CHICAGO (AP) — A Cook County judge has shot down actor Jussie Smollett's attempt to have the criminal charges against him dropped. In a ruling issued Friday, Judge James Linn rejected the argument made by the actor's attorneys that the new charges filed after the original charges were dropped violates Smollett's right against double jeopardy. Linn found that double jeopardy does not apply because Smollett has never been criminally punished.In January 2019, Smollett told Chicago police that he was the victim of an anti-gay and racist attack but he was charged after police concluded that he allegedly staged the attack himself. 640

CARLSBAD, Calif. (KGTV) - The purchase of a dream home nearly turned into a nightmare for a Carlsbad family, as they narrowly avoided a costly escrow scam.In late July, Greg Shoman and his wife were just days from closing on a four-bedroom home when he thought he got an email from his escrow officer with wiring instructions for the down payment to be sent that day. In the email, the escrow officer said she was busy and could only talk by email, before sending him a calculation of the closing costs. "You see so many emails and documents during the process, and you start to become numb to it ... Everything on the email - from the masthead to the signature - looked like the emails we had been receiving from the escrow company during the process," said Shoman.Shoman went to his bank to wire the money. His bank happened to be the same bank the money was to be transferred to, and the bank confirmed the routing number matched a non-business account in Wisconsin, not a California escrow company. After a call to the real escrow company, he learned the emails were fakes."Surprised and angry, and then ultimately relieved you didn't give away several hundred thousand dollars," said Shoman. Shoman isn't alone. According to the FBI, Americans lost 0 million to real estate fraud last year. In many cases, the scammer identifies pending home sales through the MLS and real estate sites and hacks the emails of someone involved in the sale, before sending out false wiring instructions."Be aware, be vigilant, and call your escrow company. Don't be afraid to triple check," said Shoman's realtor, Ilana Huff of Pacific Sotheby's.Shoman says the FBI is investigating his case. He says a closer look at the emails revealed the email address in the scam message was different from the email address of the real escrow officer. 1838

CAPE YORK, Australia – Australian scientists say they’ve discovered a massive new coral reef that’s taller than the Empire State Building.The scientists were aboard a research vessel exploring the sea when they found the detached structure in the Great Barrier Reef last week, according to a press release from the Schmidt Ocean Institute.The institute says the “blade-like” reef is the first to be discovered in over 120 years.On Sunday, the institute’s team conducted a dive using an underwater robot to explore the new reef and learned that it's more than 500 meters high, the base is about 1.5 kilometers wide and it rises to its shallowest depth of only 40 meters below the sea surface.The newly discovered reef adds to the seven other tall detached reefs found in the area since the late 1800s.“This unexpected discovery affirms that we continue to find unknown structures and new species in our ocean,” said Wendy Schmidt, co-founder of Schmidt Ocean Institute. “The state of our knowledge about what’s in the ocean has long been so limited. Thanks to new technologies that work as our eyes, ears and hands in the deep ocean, we have the capacity to explore like never before. New oceanscapes are opening to us, revealing the ecosystems and diverse life forms that share the planet with us.”This isn’t the institute’s first big discovery of the year, though. "COVID cars are cars that have been sitting around for a long time and the batteries do not work," Bob Gugino, owner of Bison Automotive said. Gugino says he has seen a number of cars with similar issues with rotting brakes, dead batteries and severe neglect. "Every day people are working more and more from home so this is a consequence of that," Gugino said. These consequences of cars just sitting around are happening to vehicles of all ages. "All cars, whether new or old," Gugino said, "It affects the older ones a little bit more but every car, if it's not run, can have the battery die and the brakes rot out."The best way to make sure that does not happen? Drive your car around even if you don't plan on going anywhere. CAMPO, Calif. (KGTV) -- A man was arrested after reportedly assaulting two Border Patrol agents as they attempted to arrest him for trying to smuggle people into the U.S. According to the agency, the incident happened around 1:17 a.m. Tuesday as agents patrolled Interstate 8 in Campo. Agents tried to stop a 2007 Ford F-350 near Kitchen Creek Road when the driver took off, leading agents on a high-speed chase. RELATED: 14-year-old tried to smuggle meth strapped to body, CBP saysAccording to Border Patrol, agents successfully deployed a tire deflation device, forcing the vehicle to stop a short distance later, but the driver got out and fled on foot. As agents searched for man, he reportedly jumped out of a nearby bush, tackling one of the officers to the ground. A second agent also responded to the scene, struggling with the suspect as well. Inside the F-350, agents found three men and one woman, all Mexican nationals in the U.S. illegally. They were all taken to a Border Patrol station for processing and the suspect, identified as a 37-year-old U.S. citizen, was arrested.
