When snow falls in a flurry and the weather is cold outside, escaping the elements becomes a top priority.With COVID-19 causing some warming shelters to stop operations this winter, however, the impacts could literally mean the difference between life and death.“We’re going to see a lot of people die to be perfectly honest,” said Robin Wood-Mason with The Delores Project, a homeless shelter in Denver, Colorado, that focuses on women and transgender folks.He says during a normal winter, this shelter can provide a warming space for dozens of people each day. But with a static population and a lack of social distancing, local health guidelines have forced them to shut their doors for warming shelters this season.“It’s heartbreaking,” Wood-Mason said of the warming shelter not being able to open this winter. “Here in Denver, we’ve got thousands more people experiencing than there are shelter beds available.”Across the country, other warming shelters are also being impacted by COVID concerns.“We’re just starting to inch into those winter months when we know things are going to get colder, things are going to look and feel a little different into our regions,” said Andrea Carlson with the American Red Cross.She says the days of having people packed in to one large room to get warm are gone. Now, they’re putting people into multiple separate spaces and following new COVID safety protocols.“Distanced between each other, masks are required, you do have some health checks when you come into the warming center,” Carlson said.As winter weather rolls in, and limited capacity issues mean more people are staying outside, The Delores Project believes more people will be exposed to harsh weather and the virus.“It means that we’re really going to see people get sick,” Wood-Mason said. “It’s going to put a new burden on the hospital system and our first responders.” 1887

WEST PALM BEACH, Fla. — There were plenty of Palm Beach County residents opposed to a mask mandate. Now some of them are suing to stop it.A lawsuit filed Tuesday in Palm Beach County court seeks injunctive relief to overturn the county's order.Attorneys representing Palm Beach County residents Rachel Eade, Carl Holme, Josie Machovic and Robert Spreitzer claim the new order requiring that masks be worn in public places infringes upon the constitutional rights of the plaintiffs.The 37-page lawsuit, filed by the Coconut Creek-based Florida Civil Rights Coalition, argues that the plaintiffs and other residents are having their "well-settled constitutionally protected freedoms" violated, including their "constitutional and human right to privacy and bodily autonomy."The lawsuit goes on to say that the county, having no authority to do so under Florida law, "has recklessly required countless American citizens and Florida residents," including the plaintiffs, "to submit to dangerous medical treatments with well-known risks and potential for serious injuries and death, including being forced to wear harmful medical devices like masks."Palm Beach County commissioners unanimously voted last week in favor of the mask mandate to help prevent the spread of the coronavirus amid a recent surge in cases throughout the county and state.The lawsuit takes aim at the "ridiculously vague" language of the order, which attorneys for the plaintiffs claim forces residents and visitors "to guess at the meanings and be subjected to punishment and criminal consequence."It also chastises the order's exemptions "because it arbitrarily and absurdly discriminates against anyone over the age of 2 years old, and countless citizens" who don't meet the "unlawful order's vague and ambiguous exceptions."The lawsuit berates county leaders for not clearly defining terms like "businesses or establishments" and "persons" as it is written in the order."Are non-citizens included?" attorneys wrote. "One is only left to guess, which is why the unlawful order is void for vagueness."Attorneys for the plaintiffs argue that a permanent injunction "will serve the public interest.""Millions of Palm Beach County residents and visitors are burdened by the over-reach of their local government in a fashion not before seen in the history of Florida," they wrote, adding that residents are "unduly burdened" by this violation of their rights. "The public has a strong interest in protecting their rights and ability to control their own bodies in the workplace and in public."Palm Beach County State Attorney Dave Aronberg said during a news conference Friday that commissioners do, in fact, have the constitutional authority to mandate masks."Obviously, those individuals who claim that they know the First Amendment have obviously never read the First Amendment," Aronberg said. "Because it is within the authority of the County Commission to put forward a mask ordinance. They have the authority under state law. They have the authority under the Constitution."The lawsuit seeks expedited consideration because the order is currently in effect. A written response by the county is required within 20 days of the filing.Several studies show that a mask or facial covering limits the wearer from spreading airborne droplets when speaking, sneezing or coughing. WEST SENECA, N.Y. —From the running water to the statues and perfectly trimmed plants, Pam and Dave Hubert's backyard in West Seneca, New York, is a place the couple can sit back and relax.But last fall was anything but relaxing for the family."I had a lump in the right side of my throat that I've had many times from having sinus infections," explained Dave. "I went to the doctor and he said something's not right this time.""His words were: you have cancer," Dave said. After months of grueling recovery, he was cancer-free, and could finally sleep and eat again.Pam was by his side throughout it all."We said there's got to be other purpose here than us being sick," Dave said. "I didn't get sick to get sick. I got sick cause someone else needs us to help them get through this."As fall approached this year, Dave had one question for his wife."He said to me, 'do you plan on decorating the yard for the fall?'" Pam recalled. "And I said 'yeah I usually do.' And he said, 'I was hoping you would say that, because last year I just couldn't, I was too tired, too weak I just didn't enjoy it the way I wanted to enjoy it.'""I tried to be out here doing some work," Dave said. "But I was just so tired. I was just so exhausted from the treatment."Pam decided this year needed to be different, so she put out a call on Facebook to people she knew, and to strangers."If there's somebody you know battling cancer or survived cancer, or may have lost a battle to cancer, I would like to honor them," Pam said. "And if you have a pumpkin I'm happy to put it in my yard and we'll display it."That's when the pumpkins started showing up. They have names of patients who have fought cancer, and also messages to those who were lost to the disease. 1929

