to insert a catheter, bruising found near Consuelo's genitalia and other factors, they believed she had been sexually assaulted.In the report put out by the California Supreme Court, many of those doctors then admitted later they were wrong in their initial assumptions and those issues "can instead be attributed to medical intervention," like multiple attempts at inserting a catheter.Speaking on behalf of Benavides’s post-conviction legal team after the conviction was lifted, the Habeas Corpus Resource Center’s Interim Executive Director, Michael J. Hersek said he and his team were pleased with today's decision. 2113

Awbreyk says about 91 million tons of goods on average come through the area per year.“The equivalent of 25,000 semi-trucks worth of cargo passes through this site every year,” says Awbreyk. “You can imagine the wear and tear on the interstates and the highways that would have an extra 25,000 vehicles that will be on there per day."The project's price tag has grown to around billion. The pandemic has added extra stress to our lives, but that's not stopping some of us from getting more sleep.New research from the University of Colorado Boulder and the University of Washington looked at how stay-at-home orders and social distancing guidelines have impacted college students' sleeping habits.They found that on average, students have been sleeping 30 minutes more per weekday and 24 minutes more per weekend day. They've also been keeping more consistent sleep schedules.This is similar to what a study of people ages 18 to 65 in Europe found during this same time.So, the big question now is whether these habits will continue now that stay at home orders are lifted.“One of the things we recognize is that when people who weren't getting enough sleep start to actually get better sleep because they can and they realize ‘wow that makes a difference in my life,’ a number of people choose behaviorally to go ahead and continue to get that better sleep,” said Ken Wright, integrative physiology professor at CU Boulder.As for the question about whether the quality of our sleep has improved, the study in Europe did look at that. It found on average, people have been seeing slight reductions in the quality of their sleep, but there are things you can do to help with this.“When they looked at the group as a whole, they found that those people who got exercise and got more sunlight during the COVID stay-at-home, they found that they actually had less reductions in their sleep quality,” said Wright.One negative result of the stay-at-home orders on our sleep in both studies – people have been going to bed later, both during the week and on weekends. Researchers say it will probably be healthier for us if we can start going to bed earlier now. 1776
