SAN DIEGO (KGTV) - A battle is brewing between the San Diego bay cruise companies over which companies can start up again and which ones cannot. Some companies are cleared to resume dinner cruises next weekend, while others are still stuck at the docks. On Hornblower Cruises & Events’ Facebook page, the announcement is up that it's reopening this upcoming weekend. Wednesday, the fleet was docked but starting Saturday, the company is offering dining cruises through the bay. “At the moment, we have not been permitted to leave the dock,” said Carole Noska, owner of Charter Services. She told 10News that her boat and other charters still can't operate bay tours. County guidelines only permit recreational boating, not charters, and the recreational sailing is only for passengers within the same household. The County reports that dining cruises, though, are fine to set sail so long as they operate within the County's dine-in guidelines for restaurants.“We probably lost ,000 to ,000 over Memorial weekend after having already been at the dock for the last two months since COVID started," Noska told 10News and added, “Those of us in the legal charter community the credentialed vessels for charter would just ask that the County and the Port and the State level the playing field.”In a press release, Hornblower Cruises & Events provided an extensive list of safety measures its implementing, including social distancing aboard, and facial covering requirements. The company sent 10News the following statement on Wednesday."In accordance with the latest Stage 2 Variance which now permits dine-in restaurants to operate, we are thrilled to be able to offer a limited choice of seated dining cruises starting this weekend. Like other restaurants within the County, we are adhering to the specific guidelines laid out in the San Diego Safe Onsite Dining Plan for Restaurants and the State guidance for Dine-in restaurants. In addition to already stringent cleaning protocols, we are adapting the onboard experience to reflect the need for social distancing, alongside elevated health and hygiene practices. So, while our Guests can still expect the same high standards and welcoming service, they can be assured we are fully compliant with all relevant and necessary requirements."Flagship Cruises & Events is starting dining cruises as well, but the company is also doing bay tours which is in violation of the County health code. The company was cited by Harbor Police over the holiday weekend but reports that it is continuing its operation, maintaining its allowed to do so under a certain section of County code, which the County disputes. 2679

SAN DIEGO (KGTV) -- A big step taken in the effort to get the San Diego Police Department to stop using a specific restraining maneuver during arrests.On Tuesday, the community review board voted to recommend that the department gets rid of what police call a carotid restraint in some circumstances.  "Have you ever been choked or had the life choked out of you? I can snap back too!" The public was allowed in the meeting but was not supposed to talk. Desiree Smith couldn't help herself, because this issue is personal. "My son was choked by police at a homecoming event at the school," she said. The community review board debated whether or not San Diego police officers should be able to use the carotid restraint.Police are currently allowed to use the tactic to subdue people that they are trying to detain. Smith told 10News she does not think the restraint maneuver should be used, ever."It's inhumane," she said. "I wouldn't do it to an animal, let alone a human. They have stronger laws for animals than they do for humans."  1085

SAN DIEGO (KGTV) — A coalition of groups protesting how law enforcement officers use force says it plans to launch a recall effort against San Diego District Attorney Summer Stephan in 2019."You're going to see us all over this county," said Oletha Wade-Matthews. "We're not going anywhere until we see justice, or get you out of office."Around one dozen people gathered Downtown Tuesday to speak at a San Diego City Council meeting, then hold a press conference. They pointed to several deaths which have occurred this year in law enforcement custody, including Earl McNeil earlier this year, and Vito Vitale and Jason Watts in the first three weeks of October.RELATED: No criminal charges to be filed in National City Police custody death of Earl McNeilThe protestors say it's critical to have more PERT (psychological emergency response team) crews available to advise officers on how to apprehend suspects who are either on drugs or suffering from mental illness.In Vitale's case, they criticized officers for holding Vitale down."There has to be medical doctors that will tell you when someone is high on drugs, when someone is having a mental crisis. SAN DIEGO (KGTV) -- A driver apparently lost control of his SUV and crash landed on the roof of a University City home early Tuesday morning.The crash happened at around 1:15 a.m. in the 3000 block of Pennant Way, according to San Diego police.Bill Crane told ABC 10News that after he heard a loud crash, he came out of his home and saw the male driver in his yard and the Jeep Cherokee Laredo on top of his next-door neighbor’s house."I was asleep at the time and I heard this crash, and I came out and I looked around and saw a guy kind of wandering near behind me, by what's left of the tree, and he was just kind of stumbling and I couldn't figure out what the hell that was. Because you usually don't think of a car being on someone's roof. So, when I finally figured that out, I went in to get my phone, and came back out and called 911, and he was gone,” Crane said.Crane called 911 to report the crash, and he then called the woman who lives in the house. However, Crane said the woman initially didn’t believe her.Crane added, "I called her twice and she said, 'What, a car on my roof? I'm not going out there, I can't believe that.’ It is pretty unbelievable.”ABC 10News learned the woman was asleep at the time and never heard the crash. She believes the SUV was coming down Pennant Way, somehow veered on a resident’s front lawn and launched onto her garage.A towing service used a crane to remove the Jeep from the roof of the home’s garage.There is no word on how much damage the home sustained, but inspectors said the house was structurally sound despite the wreck.No one was hurt in the crash.As of late Tuesday morning, police have not tracked down the SUV's driver. 1692

SAN DIEGO (KGTV) - A 21-year-old man was hospitalized Monday after he was stabbed in the back and arm by a home intruder in the Oak Park neighborhood, police said.It happened around 11:55 p.m. Sunday at a home on Fauna Drive, located off College Grove Drive just northwest of state Route 94, San Diego police Officer John Buttle said.The victim went downstairs to get some milk for his daughter and found a man standing in his kitchen, Buttle said.A struggle ensued and the victim was stabbed in the back and the right arm before his assailant fled, the officer said.The victim's wife drove him to a hospital for treatment of his injuries, which were not believed to be life-threatening, Buttle said.No detailed suspect descriptions were immediately available.Detectives with the San Diego Police Department's southeastern division were investigating the stabbing. 872