The National Guard put up sandbags to protect the island.With predictions of possibly 11 feet of storm surge and 15 inches of rain, it could prove too much for other areas.“If they have a failure and in some cases, there will be failures, then the internal areas will flood and it’s very difficult then, once you have a breach in the levee, to keep the water from the outside coming in,” said Gerald Galloway, P.E., PhD.Hurricane Katrina hit the lower 9th ward 15 years ago this month.A billion network of new levees and floodwalls were put in. The Army Corps of Engineers said the system will stop providing adequate protection in as little as four years because of rising sea levels and shrinking levees.There are up to 100,000 miles of levees nationwide, most of them in serious need of repair.Levees received a "D" on the American Society of Civil Engineers' national infrastructure report card.“Where you have a challenge is those areas that are not yet protected. That’s going to be a problem and where they are outside the levees in some distance and there isn’t any normal flood protection,” said Galloway.Galloway's life's work is in flooding, partially with the Army Corps of Engineers. If water overtops levees, he says the best-case scenario is for pumps to get it out, or homes elevated, or at the very least people are evacuated. 1621

Buffalo Wild Wings thinks they're a natural fit.The sports bar chain, which has about 1,200 restaurants in all 50 states, said it is exploring the possibility of offering sports wagering now that the Supreme Court has opened the door for states to legalize sports betting."As the largest sports bar in America, we believe Buffalo Wild Wings is uniquely positioned to leverage sports gaming to enhance the restaurant experience for our guests," a company spokesperson said Thursday. "We are actively exploring opportunities, including potential partners, as we evaluate the next steps for our brand."Three states -- New Jersey, Delaware and Louisiana -- have legalized sports gambling since the Supreme Court decision in May. Before the ruling, Nevada was the only state where it was legal to bet on sports.Many other states are considering legislation that will allow for sports betting in the hopes of cashing in on what could be a multibillion-dollar industry."We're still waiting for state legislatures and regulators to hash out licensing rules, so it's unclear how they'll [Buffalo Wild Wings] have opportunity to participate," said John Decree, head of North America equity for Union Gaming, a boutique investment bank that focuses on the gaming industry.Current there are 43 states with some type of legal casino. But even states without casinos could move to allow sports gambling.Decree said that he thinks it's likely that Buffalo Wild Wings will partner with an established casino or other sports betting entity, rather than try to get licenses on its own as states move to allow sports wagering."It'll be hard for them to try to get licensed in every state that allows it. There's a lot of legal costs and time involved," he said.Much of the coming boom in sports gaming is expected to take place online, especially on mobile apps, meaning that many customers watching games at a Buffalo Wild Wings will be able to place bets at a variety of sports books in their states.Decree said it's likely that some states that allow online wagering will require people to put money on their account in person and using cash, rather than using a credit card.In that case, Buffalo Wild Wings could reach an agreement with some sports books that would allow people to put money on their account in one of their restaurants."That alone can generate a lot of foot traffic," he said.Buffalo Wild Wings was purchased for .9 billion earlier this year by privately-held Arby's. 2533
