SAN DIEGO (KGTV)- Many Americans say cell phone are their lifelines. But what happens when yours breaks? Whether for convenience or for price, third-party repair shops are the choice for many customers. Unfortunately, some Apple users with the latest phones say they're not able to go to third-party shops. Four years ago, Christopher McQueen said he found the perfect niche business. “People are always breaking their phones, late at night,” McQueen said.He is the owner of Mobile Cell Doctors. Any brand, any phone, any version. He will come to you and fix your phone.“To be able to fix your phone in 10 minutes, versus a 3-hour fiasco at Apple, it was a need that was definitely there,” McQueen said. He said he can fix any hardware problems, except on the most recent iPhone models - iPhone 8, 8 Plus and X.Just recently, iPhone 8 user Lucas Peckham went to McQueen to get his broken screen replaced. His choices were 0 with McQueen or 9 at the Apple Store. He chose the cheaper, more convenient option.Peckham said everything was flawless until one morning, he woke up to a phone with a frozen screen. He could not swipe, touch, type, or do anything with his device. Peckham said it happened after his phone automatically updated overnight, installing the Apple 11.3 Software.McQueen said he was suddenly inundated with calls from all of his previous iPhone 8 customers. “It’s been a nightmare,” McQueen said. He said he had fixed about 100 iPhone 8’s in the last six months. He suggested to his customers, to do what they hoped to avoid by going to him in the first place - go to the Apple Store. But Peckham said, when he showed Apple the problem, he was told, because he previously used a third-party repairman, they could not repair it. Instead, he had to replace it with a brand new screen for 0 - or buy a whole new phone. “I totally felt screwed,” Peckham said. With no other option, Peckham said he gave in, spending six hours at the Apple Store, and paying up the 0. “It was basically a way for Apple to create kind of a monopoly on the iPhone screen,” Peckham said. Last month, California became the 18th state to introduce a “Right to Repair” Bill, which would require electronics manufacturers to make repair information and parts available to owners and third-party repair shops.McQueen hopes this legislation passes, so mom-and-pop business owners like him also get to have a piece of the pie. “I would love to fix those,” McQueen said. “But until they release the software to run the phones that would allow third-parties to work on those devices, we can’t fix them.”10News spoke to Apple, who said they do work with Authorized third-party dealers that are not Apple Stores. SAN DIEGO (KGTV) - A mountain biker wants to warn people about visiting the Tecolote Canyon Nature Trail. He tells 10News he had a disturbing encounter there with a man carrying a knife. Mike Hayes was feet from a trail entrance in Tecolote Canyon off Mt Acadia Boulevard when he was approached by a strange man on Sunday. Hayes says he was walking his bike near the man - a transient in his 20s, dressed in camouflage - when the man suddenly came forward and asked if Hayes was stalking him.  When Hayes said no, the man got agitated and had a look with "Charles Manson eyes." "Next thing you know, he has a knife in his hand and an angry look," said Hayes. "And he says 'If you follow me, I'm going to cut you.'"Hayes says he backed away slowly, got on his bike and rode off, while the man walked his bike away.     875

SAN DIEGO (KGVT) - For many students across California, school is either back in session or will start soon in a virtual setting.With uncertainty about what the school year will look like for all children, the parents of students identified as needing special education services are raising serious concerns about their child’s access to necessary supports and resources."Right now, school is virtual," said Sally Sachrison. "It’s been quite a challenge".Sachrison's 12-year-old son just started the 7th grade. That's an achievement, but the emotions she's feeling are not the typical excitement of going back to school."It's just overwhelming because distance learning doesn't always work for everybody, and I feel like they have abandoned our kids that really the special services," Sachrison said.Her son has Down syndrome and is autistic. His unique needs can’t be met over a computer, Sachrison said.“The conflict is that my son needs like a special education teacher, he needs a speech pathologist, he needs an occupational therapist, and these are specialized, trained professionals," she explained.Sachrison said she’s already noticed her child regressing just since schools moved to remote learning in mid-March to prevent the spread of COVID-19. By May, he was slurring his speech and having trouble with other tasks, she described.Regression and lack of services are a concern heard by attorney's and advocates from parents across the state."How do you take a parent and say hey we're going to train you to do occupational therapy even though you're not licensed to do it?” said Nicole Shelton, the executive director of Advocacy Associates Inc. "You don't have that background and still have that done virtually."Advocacy Associates Inc. is an origination that helps families of students with specials needs get the services to which they are entitled by law.In California, once a child is found eligible for special education, the family will participate in the process by attending an individualized education program or IEP.It's both a process and a written document.Shelton explained the IEP team, which includes representatives from the school and district, meets once every three years to conduct an assessment to ensure the student still qualifies. The team must also meet annually to review progress on goals, create new goals, and see what accommodations the student needs.She said parents are concerned that won't happen."I think it's important for parents to be requesting IEP meetings right now," Shelton said.There are also concerns about services not being provided and compensating students if they've regressed because they weren't provided with appropriate services and support."I think parents absolutely need the first step to be asking for that emergency IEP," she said. "We need to talk about services, and we need to talk about accommodation."In Sachrison's case, the district told 10News, "Providing equitable educational experiences to all students including students with disabilities is a key priority for us and we want the service you receive to reflect that principle. Due to the current school closure emergency that prevents in-person instruction, student Individualized Education Plans will be implemented through distance learning to the greatest extent practical via online resources and other means. The IEP will be provided by means of ‘distance learning’, as determined by your child's teachers, in light of the emergency circumstances."A district spokesperson explained, “‘Distance learning’ means instruction in which the pupil and instructor are in different locations. ‘Distance learning’ may include, but is not limited to, all of the following: (1) Interaction, instruction, and check-ins between teachers and pupils through the use of a computer or communications technology. (2) Video or audio instruction in which the primary mode of communication between the pupil and certificated employee is online interaction, instructional television, video, tele-courses, or other instruction that relies on computer or communications technology. (3) The use of print materials incorporating assignments that are the subject of written or oral feedback. This applies to the special education and related services in the IEP to the greatest extent possible in light of the emergency circumstances. Under current public health and CDE guidelines we cannot provide services either at the school, or in person, for more than 10 days due to the qualifying state of emergency. The parent will be notified as to the specific means by which the student's IEP will be provided, given the emergency circumstances present at that time. The IEP will be provided by alternative means as necessitated during the period of emergency conditions only."The district said IEP meetings are being scheduled to take place virtually and it is dependent upon the IEP team to determine whether new goals will be developed on an individual basis.When asked how the district plans to handle learning regression from the spring and forward and whether the state has provided any guidance a spokesperson explained, "When ‘regular’ school hours resume there will certainly be a need to discuss each students' services since distance learning falls short of providing optimal outcomes. At that time students with disabilities, in addition to ALL students in the general education setting, will have to undergo some form of instructional/educational recuperation. Our district is currently considering multiple options to meet this need."A spokesperson for the California Department of Education said students who are receiving special education services through their school district have an IEP and the services and/or accommodations they receive are listed in that IEP."The federal government has not waived the federal requirements under the Individuals with Disabilities Education Act (IDEA) and local educational agencies (LEA) should adhere to IDEA requirements. In the upcoming school year, local educational agencies in consultation with their local health agency may offer in-person instruction, distance learning, or a combination of both. Section 43503(b)(4) specifies that distance learning shall include "Special education, related services, and any other services required by a pupil's individualized education program pursuant to Section 56341, including the requirements of subparagraph (A) of paragraph (9) of subdivision (a) of Section 56345, with accommodations necessary to ensure that individualized education programs can be executed in a distance learning environment." 6617

SAN DIEGO, Calif. (KGTV) - A large San Diego Church is continuing to hold in person, indoor services despite orders from San Diego County to hold services in outdoor settings only. Awaken Church has gotten three cease and desist orders at different locations and also had an outbreak at one of those locations, according to San Diego County.County Supervisor Nathan Fletcher said the church is not cooperating with the county in regards to the outbreak at their Balboa location, so the county had to publicly announce the community outbreak and ask anyone impacted to quarantine. Typically, the specifics of community outbreaks would not be publicized, but he said the lack of cooperation from the church led to the public notice.“The Awaken Church in general has continued to be very defiant and continue to put the members of their church at a great risk and continue to not cooperate as we seek to investigate positive cases, which led us to the unique situation of publicly reporting that they did have a public outbreak at the Awaken Church,” said Supervisor Fletcher.Anyone who went to the location at 7620 Balboa Ave. between Nov. 15 and Nov. 22 is asked to quarantine for two weeks.Related: County asks Kearny Mesa church attendees to quarantine after COVID-19 outbreakSupervisor Fletcher said the county is trying to find a balance between respecting freedom of religion and also keeping the community safe.“We do recognize the first amendment role and I recognize the important role faith plays in our lives and in our community, particularly in a time of difficulty, which is why we work so hard to try and make sure that it is available, it just has to be available in a safe way,” he said.Glenn Smith is a Professor of Constitutional Law at California Western School of Law and also teaches at UC San Diego, and said there’s a chance churches could fight restrictions in court, but it depends on the circumstances. He said if a church is impacted by blanket rules for an area, they would likely not win in court. A church would have to prove that they were treated differently.“If religions are being treated in a nondiscriminatory fashion, in other words if there’s a general law that establishes how many people can be in a room or what are the conditions, and it happens to have an incidentally impact on religion, that’s not a special problem as long as government has a rational reason for doing that, that’s alright. It’s only when government discriminates against religion that a special level of review called strict scrutiny is required and government has to have a really really good reason for discrimination,” said Smith.He added that the makeup of a court will also impact any future decisions on religious freedom, saying when Justice Ruth Bader Ginsburg was alive, cases regarding religious freedom during the pandemic were found to not be discriminatory, however with the newly appointed Justice Barrett, it’s more likely the Supreme Court would rule in favor of a church. 3009

SAN DIEGO (KGTV)— Surfers and swimmers stayed away from San Diego waters after the National Weather Service issued a high surf advisory Saturday. Conditions were deemed dangerous for Southern California coastlines, with the highest waves reaching eight to ten feet in San Diego County.10News met San Diego locals Derek Janich and his daughter Kaylee at Ocean Beach. “No plans to get into the water today. Maybe on a more warm day,” Janich said. “It’s a little blown out and a little cold, lately. Definitely big surf today. You have to be careful when you’re in the water.”But out-of-towners Benjamin Guffee and his children could not resist dipping their toes in the San Diego waters. “It’s in a pool back in St. Louis, so they’re not used to this,” Guffee said. With gusty winds, water temperatures in the mid-50’s and waves jumping onto the Ocean Beach Pier, access to the pier was closed off, disappointing some visitors.“It’s normally, open — a nice walk.
